as life hazard use properties shall not be required to register under
this section.

not exempt from registration or inspection shall remain exempt from
paying inspection fees pursuant to the Municipal Code, as cited.
A CSDCMAC (certificate of smoke detector and carbon monoxide
alarm compliance) as required by N.J.A.C. 5:70-2.3 shall be based
upon the amount of time remaining before change of occupancy is expected
as cited.
A. Fire certificate fee.
(1) The fee for a request for a CSDCMAC received more than 10 business
days prior to property settlement or change of occupant shall be $50.
(2) The fee for a request for a CSDCMAC received four to 10 business
days prior to property settlement or change of occupant shall be $100.
(3) The fee for a request for a CSDCMAC received fewer than four business
days prior to property settlement or change of occupant shall be $140.
B. Fire report fee.
(1) The fee for furnishing copies of fire investigation reports to insurance
companies, property owners, or property occupants shall be $65.
(2) The fee for furnishing copies of fire incident reports to insurance
companies, property owners, or property occupants shall be $8.
(3) The fee for servicing photo reproduction applications as fire incident
evidence data to insurance companies, property owners, or property
occupants shall be $60. Fee does not include cost of reproduction
photo services.
C. Fire inspection fee.
(1) An inspection fee in an amount indicated by the fee schedule shall
be assessed for inspections relating to smoke detector alarms and
carbon monoxide alarms of structures used or intended for use for
residential purpose by not more than two households pursuant to N.J.A.C.
5:70-2.3.
(2) Before any Use Group R-3 or R-4 structure is sold or leased or otherwise
made subject to a change of occupancy for residential purpose, the
owner shall obtain, from the enforcement agency a CSDCMAC evidencing
compliance with N.J.A.C. 5:70-4.19.
(3) No certificate of inspection or occupancy or other approval under
the municipal code shall be issued until it has been determined that
dwellings comply with the requirements of N.J.A.C. 5:70-4.19. The
owner or an authorized agent of the owner shall apply for a CSDCMAC
on a form provided by the local enforcement agency. The CSDCMAC shall
not be transferable. If the change of occupancy specified in the application
for the CSDCMAC does not occur within six months, a new application
shall be required.
(4) The enforcement agency may issue a CSDCMAC for seasonal rental units for a period up to 12 months, regardless of frequency in the number of changes in tenancy. No CSDCMAC shall be issued until an inspection of the property indicates compliance with N.J.A.C. 5:70-4.19, except as specified in Subsection
C(5) below.
(5) The enforcement agency, unless otherwise required to inspect a structure
under other municipal code, may accept, in lieu of inspection, certification
that one or more smoke detectors and carbon monoxide alarms, as applicable,
have been installed and tested in accordance with N.J.A.C. 5:70-4.19.
Certification shall be upon forms provided by the enforcement agency.
(6) No CSDCMAC or municipal certificate of occupancy may be issued for
any Use Group R-3 or R-4 structure, or unit therein, unless the structure
or unit contains a carbon monoxide detector meeting the requirements
of UL standard 2034; provided, however, that no carbon monoxide alarm
shall be required in any building that does not contain any fuel-burning
appliances and does not have an attached garage. An open parking structure
as defined in the building subcode of the Uniform Construction Code
shall not be deemed attached or adjoining garage space.
