The Fire Department shall consist of a Chief and such number of officers and firefighters as determined by the Council to be requisite to manage and carry on the work of the Department. The number of officers and firefighters may be increased or diminished by the City Council as occasion requires, and the respective duties and compensation of officers and firefighters shall also be as designated by the City Council.

Whenever the Chief of the Fire Department shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the Code adopted by this Chapter do not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal the decision of the Chief of the Fire Department to the City Council within thirty (30) days from the date of the decision being appealed.

In the absence of the Chief of the Fire Department from the City or in case of his/her sickness or other inability to act, the command, charge and management of the Fire Department shall devolve upon the Assistant Chief of the Fire Department. The Assistant Chief of the Fire Department shall be elected annually by the members of the Fire Department.

A. 
The City shall hire a maximum of four (4) substitute firefighters who shall, as their duties, work for and take the place of a regular firefighter if a regular firefighter is absent and cannot answer fire alarms. Such substitutes shall be first approved by the Fire Department and the City Administrator before they are hired. They shall serve for such compensation as established by the City Council from time to time. After such substitutes have been hired, they shall train as if they are regular firefighters and each shall be prepared to take the place of a resigning regular firefighter. Regular firefighters will be selected by vote of the Fire Department Membership Committee and the Fire Department Membership on the basis of (but not limited to) amount of time served, experience, training and participation.
B. 
Should a substitute firefighter be deemed inactive or uninterested in the Fire Department membership, he/she shall be removed from the active substitute roster and be replaced by the substitute firefighter.

The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary. The Chief of the Fire Department shall recommend to the Mayor the employment of technical inspectors who, when such authorization is made, shall be selected through an examination to determine their fitness for the position. The examination shall be open to members and non-members of the Fire Department and appointments made after examination shall be for an indefinite term with removal only for cause.

The Fire Code adopted in Chapter 500 shall be enforced by the Chief of the Fire Department.

A. 
The Fire Department shall elect its own officers.
B. 
In all things the Fire Department shall be subject to such rules and regulations as may be prescribed in the bylaws and rules adopted by the Department, with the approval of the City Council and that are not inconsistent with this Code or other ordinances of the City, and the company shall provide for enforcing such rules and regulations by fine or dismissal from service.
C. 
Upon an alarm of fire, each member of the Fire Department shall report promptly for duty and shall aid and assist the commanding officer in all such matters as the commanding officer may direct, especially in preventing the hose from being trod upon and in keeping all idle and suspicious persons from the immediate vicinity of any fire.

A. 
The City firefighting equipment and firefighting personnel will be available for incidents taking place at facilities and/or structures only if the following conditions are met:
1. 
The City will respond to any other Fire Department which the City of Louisiana has a written mutual-aid agreement. Mutual-aid agreements shall not be considered, nor is it implied that the City of Louisiana Fire Department is "First to Respond"; or
2. 
If the owner of the facilities and/or structures which is outside the City limits has entered into a service contract with the City of Louisiana to provide firefighting service, a current service contract with the City of Louisiana Fire Department to provide firefighting service will be considered as the City of Louisiana Fire Department will be the "First to Respond".
B. 
The City hereby expressly denies any liability connected with the carrying out of this Section by personnel or equipment and accepts no liability for the same.
