The following words, terms and phrases, when used in this Chapter, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:
POLE
A mast, more or less rounded.
STRUCTURE
Includes a tower or pole to which an antenna is connected, including all of the accessories or appurtenances thereto.
TOWER
A structure consisting of uprights or legs and truss members, plus cap and/or footing members, as required.

Antenna structures not more than twelve (12) feet in height may be erected and maintained on the roof of any building without a building permit. No such structure, however, shall be erected so as to injure the roof covering and, when removed from the roof, the roof covering shall be required to maintain weather and watertightness. No such structure, including guy wires or other accessories, shall be erected within such distance of electric power lines as to create a hazard in normal weather conditions.

A. 
When Required. The approval of the Building Commissioner shall be secured prior to the installation of any antenna structures more than twelve (12) feet in height. When mounted on the ground, such twelve (12) feet shall be measured from grade level and when mounted on the roof, such twelve (12) feet shall be measured from the point of installation on the roof.
B. 
Application Forms And Information Sheets. Any person desiring to install any such structure shall obtain from the office of the Building Commissioner the application forms and information sheets, with checklists, summarizing the requirements for obtaining all necessary permits under this Chapter.
C. 
Filing — Plot Plan. The written application for a permit shall be filed with the Building Commissioner and shall be accompanied by a plot plan of the property, showing the location of the proposed structure in relation to any buildings, lot lines and easements, together with two (2) detailed drawings of the structure, including methods of anchorage, with load designs, wind load calculations and footing dimensions. If the application is by a party other than the owner of the property for which the permit is sought, the written consent of the owner shall be filed with the application.
D. 
Minimum Standards. Such plans shall conform with the following requirements:
1. 
All connections to the roof structure shall be properly flashed to maintain watertightness.
2. 
Manufacturers' specifications for all antenna towers shall be followed provided they require up to gusts of ninety (90) miles per hour or thirty (30) pounds per square foot of wind pressure. Where no manufacturers' specifications are given, antenna towers shall be erected so that they will withstand wind forces up to ninety (90) mile per hour gusts or thirty (30) pounds per square feet of wind pressure.
a. 
Guyed towers shall be designed of proper material to withstand wind pressures as set out in this Subsection (D)(2) and all guy wires are to be positioned to distribute horizontal wind loads evenly.
b. 
The Building Commissioner of the City may require testing of any antenna or guyed tower to determine compliance with the standards set out in this Section.
3. 
The foundation for any structure shall be in conformity with the requirements of the Building Code, shall have a minimum depth of thirty (30) inches and shall extend at least four (4) inches beyond each side of the structure.
4. 
No antenna structure shall extend more than twenty-four (24) inches within a required side yard.
5. 
All wiring shall comply with the requirements of Article 27 of the Building Code adopted by Section 505.010 of this Code and the antenna shall be grounded by direct copper ground.
E. 
Fee. A construction permit for an antenna structure shall be issued upon compliance with the requirements in this Section and payment of a fee in the sum of ten dollars ($10.00).

Upon completion of construction in accordance with the requirements of this Chapter and all other applicable requirements of the City ordinances and upon payment of an inspection fee at the rate of fifteen dollars ($15.00) for each inspection, a use permit shall be issued.

All antenna structures existing on the effective date of the ordinance from which this Chapter derives shall be brought into compliance with the requirements of this Chapter within ninety (90) days and the operator of any such structure shall obtain a permit, in accordance with the provisions of this Chapter, within such ninety (90) day period. Existing antennas grounded by either copper or aluminum shall not require any change in grounding. If the existing footing cannot be inspected because of hardship or type of construction, the Building Commissioner shall be authorized, upon submission of a notarized affidavit of the applicant that footing meets the specifications of this Chapter, to issue a permit.

Whenever the provisions of the Building Code of the City impose more stringent requirements than are provided in this Chapter, the provisions of the Building Code shall govern.
