The Fire Prevention Code, being particularly the 1965 Edition
thereof and the October, 1966, Revision thereto as published by the
American Insurance Association, is hereby adopted as fully as if it
were set out verbatim in this Section as the Fire Prevention Code
of the City.

The provisions of the Fire Prevention Code adopted in this Chapter
shall be controlling in the City, unless the provisions of the Fire
Prevention Code are expressly amended or modified by the provisions
of this Code. In the event of a conflict between the provisions of
the Fire Prevention Code and an express provision of this Code, the
provisions of this Code shall prevail.

There is hereby established a Bureau of Fire Prevention which
shall be composed of the Board of Aldermen. The Bureau of Fire Prevention
shall have the power to modify any of the provisions of the Fire Prevention
Code adopted in this Chapter, upon written application by the person
seeking the modification, when there are practical difficulties in
the way of carrying out the strict letter of the Fire Prevention Code,
provided that the spirit of Fire Prevention Code shall be observed,
the public safety secured and substantial justice done.

There is hereby created the office of Fire Marshal who shall
be appointed by the Mayor with the consent and approval of a majority
of the members of the Board of Aldermen. It shall be the duty of the
Fire Marshal to enforce the provisions of the Fire Prevention Code
adopted in this Chapter; the Fire Marshal shall perform such duties
and have such powers and authority as is prescribed for the Chief
of the Fire Department by the Fire Prevention Code. The Fire Marshal
shall perform such other duties as may be prescribed by the Mayor
or the Board of Aldermen.

The Building Inspector shall be ex officio Fire Marshal, unless
some other person is specifically appointed to fill the office of
Fire Marshal.

Appeals from orders of the Fire Marshal made pursuant to the
Fire Prevention Code adopted in this Chapter shall be made in writing
within thirty (30) days from the date of the order appealed. The appeal
shall be directed to the Bureau of Fire Prevention.
