A. Any person
or corporation owning any property fronting or abutting on any public
highway, street, avenue or alley or any part thereof may petition
the Board of Alderpersons for vacation of same. The petition must
give a correct legal description of the public property which the
petitioner desires to be vacated and also the names of the persons
or corporations owning or claiming the adjoining property. The petition
must be verified by affidavit. Written, verified consent of the persons
or corporations owning three-fourths (¾) of the front feet
of the property fronting on the property proposed to be vacated must
be attached to said petition.
B. The petition
must be filed at least fifteen (15) days before it may be taken up
by the Board of Alderpersons. Notice of the filing of the petition
shall be given by two (2) consecutive publications in a weekly newspaper
printed within Platte County, Missouri, the last publication being
not more than one (1) week prior to the hearing on said petition before
the Board of Alderpersons.
C. Any ordinance
approving the vacation of public property pursuant to this Section
must receive at least a two-thirds (2/3) affirmative vote of the full
authorized membership of the Board of Alderpersons. Every ordinance
vacating public property pursuant to this Section shall be acknowledged
by the City Clerk as deeds are acknowledged and such ordinance and
verified consents of the property owners as filed with the petition
shall be filed for record in the office of the Recorder of Deeds of
Platte County, Missouri.
