There shall be a permanent Cemetery Fund that is to be set apart
and known as the "Granby Memorial Cemetery Fund", which for brevity
may be referred to as the "Cemetery Fund". The Cemetery Fund shall
not include any amounts received from tax revenue.

A.Â
A Cemetery Committee, appointed by the City of Granby Board of Aldermen,
upon recommendation by the Mayor, is hereby designated and appointed
Ex-Officio Trustee and/or Custodian of the said Cemetery Fund. Cemetery
Committee members shall be a resident of the City of Granby, or live
within the 472 phone exchange area and shall have general knowledge
of fiduciary responsibilities of a trustee and Granby Cemetery guidelines
and ordinances. There shall be no more than five (5) members of the
Cemetery Committee and each shall comply with their duties as set
forth herein, all laws of the State of Missouri, ordinances set forth
in the Granby Municipal Code and standard fiduciary duties.

B.Â
The Cemetery Committee and Chairman shall adhere to the following
guidelines:
1.Â
Upon the first meeting after the general election in April the
Cemetery Committee shall select a Chairman of the Committee, Secretary
of the Committee, Treasurer of the Committee and establish a budget
for the year. Said results and minutes of initial meeting shall be
submitted to the City Aldermen at the following Aldermen meeting.
2.Â
The Committee shall have a monthly meeting, with minutes prepared
by the Secretary of the Committee and shall submit said minutes to
the Board of Aldermen along with a proper accounting of cemetery funds
collected and a report of lots sold, including lot numbers and sections,
names of purchasers and amount of the sale of lots.
3.Â
The Committee Chairman shall attend the first regular Aldermen
meeting of the month, and any other meetings that the Board of Aldermen
deems necessary to attend. The Chairman shall stand ready to discuss
the monthly committee minutes, accounting and reports and to discuss
general cemetery business as the Board deems necessary.
4.Â
The Board of Aldermen may adopt additional guidelines, policies
and procedures to ensure proper reporting and accounting of the cemetery
funds and adherence to City ordinances and State statutes.

Any money paid to the Granby Memorial Cemetery Fund, or any
other organization designated to the Granby Memorial Cemetery intended
for the perpetual care of the Granby Cemetery or lot therein, shall
be accepted by the Cemetery Committee and made a part of the Cemetery
Fund.

The Cemetery Board shall be authorized to create and manage
any accounts necessary for the perpetual care of the Granby Cemetery
including, but not limited to, any funds held in trust at Community
Bank and Trust, formerly Bank of Neosho, Neosho, Missouri.

The Cemetery Fund shall be expended by the Cemetery Committee
for the preservation, care, upkeep and adornment of such cemetery,
for the repurchasing of cemetery lots previously sold or for no other
purpose.

A.Â
The unsold cemetery lots and graves contained in the cemetery shall
from time to time be sold to such persons. The City Clerk shall cause
to be executed and delivered to such purchaser a proper cemetery deed
covering such lot or grave, which said deed shall be signed by the
Chairman of the Cemetery Committee and attested by the City Clerk
and the Seal of said City of Granby shall be thereunto affixed.
B.Â
The Cemetery Committee Chairman, when his/her signature is duly attested
by the City Clerk of the City of Granby, is hereby designated to be
the proper official to sign such cemetery deed and thereby convey
the title to any lot or grave in such deed described to the purchaser
thereof. All such titles, however, shall be subject to all appropriate
rules and regulations which are now in force or which may from time
to time hereafter be adopted relating to the proper care, maintenance
and beautification of the said cemetery by the City of Granby or Cemetery
Committee to have charge of the said cemetery.

A copy of all cemetery deeds and transfer documents shall be kept
at City Hall.

Upon the sale of any cemetery lot, the Cemetery Committee shall
set aside and deposit in a perpetual trust fund an amount deemed necessary
for the perpetual care, maintenance, management and beautification
of said cemetery perpetual.

The title to Granby Memorial Cemetery shall be held by the City
of Granby described as follows to wit:
Part of the Southeast Quarter of the Northwest Quarter of Section
7, Township 25, Range 30, Newton County, Missouri, described as commencing
19.50 feet North and 319.10 feet West of the center corner of the
Northwest Quarter (Southeast corner of the Northwest Quarter of the
Northwest Quarter) of said Section 7; thence South 10°12' East
110.06 feet; thence South 79°16' East 429.72 feet to the True
Point of Beginning; thence continuing South 79°16'00" East 213.21
feet to the approximate center of a public road; thence with the approximate
center of said road South 20°33' West (record) South 20°32'10"
West 172.97 feet (measured); thence North 74°07'29" West 142.54
feet (record) North 74°10'04" West 142.62 feet (measured); thence
North 04°06' West 163.15 feet (record) North 04°04'37" West
163.19 feet (measured) to the True Point of Beginning, subject to
the right-of-way of Main Street along the Easterly line thereof and
subject to any other easements or rights-of-way of record. And
Beginning at the Southeast corner of the Southwest Quarter of
the Northwest Quarter of Section 7, in Township 25, of Range 30; thence
West along the South line of the Southwest Quarter of the Northwest
Quarter of said Section 7 a distance of 400'; thence North 371'; thence
North 65°05' East 154.6'; thence East 260' to a point on the East
line of the Southwest Quarter of the Northwest Quarter of said Section
7; thence South along said line a distance of 435' to the place of
beginning. And
That part of the Northwest Quarter of Section 7, Township 25
North, Range 30 West, described as beginning at a point at the Northwest
corner of the Granby Memorial Cemetery as now located, said point
being 826.10 feet East and 653.88 feet North of an iron pin established
as the Southwest corner of the Northwest Quarter of the said Section
7 by the engineers for the American Smelting and Refining Company
who subdivided said land into miscellaneous tracts; thence North 0°14'
West for 719.89 feet; thence South 82°10'30" East for 213.52 feet;
thence South 10°12' East for 110.06 feet; thence South 79°16'
East for 429.72 feet; thence South 4°06' East for 503.75 feet;
thence West 686.32 feet to the point of beginning, containing 10.32
acres.
forever remain vested in the said City and at no time disposed
of by sale or otherwise. Neither shall the Board of Aldermen of the
said City at any time abdicate or delegate to any society, excepting
the Cemetery Committee, the absolute and unrestrained management thereof,
but any delegation of the care, maintenance or beautification of the
said cemetery shall at all times be upon condition that such delegation
may when deemed prudent by the Board of Aldermen and the welfare,
security and proper care of said cemetery so demand be revoked with
or without notice as the exigencies of the occasion may to said Board's
sole discretion seem proper.

The care, maintenance, management and beautification of said
cemetery shall be delegated to the Cemetery Committee as set forth
herein and only to such persons whose responsibility and prudence
shall to the said Cemetery Committee seem unquestioned and only for
such time as such persons shall demonstrate a capacity for the proper
care, maintenance, management and beautification thereof.

In addition to the proceeds of the sale of lots hereinbefore
declared a part of the said capital or principal sum of the said Cemetery
Fund the said Trustee and/or custodian may and, when offered, shall
accept donations to said fund from any source and give his/her receipt
therefor and such donations shall be promptly turned over to the Cemetery
Committee.

A.Â
The
price of single grave sites in the cemetery of the City of Granby,
Missouri, shall be set at the sole discretion of the Cemetery Committee.
B.Â
Persons
who are neither residents of, nor owners of, real property in the
City of Granby, Missouri, may be considered by the Committee when
determining the amount of the price of graves and lots in the cemetery
of the City of Granby, Missouri.
C.Â
The
burial of cremated human remains shall be permitted in the City Cemetery
subject to any policy of the City. Burial of cremated human remains
shall receive the prior approval of the City's designee. A grave site
owner(s) is allowed to bury up to two (2) cremated human remains on
a single grave site. Burial of cremated human remains shall be on
a site purchased by the deceased or on a site on which a notarized
affidavit consenting to such burial has been obtained from the owner(s)
thereof.
D.Â
All
burials, except the burials of the ashes of cremated bodies, shall
be in vaults or concrete boxes.
E.Â
All
lot corner markers and all grave borders shall be flush with the ground
and are subject to the approval of the Cemetery Committee. Concrete
or brick walls are not permitted marking plots.
F.Â
Internment
of a body other than the documented owner of the cemetery lot or person
previously designated by the documented owner shall require written
consent for such burial from the lot owners.

All graves or lots sold shall be subject to the regulations
now of record or hereafter provided by City ordinance, as to type
of markers, shrubbery, and other regulations affecting graves or lots
in the City Cemetery of the City of Granby, Missouri, and of the laws
of the State of Missouri. All record keeping shall be kept in accordance
with laws of the State of Missouri.

A.Â
Henceforth
all monuments and grave markers erected in the City Cemetery of the
City of Granby shall be installed on a concrete base not less than
six (6) inches deep. The top of said base shall be ground level. In
the event any person or persons fails to comply with this Article,
the Cemetery Committee or Chief of Police is hereby authorized and
empowered to remove any marker or monument erected in violation of
this Chapter. The City of Granby shall have the authority to move
any marker incorrectly placed.
B.Â
A temporary
grave marker reflecting the lot number will be placed by the City
of Granby if no permanent grave marker has been installed after a
six (6) month waiting period.

At all times except as specified, artificial flowers or similar
decorations may be placed upon or maintained upon a grave in the cemetery
of the City of Granby, Missouri. Said arrangement must be placed next
to the headstone so that it will not interfere with the mowing of
said cemetery. Additional decorations may be maintained at Christmas
and continuing thereafter until February first (1st). The caretaker
of said cemetery is hereby authorized and empowered to remove artificial
flowers or other similar decorations in poor condition and to dispose
of them forthwith if they are placed on the graves in violation of
the above regulations.

A.Â
No
person, persons, firms or corporation shall use said cemetery for
any purpose other than the burying of dead, visiting and maintaining
the graves and for any other proper cemetery purpose.

Loitering shall not be permitted in said cemetery.
2.Â
It shall be unlawful for any person or persons to enter or be found
in said cemetery after dark.
3.Â
Any person, persons, firm or corporation violating the provisions
of this Article shall be deemed guilty of a misdemeanor and punishable
in accordance with Granby Municipal Code.

No shrubbery or other plants shall be planted in the City Cemetery
of the City of Granby by any person except as authorized by the Cemetery
Committee.

No obstructions such as trees, statuary, benches, etc., shall
be placed on or around the graves without the approval of the City
of Granby, Missouri, and the Cemetery Committee pursuant to City policy.

No glass containers or figurines of ceramic, plastic, metal,
porcelain or similar material will be allowed in the cemetery and
will be removed for the safety of the caretakers, employees of the
City of Granby, Missouri, and the public.
