Section 115.010 Governing Body.

The Governing Body shall consist of a Mayor and eight (8) Council members to be elected as provided by Charter Ordinance as set out in Section 110.010 of this Code.

Section 115.020 Vacancy in Office of Council Member.

In case of vacancy occurring by reason of resignation, death or removal from office or from the ward in which a Council member has been elected, of any Council member, the Mayor, by and with the consent of the remaining Council members, may appoint some suitable elector residing in such ward to fill the vacancy for the balance of the unexpired term.

Section 115.030 Vacancy in Office of Mayor.

When any vacancy shall happen in the office of Mayor by death, resignation, removal from the City, removal from office or refusal to qualify, the President of the Council or, in case of the Mayor-elect's refusal or failure to qualify, the new President of the Council shall become Mayor until the next regular City election, and a vacancy shall occur in the office of the Council member becoming Mayor. Whenever any temporary absence shall happen in the office of Mayor, the President of the Council for the time being shall exercise the duties of the office of Mayor with all the rights, privileges and jurisdiction of the Mayor until the Mayor shall return.

Section 115.040 Mayor.

A. The Mayor shall preside at all meetings of the Governing Body. He/she shall have the tie-breaking vote on all questions when the members present are equally divided. He/she shall:

1. Have the superintending control of all officers and affairs of the City;

2. Take care that the ordinances of the City are complied with;

3. Sign the commissions and appointments of all officers elected or appointed;

4. Endorse the approval of the Governing Body on all official bonds;

5. From time to time communicate to the City Council such information and recommend such measures as in the Mayor's opinion may tend to the improvement of the finances, the police, health, security, ornament, comfort and general prosperity of the City;

6. Have the power to approve or veto any ordinance as the laws of the State shall prescribe;

7. Sign all orders and drafts drawn upon the City Treasurer for money.

Section 115.050 Council President and Council Vice President.

A. Creation Of Offices. The offices of Council President and Acting Council President (hereinafter referred to as "Council Vice President") are hereby created.

B. Elections by Governing Body — Term. The Governing Body shall elect from its membership a Council President and Council Vice President; those so elected to such offices shall be duly elected or appointed City Council members. Such election shall take place at the regular meeting of the Governing Body in April of odd-numbered years for a two (2) year term.

C. Temporary Absence Of Mayor. The Council President shall exercise the office of Mayor in the temporary absence or disability of the duly elected Mayor; when so exercising the office of Mayor, the Council President shall have no power to sign or veto any ordinance, nor to appoint "appointed officers."

D. Temporary Absence Of Mayor And Council President. The Council Vice President shall exercise the office of Mayor in the temporary absence or disability of the duly elected Mayor and Council President; when so exercising the office of Mayor, the Council Vice President shall have no power to sign or veto any ordinance, nor to appoint "appointed officers."

E. Vacancy In Office Of Mayor. If a vacancy occurs in the office of Mayor, other than a temporary absence or disability, the Council President shall become Mayor until the next regular City election by which the ballot deadline may be met. In such event, the Governing Body shall elect from its membership a new Council President to serve the balance of the existing term. In the event the Council Vice President is elected to serve the balance of the Council President's term, the Governing Body shall elect from its membership a new Council Vice President to serve the balance of the existing term.

F. Vacancy In Office Of Council President. If a vacancy occurs in the office of Council President, other than a temporary absence or disability, the Governing Body shall elect from its membership a new Council President to serve the balance of the existing term. In the event that the Council Vice President is elected to serve the balance of the Council President's term, the Governing Body shall elect from its membership a new Council Vice President to serve the balance of that existing term.

G. Vacancy In Office Of Council Vice President. If a vacancy occurs in the office of Council Vice President, other than a temporary absence or disability, the Governing Body shall elect from its membership a new Council Vice President to serve the balance of the existing term.

H. Removal. The Governing Body may remove the Council President or Council Vice President from such positions by a two-thirds (2/3) vote of the members of the Governing Body then in office. The positions of Council President and Council Vice President, which are vacated by such removal, shall be filled in the same manner as set forth in Subsection (F) and (G) above.

Section 115.060 Compensation.

A. The compensation of the Governing Body shall be as follows:

1. The annual salary for the Mayor shall be set forth in the City's compensation plan. The salary shall be paid in monthly installments until the Mayor's term of office shall cease, or he/she/they are removed from office, or for any reason leave the office.

2. The annual salary for the office of Council member shall be set forth in the City's compensation plan. The salary shall be paid in monthly installments until the Council member's term of office shall cease, or he/she/they are removed from office, or for any reason leave the office.

3. The Governing Body will review annually the compensation of the Mayor and Council members at the first (1st) regularly scheduled meeting in January. The salaries of the Mayor and Council members shall be adjusted annually in accordance with the merit increase aligned with the "Meets Expectations" category for all other City employees from the most recent performance evaluation period unless otherwise modified by action of the Governing Body.

4. The annual salary and any corresponding adjustment to the salary for the office of Mayor or Council member may be waived or reduced at any time upon written request of an individual elected official and such waiver or reduction may be revoked at any time in writing.

Section 115.070 Expenses.

Members of the Governing Body shall be reimbursed for all expenses incurred in the performance of their official duties or at a per diem rate as established by the Federally established per diem rate for destination cities. Requests for reimbursement shall be presented to and approved by the City Administrator.
