For the purposes of this article, the following definitions shall apply:
AFFILIATED
A City employee controlling, controlled by or under the common control of another person participating in a corporation, partnership, proprietorship or any other form of business organization engaged in the construction business. A City employee who shares in the income or has the right to share in the income generated from a construction business shall also be deemed to be "affiliated" with said business and the persons engaged therein.
CONSTRUCTION BUSINESS or CONSTRUCTION ACTIVITIES
Those businesses or activities concerned with the erection, alteration, renovation or demolition of structures subject to the construction, fire, property maintenance or health codes of the City of Camden.
DUTIES INVOLVING CODE ENFORCEMENT AND INSPECTION OF STRUCTURES
Any part of an employee's duties which involves the enforcement, inspection or supervision of employees involved in the enforcement or inspection of the construction, fire, property maintenance or health codes.
OWNER
A person affiliated with a construction business.
No City employee whose duties directly involve the inspection of structures within the City of Camden shall enter into any contract or agreement with any persons concerning construction within the City of Camden; provided, however, that an employee may enter into such an agreement for work to be performed on property owned by that employee if said employee shall first make written disclosure of such contract or agreement to the Director of his or her department so that the Director may determine whether it is necessary to assign another employee or an outside inspection company to perform the inspections in lieu of the City employee who would ordinarily perform the inspection. Directors making such agreements or contracts shall make disclosure directly to the Business Administrator.
The use of an affiliate or a sham transaction to avoid the application of the provisions of this article shall not absolve an employee from responsibility hereunder and may, where it is apparent that the employee's intent was to avoid detection of a violation of the provision of this article, be considered a separate offense.
The directors of the departments may make further rules and regulations according to the procedures provided by law to implement and enforce this article.
A. 
The Business Administrator and the City Attorney shall be prohibited from holding outside employment, including the private practice of law, for the purposes of avoiding conflicts of interest with their official duties for the City.
