On municipal election day in the year 1923 and every two (2)
years thereafter, there shall be elected by the qualified voters of
the City some suitable person as City Treasurer who shall, at the
time of his/her election, be a resident of the City and a qualified
voter under the laws and Constitution of the State and the provisions
of this Code and other ordinances of the City.
Every officer of the City and his/her assistants, and every
Council member, before entering upon the duties of his/her office,
shall take and subscribe to an oath or affirmation before some court
of record in the County, or the City Clerk, that he/she possesses
all the qualifications prescribed for his/her office by law; that
he/she will support the Constitution of the United States, and of
the State of Missouri, the provisions of all laws of this State affecting
Cities of this class, and the ordinances of the City, and faithfully
demean himself/herself in office; which official oath or affirmation
shall be filed with the City Clerk. All officers and employees of
the City who receive, disburse, or are responsible for City funds,
and such other officers and employees as the Council by ordinance
may designate or as may be required by law, shall, within fifteen
(15) days after election or appointment, and before entering upon
the discharge of their duties, give bond to the City in such sums
and with such sureties as shall be prescribed by ordinance, and subject
to approval by the Council, conditioned upon the faithful and proper
performance of their duties and for the prompt accounting for and
paying over to the City of all monies belonging to the City that may
come into their hands. The City shall pay the premiums on all such
bonds. If any person elected or appointed to any office shall fail
to take and subscribe such oath or affirmation, or to give bond as
herein required, his/her office shall be deemed vacant. For any breach
of condition of any such bond, suit may be instituted thereon by the
City, or by any person in the name of the City for the use of such
person.
