The following terms shall have the following meanings as used
in this Part:
PUBLIC WATER DRAINAGE NUISANCE
Any artificial, mechanical, unnatural landscaping, pumping,
engineering or other unnatural condition not authorized by the Township
of Susquehanna, which diverts water from lands owned by one party
or entity onto adjoining property and which flow of water the adjoining
property or properties cannot accommodate, unless the same is done
with the continuing permission of the owners of the adjoining lands
on to which the water flows.

No person or entity, either personally, through an agent or
in association with others, shall create or maintain a public water
drainage nuisance of whatsoever kind within the limits of Susquehanna
Township, and the owner or occupant of any premises on which a public
water drainage nuisance is found to exist, upon notice from the Codes
Enforcement Officer, shall abate the same within the time specified.

Upon complaint to the Susquehanna Township Codes Enforcement
Officer, such officer shall promptly investigate to determine if a
public water drainage nuisance exists and, if the same is found to
exist, written notice of the condition and an order to correct shall
be delivered to the owner of the premises on which the public water
drainage nuisance is found. The notice to correct shall direct that
the party notified provide a reasonable and diligent plan for correction
of the public water drainage nuisance within seven days of the date
of notice. In the event that no such correction is made, or plan filed,
within the time set forth, a second notice shall be issued by the
Codes Enforcement Officer requiring abatement of the public water
drainage nuisance within 48 hours, after which, absent abatement of
the public water drainage nuisance, a citation shall be issued.

Any person or entity who shall violate any provision of this
Part shall, upon conviction thereof, be sentenced to pay a fine of
not more than $600, and costs, and shall pay the costs of Susquehanna
Township incurred in the investigation of the public water drainage
nuisance and prosecution or, in default of payment thereof, shall
be subject to imprisonment for a term not to exceed 30 days.
