The purpose of this section is to prescribe minimum regulations
governing conditions hazardous to life and property from fire, hazardous
materials or explosion within the Village of Bosque Farms, New Mexico;
the following is adopted:
A. The International Fire Code (IFC) 2015 edition including appendices
B, C, D, J and K.
B. All fire codes, standards and supplements as published by the National
Fire Protection Association (NFPA) 2015 edition and documents adopted
by Chapter two.
C. The NFPA Life Safety Code 101, 2015 edition with the exception of
Chapter 24.
As used in this section, the following terms shall have the
meanings indicated:
JURISDICTION
The area within the corporate limits of Bosque Farms, New
Mexico.
PREMISES
Any property, building, structure, yard, tank with enforceable
fire code attached or vehicle or any portion thereof.
The Fire Chief or duly authorized representative shall have
jurisdiction to administer the Village of Bosque Farms Fire Code as
applicable to all existing and new structures. The Fire Chief or duly
authorized representative shall have jurisdiction under this Fire
Code to test and inspect fire suppression systems, including fire
hydrants, fire extinguishers, fire alarms and sprinkler systems installed
in construction, alteration, moving, demolition, repair use and occupancy
of buildings, structures and building service equipment.
Any person who shall violate any provision of this section or
standard hereby adopted or fail to comply therewith; or who shall
violate or fail to comply with any order made thereunder; or who shall
building violation of any detailed statement of specifications or
plans submitted and approved thereunder; or fail to operate in accordance
with any certificate or permit issued thereunder; and from which no
appeal has been taken; or who shall fail to comply with such an order
as affirmed or modified by a court of competent jurisdiction, within
the time fixed herein, shall severally for each and every such violation
and noncompliance, respectively, be guilty of a misdemeanor, punishable
by a fine of not more than $500 or imprisonment for no more than 90
days or both such fine and imprisonment. The imposition of one penalty
for any violation shall not excuse the violation or permit it to continue;
and all such persons shall be required to correct or remedy such violations
or defects within a reasonable time; and when not otherwise specified
the application of the above penalty shall not be held to prevent
the enforced removal of prohibited conditions. Each day that prohibited
conditions are maintained shall constitute a separate offense.
If any action, subsection, paragraph, phrase, or other portion
of this section shall be declared invalid for any reason whatsoever
by a court of competent jurisdiction, then such decision shall not
affect the validity or enforceability of the remaining portions of
this section.
All ordinances or resolutions or parts thereof inconsistent
herewith are hereby repealed to the extent only of such inconsistency.
This repealer shall not be construed to revive any ordinance or resolution
or part thereof previously repealed.
