A. 
The City Council of the City of University City makes the following findings, determinations and statements:
1. 
The City Council adopted a resolution on January 9, 1996, at 7:30 P.M. as the resolution of intention to establish a Parkview Gardens special business district pursuant to which the ordinance codified in this Chapter is adopted; and
2. 
The City Council held a hearing on January 22, 1996, at 7:30 P.M. in the Council Chambers, City Hall, 6801 Delmar Boulevard, University City, Missouri to consider the formation of the Parkview Gardens special business district; and
3. 
The Parkview Gardens special business district shall have a boundary as described in Exhibit A which is on file in the City offices and incorporated in this Chapter by reference.

The Parkview Gardens special business district is established.

The initial rate of levy to be imposed upon property lying within the Parkview Gardens special business district shall be eighty-five cents ($0.85) on the one hundred dollar ($100.00) assessed valuation and there is imposed, subject to the requisite majority of the qualified voters of the Parkview Gardens special business district voting thereon, upon all real property lying within the Parkview Gardens special business district a tax levy at the rate of eighty-five cents ($0.85) on the one hundred dollar ($100.00) assessed valuation.

A. 
The uses to which the additional revenue shall be put shall be:
1. 
Marketing and promotion;
2. 
Neighborhood/district beautification;
3. 
Youth recreation programs; and
4. 
Crime prevention programs.

A. 
There is created and established a Parkview Gardens Special Business District Advisory Commission (the "Commission"). The Commission shall consist of five (5) persons who shall be residents of, owners of real property within, or operators of business located within the Parkview Gardens special business district.
B. 
The Commission shall have the following duties and responsibilities only:
1. 
To make recommendations to the City Council as to the use of revenue from any tax imposed within the Parkview Gardens special business district under the Special Business District Act; and
2. 
To undertake such other tasks, duties and responsibilities as the City Council shall from time to time designate.
C. 
The terms of members first (1st) appointed shall be staggered as follows: one (1) member shall be designated to serve a term of one (1) year; two (2) members shall be designated to serve a term of two (2) years; two (2) members shall be designated to serve a term of three (3) years. Subsequent terms shall be for three (3) years. Appointments to fill vacancies shall be for the unexpired portion of a term only. The Commission shall annually elect a Chairperson, Vice Chairperson, and Secretary and shall adopt such rules or bylaws as the Commission shall deem necessary or convenient to carry out the duties and responsibilities under this Section.
