For
the purposes of this Chapter, certain rules of construction apply
to the text as follows:
1.Â
Words used in the present tense include the future tense; and the
singular includes the plural, unless the context clearly indicates
the contrary.
2.Â
The terms "shall" and "must" are
always mandatory and not discretionary; the words "may" or "should" are permissive.
3.Â
Words or terms not interpreted or defined by this Article shall be
used with a meaning of common or standard utilization.
4.Â
The word "person" includes a firm, organization,
association, partnership, trust, company or corporation, as well as
an individual.
5.Â
The words "use" or "occupy" shall
include the words "intended", "designed" or "arranged" to be "used" or "occupied".

For the purpose of this Chapter, the following terms, phrases,
words and their derivations shall have the meaning given herein.
Buildings and structures which are clearly incidental to
and customarily and commonly associated with the main permitted use
of the premises. Such accessory buildings and uses shall not be so
constructed, maintained and conducted as to produce noise, vibration,
concussion, dust, dirt, fly ash, odor, noxious gases, heat or glare
which is injurious, damaging or unhealthful to adjacent property or
the uses thereof and shall be on the premises of the main use. Each
accessory building requires a building permit.
A group program designed to provide care and supervision
to meet the needs of functional impaired adults for periods of less
than twenty-four (24) hours but more than two (2) hours per day in
a place other than the adult's own home but such facilities shall
not be allowed in a "Shopping Center."

A program of organized therapeutic, rehabilitative and social
activities provided outside the home for a period of less than twenty-four
(24) hours to persons with functional impairments of at least an intermediate
care facility (ICF) level of care. For the purpose of this definition "adult", means a person eighteen (18) years of age or older.
Any business or establishment which offers its patrons services
or entertainment such as books, videos, periodicals and the like characterized
by an emphasis on matter depicting, describing or relating to sexual
activities or specified anatomical areas.
Any public space or thoroughfare twenty (20) feet or less
in width but not less than ten (10) feet in width which has been dedicated
or deeded to the public for public travel and which affords secondary
access to abutting property.
Any change or modification to the exterior of a building,
site, structure or object that requires a Building Permit or any change
or modification to an exterior architectural feature as identified
by the Landmark and Historic District Commission ("LHDC") at the time
of the nomination and designation by the City Council. Alteration
does not include repair nor does it include landscape maintenance.
As applied to a building or structure, a change or rearrangement
in the structural parts or in the exit facilities or an enlargement,
whether by extending on a side or by increasing in height, or the
moving from one location or position to another.
Less than completely or opaquely covered:
Any device that transmits and/or receives electromagnetic
signals for voice, data or video communications purposes including,
but not limited to, television, AM/FM radio, microwave, cellular telephone
and similar forms of communications. The term shall exclude satellite
earth station antennae less than six (6) feet in diameter, any receive-only
home television antennae, ground-mounted antennas and antennas constructed
primarily of wire and used for non-commercial purposes.
A structure for the protection and security of communications
equipment associated with one (1) or more antennae where direct access
to equipment is provided from the exterior and that has horizontal
dimensions that do not exceed four (4) feet by six (6) feet and vertical
height that does not exceed six (6) feet.
A building for the protection and security of communications
equipment associated with one (1) or more antennae and where access
to equipment is gained from the interior of the building. Human occupancy
for office or other uses or the storage of other materials and equipment
not in direct support of the connected antenna is prohibited.
A tower or disguised support structure but excluding those
support structures under eighty (80) feet in height owned and operated
by an amateur radio operator licensed by the FCC.
The aggregate of the maximum horizontal cross section area
of the main building on a lot, excluding cornices, eaves, gutters
or chimneys projecting not more than two (2) feet, steps, one-story
open porches, balconies and terraces measuring from outer side of
wall.
A place where repairs, rental, washing, servicing, greasing,
adjusting or equipping of automobiles or other motor vehicles may
be performed but not including painting, body work and major repairs.
An institution that trades in money; an establishment for
the deposit, custody and issuance of money and also for making loans
and discounts and facilitating the transmission of remittances from
one place to another. Credit unions and savings and loans shall also
be classified as a bank, but "check cashing establishments", "short-term
loan establishments" and "pawnshops" are not classified as a bank.
A facility who holds themselves out as providing educational
services, duly licensed by the Missouri State Board of Cosmetology
and Barber Examiners for a barber school, cosmetology school or crossover
school.

A story partly underground and having more than one-half
(½) of its height below the ground. A basement shall be counted
as a story if subdivided and used for dwelling or business purposes.
Rathskeller or playrooms are not dwelling purposes.
A use within an occupied single-family dwelling wherein rooms
are rented and meals are served to overnight guests for commercial
purposes, as distinguished from a hotel or motel.
A microbrewery that brews beer for both on and off-premise
sale and consumption with an annual production of ten thousand (10,000)
barrels or less.

A structure having a roof supported by columns or walls and
when separated by a division wall without openings, each portion of
such building shall be deemed a separate building except as provided
in this Chapter.
The vertical distance measured from the curb level to the
highest point of the roof surface, if a flat roof; to the deck line
of mansard roofs; and to the mean height level between eaves and ridges
for gable, hip and gambrel roofs. For buildings set back from the
street line, the height of the building may be measured from the average
elevation of the finished grade along the front of the building.
A line parallel to and equidistant from the street between
which line and street no building or structure may be erected.
Any building or part of a building in which one (1) or more
persons are employed in the management, direction or conducting of
an agency, business or brokerage, labor or fraternal organization
and shall exclude such uses as retail sale, manufacture, assembly
or storage of goods, places of assembly and amusement, tattooing establishment,
check-cashing establishment or consumer installment loan establishment.
A measurement of the tree trunk diameter measured at two
and one-half (2½) feet above grade level.
A certificate issued by the Landmark and Historic District
Commission ("LHDC") indicating its approval of plans for alteration,
off-site relocation or demolition of a landmark or of a Historic District
contributing resource.
A certificate issued by the Landmark and Historic District
Commission ("LHDC") authorizing demolition, even though a certificate
of appropriateness has previously been denied.
A business engaged in check-cashing operations for a fee
as a primary or substantial element of its business and which is not
licensed by the appropriate State or Federal agency as a banking or
savings and loan facility.
A facility, other than the provider's permanent residence
or separate from the provider's living quarters, where any person
advertises or holds themselves out as providing care for more than
four (4) children for any part of the twenty-four (24) hour day, for
compensation or otherwise, except those operated by a school system
or in connection with a business establishment as a convenience for
its customers or for its employees. But such facilities shall not
be allowed in a "shopping center".
A family home, occupied as a permanent residence by the day
care provider, in which family-like care is given for more than four
(4) children but no more than ten (10) children, not related to the
day care provider, for any part of the twenty-four (24) hour day.
A business with a permit to sell alcoholic beverages that
generates twenty-five percent (25%) or more of its quarterly gross
revenue from the sale of cigars and/or rental of humidor space, has
a humidor on the premises and does not allow minors to enter the premises.

A building or portion thereof on premises owned or operated
by a corporation, association, person or persons for a social, educational
or recreational purpose, but not primarily for profit or to render
a service which is customarily carried on as a business.
Planning and Zoning Commission of the City of Florissant,
Missouri.
The Commissioner shall mean the Building Commissioner of
the City of Florissant, Missouri or designated representative.
The act of adding an addition to an existing structure or
the erection of a new principal or accessory structure on a lot or
property.
A company that is primarily or substantially in the business
of making loans secured or unsecured and are authorized under Chapter
367, RSMo., sometimes also referred to as "traditional installment
loan lenders," as authorized under Chapter 408, RSMo. A consumer loan
company shall not include companies sometimes referred to as "pay
day loan companies" or "title loan companies."

A building or complex of buildings that provides elderly
housing, catered living and/or assisted living dwelling units, skilled
and intermediate care nursing units and accessory services for residents
of the facility; and programs, outpatient care and rehabilitation
services provided by the facility to the general public.
A retail establishment having a gross floor area of five
thousand (5,000) square feet or less, primarily selling foods as well
as other household goods customarily sold in larger food markets and
supermarkets.
A method of adding, replacing or augmenting cosmetic features
by the placement of subcutaneous pigmentation by a licensed doctor
or nurse.
An open space which may or may not have direct street access
and around which is arranged a single building or a group of related
buildings.
A facility who holds themselves out as providing a space
for craft activities associated with learning techniques.

The level of the established curb in front of the building
measured at the center of such front. Where no curb has been established,
the Director of Public Works shall establish such curb level or its
equivalent for the purpose of this Chapter.
Any act or process which destroys, in part or in whole, a
landmark or a Historic District contributing resource or threatens
to destroy a landmark or a Historic District contributing resource
by failure to maintain it in a condition of good repair and maintenance.
A standard of appropriate activity that will preserve the
historic, architectural, scenic or aesthetic character of landmarks,
Historic District contributing resources and Historic Districts.
The Director of Public Works or his/her designee.
Any freestanding manmade structure designed for the support
of communications antennas, the presence of which is camouflaged or
concealed from ordinary view as an appropriately placed architectural
or natural feature. Such structures may include, but are not limited
to, clock towers, campaniles, bell towers, church steeples, observation
towers, signs, light standards and artificial trees of designs and
types as approved by the Building Commissioner.
Any section of the City of Florissant within which the zoning
regulations are uniform.
A detached or semi-detached building designed for or occupied
exclusively by two (2) families living independently of each other.
Any building, or portion thereof, which is designed or used
exclusively for dwelling purposes.
A detached building designed for or occupied exclusively
by one (1) family.
A building or portion thereof used or designed as a residence
for three (3) or more families living independently of each other
and doing their own cooking in said building, including apartments,
apartment hotels and group houses.
One (1) or more rooms physically arranged so as to create
an independent housekeeping establishment for occupancy by one (1)
family with at least one (1) separate bathroom and facilities for
cooking and sleeping.
A facility who holds themselves out as providing educational
services, pre- or after-school programs, summer educational camps,
and having obtained a written determination from the State Division
of Health and Senior Services that it is not a child day care center,
or having obtained partial funding from the State Department of Education
and Secondary Education to provide such services. But such facilities
shall not be allowed in a shopping center.

To build, construct, attach, hang, place, suspend or affix.
The sale of goods or products that are part of an estate
and such sale shall take place on the premises subject to the estate.
The architectural character and general composition of the
exterior of a structure including, but not limited to, the kind, color
and texture of the building material and the type, design and character
of all windows, doors, light fixtures, signs and appurtenant elements.
The Federal Aviation Administration.
An individual living as a single non-profit, housekeeping unit
in a dwelling unit; or
Two (2) individuals or married couple and the children thereof,
including adopted children, foster children and grandchildren, and
no more than two (2) other persons related to the individuals or married
couple by blood or marriage and no more than two (2) other individuals;
or
A group of not more than four (4) persons not related by blood
or marriage and not living as a group home but living together as
a single housekeeping unit in a dwelling unit as distinguished from
a boarding house; or
A group of nine (9) or fewer unrelated mentally or physically
handicapped persons (group home), excluding supervisory persons acting
as house parents or guardians, who need not be related to each other
or to any of the mentally or physically handicapped individuals residing
in a dwelling unit as distinguished from a boarding house.
The Federal Communications Commission.
A structure, partition or wall erected for the purpose of
enclosing a piece of land or to separate two (2) contiguous pieces
of land. Shrubs, hedges, trees or an ornamental divider consisting
of posts no higher than thirty (30) inches from the ground level,
spaced no closer than four (4) feet from each other and connected
by not more than two (2) strands or rails, having a minimum nominal
dimension of three-quarters (¾) inch, located along a private
walkway or driveway and not used to enclose an area shall not be considered
a fence.
Any building, structure or land used for the dispensing,
sale or offering for sale at retail of any automobile fuels, oils,
including accessories, lubrication of automobiles and replacement
or installation of minor parts and accessories, but not including
major repair work such as motor replacement, body and fender repair
or spray painting.
The square feet of floor space within the outside line of
walls and includes the total of all space on all floors of a building.
It does not include porches, garages or space in a basement or cellar
when said basement or cellar space is used for storage or incidental
uses.
The list of officially designated Landmarks, Historic District
Contributing Resources and Historic Districts within the City of Florissant.
That portion of a lot, parcel or tract of land adjacent to
or abutting a street.
A corner lot with a rear lot line adjacent to the side lot
line of the abutting lot.
A building or part thereof accessory to a main building and
providing for the storage of automobiles and in which no occupation
or business for profit is carried on.
A building, other than a private or storage garage, used
for the care, repair or equipment of self-propelled vehicles or where
such vehicles are kept for remuneration or hire.
A building or part thereof, other than a private garage,
for the storage of motor vehicles and in which service activities
may be carried on only by special permit for filling station.
Any dwelling in which nine (9) or fewer unrelated mentally
or physically handicapped persons reside, excluding supervisory persons
acting as house parents or guardians, who need not be related to each
other or to any of the mentally or physically handicapped persons
residing in the dwelling unit.
The vertical distance measured from the base of the structure
to its highest point and including the main structure and all attachments
thereto.
An area designated as a "Historic District" by ordinance
of the City Council which may include individual Landmarks, as well
as other properties or structures, referred to as Historic District
Contributing Resources which, while not of such historic and/or architectural
significance to be designated as Landmarks, nevertheless contribute
to the overall visual characteristics and historical significance
of the Historic District.
A building, site, structure or object within the boundaries
of a Historic District that adds to the historic, architectural, cultural
or archeological values for which the district is considered significant
but does not qualify as a Landmark.
Character, interest or value as part of the development,
heritage or culture of the community, County, State or country; as
the location of an important local, County, State or national event;
or through identification with a person or persons who made an important
contribution to the development of the community, County, State or
country.
An occupation or activity carried on by no more than two
(2) members of a family residing on the premises, including home work
activities carried on under the supervision of the State vocational
rehabilitation agency or pursuant to license issued by the State Department
of Labor, but excluding beauty shops, barbershops, music schools,
convalescent or nursing homes, tourist homes, massage or other establishment
offering services to the general public and providing that there are
no signs or any display that will indicate from the exterior of the
building that it is being utilized for any purpose other than that
of a dwelling, providing further, that there is no stock-in-trade
or commodity sold upon the premises, no person is employed other than
a member of the family residing on the premises, except as to the
said home work activities hereinabove authorized, no mechanical equipment
is used in the conduct of the activity or is stored on the premises
except such as is customary for purely domestic or household purposes
and, provided further, that not over twenty percent (20%) of the total
actual floor area of the improvements, exclusive of the basement,
is used for the conduct of such home occupation and except for the
storage of equipment for home operated lawn care businesses provided
that there is no more than one (1) properly licensed trailer stored
on the property, which shall be kept clean and that all equipment
pertaining to the lawn care business must be stored in the trailer
that shall not be larger than six (6) feet by sixteen (16) feet and
the equipment stored on the trailer shall not exceed six (6) feet
in height and the trailer shall be parked in an enclosed area or shall
be covered and parked behind the front of the property line on an
improved surface of asphalt or concrete.
A building in which lodging is provided and offered to the
public for compensation and in which ingress and egress to and from
rooms is made through an inside lobby or office supervised by a person
in charge at all hours and which is open to transient guests, as distinguished
from a motel or bed and breakfast.
A company that is licensed under Sections 367.100 to 367.200,
RSMo., or Section 408.510, RSMo., whose direct consumer loans are
limited only to traditional installment loans as defined in Section
408.512, RSMo. An installment loan lender is also referred to as a
"consumer loan company" but shall not include companies referred to
as "pay day loan companies" or "title loan companies."

A building occupied by a non-profit corporation or a non-profit
establishment for public use.
The use of an open space for the wrecking, dismantling or
storage of worn-out or wrecked automobiles or machinery or other worn-out,
cast-off, discarded or scrap material which is ready for destruction
or has been collected or stored for salvage purposes or conversion
to some use.
Any property, site or structure designated as a "landmark"
by ordinance of the City Council pursuant to the procedures described
herein.
The Landmark and Historic District Commission.
An off-street space or berth on the same lot with a building,
or contiguous to a group of buildings, for the temporary parking of
a commercial vehicle while loading or unloading merchandise or materials
and which abuts upon a street, alley or other appropriate means of
access and having a minimum dimension of twelve (12) feet by thirty-five
(35) feet and a vertical clearance of at least fourteen (14) feet.
A parcel of land occupied or capable of being occupied by
one (1) building and the accessory buildings or uses customarily incident
to it, including such open spaces as are required by this Chapter
and having its principal frontage upon a street or court.
A lot at the point of intersection of and abutting on two
(2) or more intersecting streets, the angle of intersection being
not more than one hundred thirty-five degrees (135°).
The minimum horizontal distance between the front and rear
lot lines.
A lot having a frontage on two (2) non-intersecting streets,
as distinguished from a corner lot.
A lot other than a corner lot.
A lot which is a part of a subdivision, the map of which
has been recorded in the office of the County Recorder of Deeds of
St. Louis County, or a lot described by metes and bounds, the description
of which has been recorded in the office of the County Recorder of
Deeds of St. Louis County.
A street of substantial continuity which serves or is intended
to serve fast or large volumes of traffic and is indicated as a major
street in the City Comprehensive Plan.
Cannabis indica, Cannabis sativa, and Cannabis ruderalis,
hybrids of such species, and any other strains commonly understood
within the scientific community to constitute marijuana, as well as
resin extracted from the plant and marijuana-infused products. "Marijuana"
or "Marihuana" do not include industrial hemp containing a crop-wide
average tetrahydrocannabinol concentration that does not exceed three-tenths
of one percent (3/10 of 1%) on a dry weight basis, or commodities
or products manufactured from industrial hemp.

A facility licensed by the State of Missouri to acquire,
cultivate, process, store, transport, and sell marijuana to a Marijuana
Dispensary Facility, Marijuana Testing Facility, or to a Marijuana-Infused
Products Manufacturing Facility.

A facility licensed by the State of Missouri to acquire,
store, sell, transport, and deliver marijuana, marijuana-infused products
and drug paraphernalia used to administer marijuana in accordance
with applicable law and regulations.

Products that are infused with marijuana or an extract thereof
and are intended for use or consumption other than by smoking, including,
but not limited to, edible products, ointments, tinctures and concentrates.

A facility licensed by the State of Missouri, to acquire,
store, manufacture, transport, and sell marijuana-infused products
to a Marijuana Dispensary Facility, a Marijuana Test Facility, or
to another Marijuana-Infused Projects Manufacturing Facility.

A facility certified by the State of Missouri, to acquire,
test, certify, and transport marijuana.

Exposed face brick or natural building stone which is used
as a facing component which is applied over exterior wall back-up
construction. Exposed masonry construction shall not include hollow
masonry units, concrete masonry units, glass blocks, plastic and/or
composite blocks, metal panels, plastic panels, plaster exterior insulation-finish
system, precast concrete panels or any composition and all cast-in-place
concrete walls, tilt-up concrete panels.
Any establishment operating in conformity with the Florissant
Code in which, for any form of payment or consideration, a massage,
alcohol rub, electric or magnetic treatment or similar treatment or
manipulation of the human body is administered except when such treatment
or manipulation is administered by a medical practitioner, chiropractor,
acupuncturist, physical therapist or similar person licensed by the
State or as a service provided by a medical facility, athletic club,
health club, reducing salon or similar establishment where massage
or a similar manipulation of the human body is offered as an incidental
or accessory service.
A facility licensed by the State of Missouri to acquire,
cultivate, process, store, transport, and sell marijuana to a Medical
Marijuana Dispensary Facility, Medical Marijuana Testing Facility,
or to a Medical-Infused Products Manufacturing Facility.

A facility licensed by the State of Missouri to acquire,
store, sell, transport, and deliver marijuana, marijuana-infused products
and drug paraphernalia used to administer marijuana in accordance
with applicable law and regulations.

A facility licensed by the State of Missouri, to acquire,
store, manufacture, transport, and sell marijuana-infused products
to a Medical Marijuana Dispensary Facility, a Medical Marijuana Test
Facility, or to another Medical Marijuana-Infused Projects Manufacturing
Facility.

A facility certified by the State of Missouri, to acquire,
test, certify, and transport marijuana.

The minimum regulations governing the conditions and maintenance
of all existing structures, as set out in the prevailing Building
Code or Property Maintenance Code and related codes and standards
as adopted by reference, with certain amendments thereto by the City
Council of the City of Florissant, Missouri, as such Existing Structures
Code shall be amended from time to time by the City of Florissant.
A building or buildings in which lodging is provided and
offered to the public for compensation and in which ingress and egress
to and from rooms is not made through an inside lobby or office and
which is open to transient guests, as distinguished from a hotel or
bed and breakfast.
The sale of goods or products owned by an individual upon
property which said person owns and is in the process of moving from
said property.
Any building or land lawfully occupied by a use at the time
of passage of this Chapter or amendment thereto which does not conform
after the passage of this Chapter or amendments thereto with the use
regulations of the district in which it is situated.
Any relocation of a structure, object or artifact, in whole
or in part, from its current site or to another site.
An area generally bounded by Castello, St. Marie, St. Michael
Streets including both sides of the street and Coldwater Creek.
A set of guidelines as adopted herewith and as may be hereafter
amended, which guidelines are applicable to and are designated as
the standards regulating the exterior design of buildings within those
portions of Old Town that are within "H" Historic Districts. Such
guidelines are generally based upon a document entitled "Old Town
Development Plan" dated August 18, 1970, and subsequent amendments
thereto. The guidelines set forth in the Old Town Development Plan
and Guidelines as adopted herewith and as may be hereafter amended
shall be considered as recommended actions and practices under and
in accordance with the Secretary of the Interior's standards, which
shall be considered the governing document for the Old Town Development
Plan and Guidelines.
Any work for which a Building Permit is not required by municipal
ordinance, where the purpose and effect of such work is to correct
any deterioration or decay of or damage to a structure or any part
thereof and to restore the same, as nearly as may be practical, to
its condition prior to the occurrence of such deterioration, decay
or damage and does not involve change of materials nor form.
The person(s), corporation or other legal entity listed as
the owner of record in the County Recorder of Deeds office.
Any place, lot, parcel or yard used in whole or in part for
storing or parking of six (6) or more motor vehicles where a storage
or parking fee is charged therefore or where the lot is operated in
connection with or for the use of the customers of a retail store,
theater or any commercial or industrial use.
A durable, dustproof, surfaced area, enclosed in the main
building, in an accessory building or unenclosed, sufficient in size
to store one (1) standing automobile and if the space is unenclosed,
a durable, dustproof surface area comprising an area of not less than
one hundred eighty (180) square feet, excluding the necessary driveway
and space between automobiles on the parking lot.
Any establishment which provides five (5) or more automatic
coin-operated amusement machines for use or operation by the public.
Any right or interest in or title to a property or any part
thereof including, but not limited to, fee title, scenic or other
easement, or the right of making exterior changes to or additional
development of the property.
An action by the City of Florissant or any of its departments
or agencies involving major modification or replacement of streets,
sidewalks, curbs, street lights, street or sidewalk furniture, landscaping,
parking or other portions of the public infrastructure servicing commercial,
residential, recreational or industrial development; or any undertakings
effecting City parks or City-owned structures.
Any change that is not construction, alteration, demolition
or off-site relocation and is necessary or useful for continuing normal
maintenance and upkeep.
A building where food and beverages are offered for sale
to the public for consumption at tables or counters either inside
or outside the building on the lot and take-out service of food and
beverages for off-site consumption is provided.
A building where food and beverages are offered for sale
to the public for consumption at tables or counters either inside
or outside the building on the lot.
Any dwelling in which one (1) or more persons, not members
of principal occupant's family, are housed or lodged for hire, without
meals.
The Secretary of the Interior's Standards for the Treatment
of Historic Properties are sets of treatment standards intended to
assist users in making sound historic preservation decisions for the
preservation, rehabilitation, restoration or reconstruction of historic
properties. The Standards are codified as 36 CFR Part 68 in the July
12, 1995, Federal Register (Vol. 60, No. 133) and as may hereafter
be amended.
Two (2) or more businesses located under a common roof and
conducted by different owners or managers.
A business, other than a pawn broker operating in conformity
with the Florissant Code, engaged in providing short-term loans to
the public as a primary or substantial element of its business and
which is not licensed by the appropriate State or Federal agency as
a bank or savings and loan facility, a consumer loan company or a
traditional installment loan lender. These businesses are sometimes
referred to as "pay day loan companies," "title loan companies" or
other similar names.

Any sign, billboard, commercial sign or illuminated sign
or any other lettering or device, the intent of which is to display,
illustrate or advertise the interest of any person, when the same
is placed out-of-doors in view of the general public.
The traditional, documented or legendary location of an event,
occurrence, action or structure significant in the life or lives of
a person, persons, groups or tribe or any place with evidence of past
human activity. Sites include, but are not limited to, cemeteries,
burial grounds, occupation and work areas, evidence of farming or
hunting and gathering, battlefields, settlements, estates, gardens,
groves, river crossings, routes and trails, caves, quarries, mines
or significant trees or other plant life.
An order directing an owner, occupant, contractor or subcontractor
to halt an action due to a Building Code or Zoning Code violation
or for which a Certificate of Appropriateness is required and notifying
the owner, occupant, contractor or subcontractor of the application
process for a Certificate of Appropriateness.
Any structure or part of a structure not in excess of fifteen
(15) feet, other than a cellar, included between the surface of any
floor and the surface of the floor next above it or, if there be no
floor above it, then the space between the floor and the ceiling next
above it.
A space under a sloping roof which has the line of intersection
of roof decking and wall face not more than three (3) feet above the
top floor level and in which space not more than two-thirds (2/3)
of the floor area is finished off for use.
Any street, way or place in private ownership and used for
vehicular travel by the owner and those having express or implied
permission from the owner.
Any public street duly accepted for maintenance by the City
of Florissant, St. Louis County and the Missouri Highway Commission,
the Federal Government or a municipal government.
Anything constructed or erected which requires location on
the ground attached to something having location on the ground, including
signs, billboards and satellite receiver dish defined as a device
which focuses an electromagnetic wave and/or laser onto an attached
receiver antenna.
A neat, orderly and healthy screen of evergreen plant material
not less than three (3) feet in height with an expected normal growth
of at least five (5) feet in height, protected by a galvanized wire
link fence at least five (5) feet in height. A wooden or masonry fence
or other landscaping may be substituted for the screening and wire-link
fence when determined to be appropriate by the Building Commissioner.
The systematic gathering of information on the architectural,
historic, scenic and archaeological significance of buildings, sites,
structures, areas or landscapes through visual assessment in the field
and historical research for the purpose of identifying landmarks or
districts worthy of preservation.
Any method of placing designs, letters, scrolls, figures
or symbols upon or under the skin with ink or colors by the aid of
needles or instruments. The provision of cosmetic micropigmentation
services by a licensed doctor or nurse shall not be considered "tattooing".
Any place or facility where tattooing is performed.
An establishment or place of business primarily engaged in
the preparation and retail sale of alcoholic beverages for consumption
with a City and State approved liquor license, including bars, cocktail
lounges and other similar uses other than a restaurant, at which less
than fifty percent (50%) of the total revenue is generated by food
sales.
Any air-supported, air-inflated, membrane-covered cable or
membrane-covered frame structure.
A group of attached, semi-detached or detached buildings
containing individual sleeping or living units, designed for or used
temporarily by automobile tourists or transients, with garage attached
or parking space conveniently located to each unit and offered to
the public for daily rates, as well as other longer term rental rates
and maintaining a register of guests or their vehicles.
A structure designed for the support of one (1) or more antennae
and including guyed towers, self-supporting (lattice) towers or monopoles
but not disguised support structures or buildings. The term shall
also not include any support structure under eighty (80) feet in height
owned and operated by an amateur radio operator licensed by the Federal
Communications Commission.
Any structure used or capable of being used for living, sleeping,
business or storage purposes, having no foundation other than wheels,
blocks, skids, jacks, horses or skirting and which is, has been or
reasonably may be equipped with wheels or other devices for transporting
the structure from place to place whether by motive power or other
means. The term "trailer" shall include camp car
and house car. A permanent foundation shall not change its character
if the structure can be removed therefrom practically intact.
An area used for the parking of one (1) or more tents or
trailers designed or intended to be used as temporary living facilities
for one (1) or more families and intended primarily for automobile
transients.
The purpose for which land or a building is arranged, designed
or intended or for which either land or a building is or may be occupied
or maintained under provisions of this Chapter.
An open area, other than a street, alley or place, used for
the display and sale of used automobiles and where no repair work
is done except the necessary reconditioning of the cars to be displayed
and sold on the premises.
A required open space, other than a court, on a lot unoccupied
and unobstructed from the ground upward, except as otherwise provided
in this Chapter.
An open unoccupied space on the same lot with a main building,
extending the full width of the lot and situated between the street
line and the frontmost point of the principal streetside face of the
building projected to the side lines of the lot.
An open unoccupied space on the same lot with the building
between the rear line of the building and the rear line of the lot
and extending the full width of the lot.
An open unoccupied space on the same lot with the building
situated between the building and the side line of the lot and extending
from the front yard to the rear yard. Any lot line not a rear line
or a front line shall be deemed a side lot line.
