A. 
If not otherwise set forth in the Borough of Lincoln Park Code, fees are as follows. However, all fees related to the Development Regulations, including Chapter 17, Land Development Review, and Chapter 28, Zoning, are specifically set forth in Chapter 17, Article V, Fees. The specific fee for any item below that provides for a fee range shall be established by ordinance adopted by the Council.
B. 
The following fees shall be collected by the Health Department or its designee:
(1) 
Permits, licensing and other charges for dogs, kennels and other animals (§ 34-2).
(2) 
Licensure of food and food establishments (§ 34-5).
(3) 
Clinic services conducted by the Health Department (§ 34-6).
(4) 
Sanitary permits and inspections (§ 34-11).
(5) 
Permits for swimming pools (§ 34-12).
(6) 
Licenses, permits and certificates issued by the Registrar of Vital Statistics (§ 34-15).
(7) 
License for farmers market food vendors (§ 34-5).

Animal Warden.
(1) 
Impounding of dog or other animal: $10.

The following fees are in addition to any and all applicable State of New Jersey Department of Community Affairs fees. The total fee for a construction permit shall be sum of the subcode fees listed in Subsections A through M (as applicable) hereof and shall be paid before the permit is issued.
A. 
New structure fees.
(1) 
Use Groups B, H, I-1, I-2, I-3, M, E, R-1, R-2, R-3, R-4 and U: volume of building (in cubic feet) times $0.070 equals the volume fee.
(2) 
Use Groups A-1, A-2, A-3, A-4, F-1, F-2, S-1 and S-2: volume of building (in cubic feet) times $0.040 equals the volume fee.
(3) 
Commercial farm building: volume of building (in cubic feet) times $0.030 equals the volume fee.
(4) 
Surcharge fee: $0.00371 per cubic foot of volume of new construction.[1]

B. 
Renovations, alterations, repair and minor work fees.
(1) 
Estimated cost up to and including $50,000: $26 per $1,000.
(2) 
Portion of cost over $50,000 but under $100,000: $22 per $1,000.
(3) 
Portion of cost $100,000 and over: $20 per $1,000.
(4) 
For combination of work involving new structures and existing structure work: the sum of the fees computed separately as renovations/alterations/repairs and volume fees.
(5) 
Installation or replacement of storage tanks up to 550 gallons for R-3/R-4: $75.
(6) 
Installation or replacement of nonresidential storage tanks: $200.
(7) 
Installation of underground storage tank: $85 per tank.
(8) 
Taking tank out of service, altering the piping or otherwise modifying any installation: $22 per $1,000 of estimated cost of removal; minimum fee of $50.
(9) 
Minimum fee shall be $65.
(10) 
Fees for roofing and siding shall be based on the estimated cost of the work, $20 per $1,000, with a minimum fee of $50.
(11) 
The fee for fences over six feet in height or for fences which are required barriers surrounding public or private swimming pools shall be based upon the estimated cost of the work, $20 per $1,000.
(12) 
The fee for temporary structures and all structures for which volume cannot be computed shall be based upon the estimated cost of the work, $20 per $1,000.
(13) 
The fee for a change of contractor shall be $10.
C. 
Demolition or removal permits.
(1) 
For a structure less than 5,000 square feet in area and less than 30 feet in height, or for one- or two-family residences (R-3/R-4 use) and for structures on farms: fee of $100.
(2) 
All other structures: fee of $120.
D. 
Certificate of occupancy fees.
(1) 
Fee shall be set in the amount of 10% of permit fees for new structures, with a minimum of $75 for one- or two-family structures.
(2) 
All other structures, minimum fee of $85.
(3) 
The fee for a certificate of occupancy granted pursuant to a change of use group shall be $200.
(4) 
The fee for a certificate of continued occupancy shall be $200.
(5) 
The fee for a temporary certificate of occupancy shall be $30. Exception: There shall be no fee for the first issuance of the temporary certificate of occupancy provided that the certificate of occupancy fee is paid at that time.
E. 
Asbestos abatement fee. Fee shall be $106 plus certificate of occupancy fee of $21 pursuant to N.J.A.C. 5:23-8.9.
F. 
Lead hazard abatement/radon mitigation.
(1) 
The fee for lead abatement shall be $176.
(2) 
The fee for lead abatement clearance certificate shall be $35.
(3) 
The fee for radon abatement shall be $100.
(4) 
The fee for radon clearance certificate shall be $35.
G. 
Signs: $2 per square foot of sign. (Double-faced sign fee will be based on one side of face.) For double-faced signs the minimum fee shall be $75.
H. 
Pools.
(1) 
The fee for an aboveground swimming pool shall be $100.
(2) 
The fee for an in-ground swimming pool shall be $189.
I. 
Electrical fees. For calculating the following electrical fees provided in Subsection I(2) through (6) below, all motors except those plug-in appliances shall be counted, including control equipment, generators, transformers, and all heating, cooking or other devices consuming or generating electrical current.
(1) 
Electrical fixtures and devices. Fixtures and devices to be counted for these items include lighting outlets, wall switches, smoke detectors, fluorescent fixtures, convenience receptacles or similar fixtures and motors or devices of one horsepower (HP) or one kilowatt (KW) or less.
(a) 
First 50: fee is $50
(b) 
Increments of 10 additional fixtures and devices: $15.
(2) 
For each motor or electrical device greater than one HP and less than or equal to 10 HP and for transformers and generators greater than one KW and less than or equal to 10 KW the fee is $15 each.
(3) 
For each motor or electrical device greater than 10 HP and less than or equal to 50 HP, for each service panel, service entrance or subpanel less than or equal to 200 amperes, and for all transformers and generators greater than 10 KW and less than or equal to 45 KW and for each utility load management device the fee is $65 each.
(4) 
For each motor or electrical device greater than 50 HP and less than or equal to 100 HP, for each service panel, service entrance or subpanel greater than 200 amperes and less than or equal to 1,000 amperes, and for each transformer or generator greater than 45 KW and less than or equal to 112.5 KW the fee is $116 each.
(5) 
For each motor or electrical device greater than 100 HP, for each service panel, service entrance or subpanel greater than 1,000 amperes, and for each transformer or generator greater than 112.5 KW the fee is $576.
(6) 
The fee for the annual electrical inspection of swimming pools, spas, or hot tubs shall be $100.
(7) 
For each pool bonding inspection there shall be a flat fee of $95.
(8) 
For photovoltaic systems, the fee shall be based on the designated kilowatt rating of the solar photovoltaic system as follows:
(a) 
One to 50 kilowatts the fee shall be $58;
(b) 
Fifty-one to 100 kilowatts the fee shall be $116; and
(c) 
Greater than 100 kilowatts the fee shall be $576.
(9) 
Minimum fee shall be $50.

L. 
Plumbing fees.
(1) 
Total number of fixtures: $15 per fixture. Plumbing fixtures shall include, but not be limited to, stacks, lavatories, kitchen sinks, slop sinks, sinks, urinals, water closets, bathtubs, shower stalls, laundry tubs, floor drains, washing machine connections, hose bibs and similar fixtures.
(2) 
Total number of plumbing devices: $85 per device. Plumbing devices shall include, but not be limited to, devices, a manufacturer's device, or an on the job assembly of component parts which is adjunct to the basic piping system and plumbing fixtures, pressure-reducing valves, backflow prevention devices, backwater valves, vacuum breakers, grease traps, interceptors and similar devices.
(3) 
Total number of plumbing appliances: $45 per appliance. Plumbing appliances shall include, but not be limited to, hot-water heaters, tankless heaters, heat exchangers, water storage tanks, solar panels, water pressure booster systems, sump pumps, commercial dishwashers, commercial ice makers, instant hot-water coils, sewage ejectors, garbage disposal units, sterilizers, aspirators, water-cooled air-conditioning units, water conditioners and similar equipment.
(4) 
The fee for the installation of a house or building sewer and/or water service pipe shall be $75.
(5) 
The fee for the abandonment in place of a sewage disposal system and/or septic tank shall be $35.
(6) 
The fee for installation or replacement of roof drains and/or area drains shall be $35 per drain.
(7) 
The fee for gas line piping is $12 per each gas appliance connection.
(8) 
The fee for installation of or replacement of oil lines and/or oil tank piping shall be $35.
(9) 
The minimum fee shall be $50.
M. 
Miscellaneous.
(1) 
Plan review credit for prototype buildings: 20% reduction of plan review fee only (minimum fee of $35).
(2) 
Variation. The fee for an application for a variation in accordance with N.J.A.C. 5:23-2.10 shall be $100 for Class I structures, $50 for Class II structures, and $50 for Class III structures.
(3) 
For cross-connections and backflow preventers that are subject to testing and require annual inspections the fee shall be $75.
(4) 
All suspensions of permits pursuant to N.J.A.C. 5:23-2.16(b) will not be refundable in whole or in part.
(5) 
The fee for plan review shall be 20% of the amount to be charged for a new construction permit. Plan review fees are not refundable.
(6) 
State training fees. Fees shall be pursuant to current regulations of N.J.A.C. 5:23-4.19.

If the raffle should unexpectedly exceed $400, then a total of $20 must be submitted to the state and a total of $20 must be submitted to the Borough at the time of filing the report of operations to the state.
(3) 
Off-premises draw raffle awarding merchandise as a prize (for each $1,000 or part thereof) the fee is $20 to the state and $20 to the Borough.
(4) 
Off-premises cash (50/50) raffle the fee is $20 to the state and $20 to the Borough with submission of application. If more than $1,000 is awarded in prizes, then additional $20 to the state and $20 to the Borough per each $1,000 in awarded prizes or part thereof.
(5) 
Special door prize raffle, no fee and no license required provided the merchandise is wholly donated and has a retail value of less than $50 and provided that other games of chance are not being conducted, held or operated.
(6) 
Calendar raffle fee of $20 to the state and $20 to the Borough for each $1,000 or part thereof of the retail value of the prize.
(7) 
Instant raffle the fee is $20 to the state and $20 to the Borough for each day on which instant raffle tickets are sold or offered for sale, or for a one-year license the fee is $750 to the state and $750 to the Borough.
H. 
Taxicab license (per year): $50.
I. 
Autocab/limousine/livery service shall be $50 for each limousine service plus $10 for each limousine which is covered under the required insurance policy.[1]

Definitions. The following definitions apply to all persons, groups, and organizations requesting use of Borough facilities and fields. Nonresident fees will be assessed when less than 70% of the participants are Lincoln Park residents for Groups B-1 and C-1, regardless of the requestor's residence.
(1) 
Group A-1: Borough use, no charge.
(a) 
Emergency services.
(b) 
Mayor and Council and other Borough services.
(c) 
Recreation and/or educational services sponsored exclusively by the Borough of Lincoln Park and/or the Department of Parks and Recreation.
(2) 
Group A-2: Borough affiliated, no charge.
(a) 
PAL: PAL youth sports. Programs are confined to Lincoln Park youth sports, PAL meetings, sports registrations, sports training classes and other activities that directly relate to PAL sports programs. All other events, classes, and programs sponsored by PAL must be submitted as a separate request by the vendor, instructor or other facilitator with required paperwork, insurance and fees.
(b) 
Not-for-profit youth groups/organizations providing recreational or educational services that are open to all Borough residents. Scheduling preference is given to Lincoln Park service groups or any civic organization or public service groups associated with the Borough of Lincoln Park or the Lincoln Park School District.
(3) 
Group B-1: nonprofit, must submit 501c3 with application.
(a) 
All other not-for-profit groups/organizations providing recreational or educational services that are open to all Borough residents. Scheduling preference is given to Lincoln Park service groups or any civic organization or public service groups associated with the Borough of Lincoln Park or the Lincoln Park School District.
(b) 
Individual resident(s) or other unorganized groups of residents requesting use of facilities or fields for private use shall be assessed a fee and required to submit all required paperwork.
(4) 
Group C-1: for profit. All other for-profit groups, organizations and other users not related to the Borough requesting use of a Borough facility or field.
(5) 
No person, group or organization shall apply for a permit on behalf of another person, group or organization. In the event this occurs, without the Borough's knowledge, the group sponsoring the event will be assessed the rental fees. Examples:
(a) 
Emergency services may not apply for a permit on behalf of an outside vendor to hold a fund-raising event in an emergency services building.

B. 
Municipal Complex facilities and fields.

The Borough reserves the right to deny applications for the use of any of the named fields based on the conditions of the facilities and/or fields, maintenance schedules or any other unforeseen circumstances that would endanger the condition of the facilities and/or fields.

Daily, weekly, monthly and yearly fees are based on three-hour blocks per day. Fees for more than three-hour blocks per day will be adjusted accordingly. Fees may not be prorated for requests for less than three hours per day.

Pursuant to N.J.S.A. 40:48-2.51, an operator engaged in the removal of motor vehicles, or an employee, officer or agent thereof, who engages in a pattern or practice of knowingly violating the fee limits set forth above may be liable to the municipality for a civil penalty of not less than $25 nor more than $50 for each motor vehicle stored with the operator.
