A. Purpose. The purpose of this section is to create part of the required
administrative mechanism for the execution of the responsibility of
the Borough of Lincoln Park to provide its fair share of the region's
need for affordable housing pursuant to the Fair Housing Act of 1985.
B. Definitions. As used in this section the following terms shall have
the meanings indicated:
ADMINISTRATIVE AGENT
The entity responsible for administering the affordability
controls on the very-low-, low- and moderate-income units created
in the Borough of Lincoln Park to ensure that all such restricted
units are affirmatively marketed and sold or rented, as applicable,
only to duly qualified very-low-, low- and moderate-income households.
MUNICIPAL HOUSING LIAISON
The municipal employee charged by the governing body with
the responsibility for oversight and administration of the affordable
housing program for the Borough of Lincoln Park.
C. Establishment of Municipal Housing Liaison position and compensation;
powers and duties.
(1) There is hereby established the position of Municipal Housing Liaison
for the Borough of Lincoln Park.
(2) Subject to the approval of the Superior Court in re Borough of Lincoln
Park, Docket No. MRS-L-1638-15, the Municipal Housing Liaison shall
be appointed by the governing body and may be a full- or part-time
municipal employee.
(3) The Municipal Housing Liaison shall be responsible for the oversight
of the administration of the affordable housing program for the Borough
of Lincoln Park, including all of the following responsibilities which
may not be contracted out:
(a)
Serving as Lincoln Park's primary point of contact for
all inquiries from the state, affordable housing providers, administrative
agents, and interested households;
(b)
Monitoring the status of all restricted affordable housing units
in Lincoln Park;
(c)
Compiling, verifying, submitting to the Fair Share Housing Center and posting on the municipal website all required annual, mid-point and three-year lookback monitoring reports as required by the Court, consistent with Chapter
17, Article
XIX, Affordable Housing, of this Code;
(d)
Coordinating meetings with affordable housing providers and
administrative agents, as applicable; and
(e)
Attending continuing education opportunities on affordability
controls, compliance monitoring, and affirmative marketing offered
by the Affordable Housing Professionals of New Jersey.
(4) Subject to the Court's approval, Lincoln Park may contract with or authorize a consultant, authority, governmental agency or other qualified entity charged by the governing body with all other responsibilities of administering the affordable housing program of the Borough of Lincoln Park, except for those responsibilities which may not be contracted out pursuant to Subsection
C above. The Municipal Housing Liaison shall supervise the contracting administrative agents, who shall provide regular updates to the Municipal Housing Liaison of their activities.
(5) Compensation. Compensation shall be fixed by the governing body at
the time of the appointment of the Municipal Housing Liaison.
