The office of City Administrator is hereby created for the City pursuant to Chapter 77, RSMo.

A.
The Board of Aldermen, subject to the approval of the Mayor, shall by resolution employ a City Administrator, who shall be responsible for the administration of all the departments of the City government which the Mayor and Board of Aldermen have the authority to control. He/she shall be appointed with regard to merit only, and he/she need not be a resident of the City at the time of his/her appointment.
B.
The qualifications for holding the office of City Administrator shall be as follows:

He/she must have a college degree in business administration, public administration, political science or engineering, or other appropriate graduate degree from an accredited college or university.
4.
He/she must be at least twenty-one (21) years of age and must devote his/her full time to his/her duties as City Administrator.
C.
Removal From Office.
1.
The City Administrator may be removed from office and discharged from employment without cause upon resolution of the Board of Aldermen adopted by a two-thirds (2/3) majority of the members of the Board of Aldermen. A certified copy of such resolution shall be delivered to the discharged City Administrator by the City Clerk, or Mayor, within ten (10) days following its adoption.

The City Administrator may be removed from office and discharged from employment by the Mayor upon the affirmative vote of a majority of all the members of the Board of Aldermen.

A.
The City Administrator shall have the following functions and duties:

He/she shall be the Chief Administrative Assistant to the Mayor.
2.
He/she shall have general superintending control of the administration and management of the government business, officers and employees of the City, subject to the direction and supervision of the Mayor. These responsibilities shall include:
a.
To execute the policies, directives and legislative actions of the Mayor and Board of Aldermen.
b.
To direct, supervise and coordinate administrative activities of the City.
c.
To employ, demote, promote, discipline, suspend and discharge any Group Manager of the City with the approval of the Mayor, but without necessity of approval of the Board of Aldermen, and all other employees without the necessity of approval of the Mayor and the Board of Aldermen.
d.
Serving as the City's budget officer, and preparing a proposed annual budget presenting a complete financial plan for the ensuing budget year, which plan shall include at least the following information:

(1)
A budget message describing the important features of the budget and major changes from the preceding year;
(2)
Estimated revenues to be received from all sources for the budget year, with a comparative statement of actual or estimated revenues for the two (2) years next preceding, itemized by year, fund, and source;
(3)
Proposed expenditures for each department, office, commission, and other classification for the budget year, together with a comparative statement of actual or estimated expenditures for the two (2) years next preceding, itemized by year, fund, activity, and object;
(4)
The amount required for the payment of interest, amortization, and redemption charges on the debt of the City; and
(5)
A general budget summary.
In no event shall the total proposed expenditures from any fund exceed the estimated revenues to be received plus any unencumbered balance or less any deficit estimated for the fund for the beginning of the budget year; provided, however, that nothing herein shall be construed as requiring the budget to use any cash balance as current revenue or to change from a cash basis of financing its expenditures.
After the City Administrator has prepared the proposed budget, he shall submit the same, along with such supporting schedules, exhibits, and other explanatory material as may be necessary for the proper understanding of the financial needs and position of the City, to the Mayor and Board of Aldermen for their review, consideration and adoption. He shall submit at the same time complete drafts of such orders, motions, resolutions, or ordinances as may be required to authorize the proposed expenditures and produce the revenue necessary to balance the proposed budget.
e.
To administer the annual operating budget as adopted by ordinance.
f.
To prepare and periodically revise a five (5) year capital improvements plan and budget.
g.
To recommend and administer personnel policies and classifications, compensation and evaluation programs for all City employees, in conformity with the ordinances of the City.
h.
To monitor the financial condition of the City and estimate present and future financial needs.
i.
To submit monthly financial reports.
j.
To combine or consolidate job positions within departments as necessary or prudent for maximum utilization of manpower.
k.
To recommend and administer policies governing purchasing procedures and inventory control.
l.
The authority to make changes in budget line items, within a fund budget, so long as the same is not already encumbered and does not increase the total fund budget.

m.
To investigate and take any necessary action on complaints concerning administrative matters and personnel performance, subject to paragraph (c) of this subdivision.
n.
To delegate to other administrative officers subject to the City Administrator's direction and supervision the authority to exercise such powers, perform such duties and assume such responsibilities as may be considered appropriate.
o.
To provide to the Mayor and Board of Aldermen information, guidance and leadership in matters of policy determination.
p.
To perform such other duties as may be required by the Mayor or Board of Aldermen.

Any action taken by a person or persons designated or employed pursuant to Section 115.090 hereof, which could have validly been taken by the City Administrator and which has been delegated to such person by the City Administrator or by ordinance, shall have the same effect as if the City Administrator has personally taken such action. No action taken by such designee pursuant to this Section shall require any additional authorization from the Mayor or the Board of Aldermen if such authorization would not have been required if the City Administrator had personally taken such action.

The City Administrator shall have the authority to appoint an assistant or assistants with the authority to exercise the powers and duties of the City Administrator set forth in Section 115.070 hereof, together with the authority to exercise such powers, perform such duties and assume such responsibilities as may be considered consistent therewith during the temporary absence of the City Administrator from the City, or as are delegated to him/her from time to time by the City Administrator, subject to the City Administrator's direction and supervision.
