A. The
office of City Administrator is hereby created.
B. The
City Administrator shall be appointed by the Mayor with approval of
a majority of elected members of the Board of Aldermen for an indefinite
term. He/she shall be at least twenty-one (21) years of age and shall
be chosen solely on the basis of his/her executive and administrative
qualifications. The choice of the City Administrator shall not be
limited by residence qualifications, however, he/she shall reside
within the City limits of New Haven while in office and shall devote
his/her full time to the performance of the duties of his/her office.

Before entering upon the duties of his/her office, the City
Administrator shall take and subscribe to an oath or affirmation before
the City Clerk or someone authorized to administer oaths, that he/she
possesses all the qualifications prescribed for his/her office by
law; that he/she will support the constitution of the United States
and the State of Missouri; the provisions of all laws of the State
of Missouri and the ordinances of the City of New Haven; and that
he/she will faithfully demean himself/herself while in office.

The compensation of the City Administrator shall be set each
year for services as City Administrator.

The City Administrator shall serve at the pleasure of the appointing
authority. The Mayor, with consent of a majority of all members of
the Board of Aldermen may remove the City Administrator form office
at will, and such City Administrator may also be removed by a three-fourths
(¾) vote of all members elected to the Board of Aldermen independently
of the Mayor's approval or recommendations. If requested, the Mayor
and Board of Aldermen shall grant the City Administrator a public
hearing within thirty (30) days following notice of removal. During
the interim, the Mayor with the approval of a majority of all Aldermen
or by three-fourths (¾) of all Aldermen without the Mayor's
approval, may suspend the City Administrator from duty, but shall
continue his/her salary and, if after a hearing, removal becomes final,
shall pay his/her salary fee two (2) calendar months following the
final removal date; provided however, that if the City Administrator
shall be removed from acts of dishonestly or moral turpitude, such
salary shall not be continued.

A. The City Administrator shall be the Chief Administrative Assistant
to the Mayor and he/she shall have general superintending control
of the administration and management of the Government business, officers
and employees of the City, subject to the direction and supervision
of the Mayor and Board of Aldermen. To that end, he/she shall have
the power and shall be required to:

Appoint and when necessary for the good of the service, suspend
or remove all employees of the City except as otherwise provided for
by law or City ordinance, except department heads. However, when it
is necessary to fill vacancies in the office of City Attorney, Public
Works Director, City Clerk, City Collector, Police Chief, City Treasurer,
and Park Manager, the City Administrator shall submit the names of
individuals for approval by the Mayor and Board of Aldermen or, in
the case of the Park Manager, the Park Board. The City Administrator
may recommend removal or suspension of any such appointee when it
would be in the best interest of the City, and the Governing Body
shall give due consideration to such recommendations. If any appointment
made by the Mayor is rejected by the Board of Aldermen, the Administrator
shall, within twenty (20) days after the rejection of such permanent
nominee, submit to the Board of Aldermen the name of some person other
than such rejected nominee for permanent appointment to such office,
job, board or commission. All direct appointments, removals or suspensions
made by the City Administrator, and all recommendations made to the
suspensions shall be based solely on merit, qualifications, or disqualifications
of the officers or employees concerned without regard to his/her political
beliefs or affiliations.

2.
Recommend for adoption by the Board of Aldermen standard personnel
procedures to include position classifications and pay schedules for
all employees covered in the City's personnel program and shall
cause to be prepared written job descriptions of all regularly employed
City personnel.
3.
Prepare the proposed budget annually and submit it to the Board
of Aldermen together with a message describing important features,
the budget to be supported by appropriate schedules and analysis,
and he/she shall be designated the "Budget Officer" of the City.
4.
Keep the Board of Aldermen advised of the financial condition
and future condition and future needs of the City, and make such recommendations
as he/she may deem desirable.
5.
Prescribe such rules and regulations as are necessary or expedient
for conduct of administrative departments or agencies subject to his/her
authority, and he/she shall have the power to revoke, suspend or amend
any rule or regulation of the administrative service prescribed by
himself/herself or any subordinate.

A. The City Administrator's further powers and duties shall be:
1.
Supervise the preparation of all bid specifications for services,
construction and equipment, with the consent of all department heads.
2.
Account to the Mayor and Board of Aldermen for any actions taken
when requested to do so and, at all times, shall be subject to supervision,
control and direction of the Mayor and Board of Aldermen.
3.
Coordinate the work of all the departments of the City, and
shall have authority to assign the employees of the City to any department
where they are needed for the most effective discharge of the functions
of City government.
4.
He/she shall have the power to investigate and to examine or
inquire into the affairs or operation of any department of the City
and shall report on any condition or fact concerning the City government
requested by the Mayor or Board of Aldermen.
5.
He/she shall have the power to overrule any action taken by
a department head, and may supersede him/her in the functions of his/her
office.
6.
He/she shall be subject to the orders of the Board of Aldermen
and shall perform such service as may be assigned to him/her by them.
7.
Meet with standing committees appointed by the Mayor on matters
concerning general and special administrative problems, who shall
consult with and render advice to the City Administrator on such matters.
8.
Attend all meetings of the Board of Aldermen and have the right
to appear before and address the Board of Aldermen at any meeting.
9.
Have responsibility for all real and personal property of the
City of New Haven. He/she shall have responsibility for all inventories
of such property and for the upkeep of all such property. Personal
property may be sold by the Administrator only with the approval of
the Board of Aldermen. Real property may be sold only with the approval
of the Board of Aldermen by resolution or ordinance.
10.
Supervise the purchase of all materials, supplies and equipment
for which funds are provided in the budget. He/she shall have the
power to purchase materials, supplies and equipment to amounts up
to and including one thousand five hundred dollars ($1,500.00). Amounts
over one thousand five hundred dollars ($1,500.00) shall be subject
to approval of the Governing Body, unless the health or safety of
the citizens of the City are involved; then this limit shall not apply.
Contracts for services, construction and items of equipment purchased
by sealed bids must be approved by the Board of Aldermen.
11.
Perform other such duties as may be required by the Board of
Aldermen, not inconsistent with the State Statutes, laws or ordinances.
12.
Park Board duties. The City Administrator shall be the Chief
Administrative Assistant to the President of the Park Board of the
City of New Haven. He/she shall attend all meetings of the Park Board
and shall be responsible for the general administrative duties of
same.

No member of the Board of Aldermen shall directly interfere
with the conduct of any department head or duties of City employees,
except at the express direction of the entire Board of Aldermen.
