No person shall cause, suffer or allow any animals or fowl,
including domesticated birds and bees, to run at large or be at large
in the Village.
The raising or harboring of livestock, including horses, cattle,
hogs, fowl or fur-bearing animals, is prohibited within the Village,
except upon a farm operation located in an agricultural district as
defined in Article 25AA of the New York Agriculture and Markets Law.
Common household pets are excepted from this prohibition, provided
that there are not more than four cats and/or dogs over six months
old upon the premises.
No person shall ride any horse or other animal on any street
or in any public place at a pace other than a walk. The provisions
of this section do not apply, however, to any show, parade, exhibition,
performance or function duly authorized in any public place or park.
No person shall ride or lead a horse, pony, donkey or mule along
any sidewalk or footpath or upon private property without the consent
of the owner or occupant thereof.
No person owning or possessing any animal shall allow it to
disturb the comfort, peace or repose of any persons in the vicinity
by long-continued or frequent noise.
As used in this chapter, the following terms shall have the
meanings indicated:
ADOPTION
The delivery to any individual 18 years of age or older,
for purpose of harboring the animal, of any unredeemed dog impounded
pursuant to the provisions of this chapter and Article 7 of the Agriculture
and Markets Law.
AT LARGE
Any animal that is unrestrained in its movement by a leash or fence shall be deemed at large. Any dog that is in violation of the provisions of §
56-9 of this chapter shall be deemed at large. No dog shall be deemed to be at large if it is:
A.
A police work dog in use for police work.
B.
A service dog actually assisting, or in training to assist,
a disabled person.
DOG
Any member of the species Canis familiaris.
DOG CONTROL OFFICER
Any individual appointed by a municipality to assist in the
enforcement of this chapter and Article 7 of the Agriculture and Markets
Law or any authorized officer, agent or employee of an incorporated
humane society or similar incorporated dog-protection association
under contract with a municipality to assist in the enforcement of
this chapter and Article 7 of the Agriculture and Markets Law of the
State of New York.
EUTHANIZE
To bring about death by a humane method administered by a
licensed veterinarian.
HARBOR
To provide food, shelter, care or supervision to any dog
or animal, or to have custody (temporary or permanent) of a dog or
animal.
IDENTIFIED DOG
Any dog carrying an identification tag as provided in § 112
of Article 7 of the Agriculture and Markets Law relating to licensing,
identification and control of dogs.
OWNER
Any person who owns, harbors or keeps any dog or animal.
In the event that any dog or animal found in violation of this chapter
shall be owned by a person under 18 years of age, the owner shall
be deemed to be the parent or guardian of such person or the head
of the household in which said person resides, all as defined in Article
7 of the Agriculture and Markets Law.
