For the purposes of this Article, the following words and phrases
shall have the meanings respectively ascribed to them by this Section:
BOD (DENOTING BIOCHEMICAL OXYGEN DEMAND)
The quantity of oxygen utilized in the biochemical oxidation
of organic matter under standard laboratory procedure in five (5)
days at twenty degrees Centigrade (20°C), expressed in milligrams
per liter.
BUILDING DRAIN
That part of the lowest horizontal piping of a drainage system
which receives the discharge from soil, waste and other drainage pipes
inside the walls of the building and conveys it to the building sewer,
beginning five (5) feet outside the inner face of the building wall.
BUILDING SEWER
The extension from the building drain to the public sewer
or other place of disposal.
GARBAGE
Solid wastes from the domestic and commercial preparation,
cooking and dispensing of food and from the handling, storage and
sale of produce.
INDUSTRIAL WASTES
The liquid wastes from industrial manufacturing processes,
trade or business, as distinct from sanitary sewage.
NATURAL OUTLET
Any outlet into a watercourse, pond, ditch, lake or other
body surface or ground water.
PERSON
Any individual, firm, company, association, society, corporation
or group.
pH
The logarithm of the reciprocal of the weight of hydrogen
ions in grams per liter of solution.
PROPERLY SHREDDED GARBAGE
The wastes from the preparation, cooking and dispensing of
food that have been shredded to such a degree that all particles will
be carried freely under the flow conditions normally prevailing in
public sewers with no particle greater than one-half (½) inch
in any dimension.
SANITARY SEWER
A sewer which carries sewage and to which storm, surface
and ground waters are not intentionally admitted.
SEWAGE
A combination of the water-carried wastes from residences,
business buildings, institutions and industrial establishments, together
with such ground, surface and stormwaters as may be present.
SEWAGE WORKS
All facilities for collecting, pumping, treating and disposing
of sewage.
SEWER
A pipe or conduit for carrying sewage.
SLUG
Any discharge of water, sewage or industrial waste which,
in concentration of any given constituent or in quantity of flow,
exceeds for a period of duration longer than fifteen (15) minutes
more than five (5) times the average twenty-four (24) hour concentration
or flows during normal operation.
SUPERINTENDENT
The Superintendent of the sewage works and/or of water pollution
control of the City or his/her authorized deputy, agent or representative.
SUSPENDED SOLIDS
Solids that either float on the surface of or are in suspension
in water, sewage or other liquids and which are removable by laboratory
filtering.
WATERCOURSE
A channel in which a flow of water occurs, either continuously
or intermittently.

A flush tank or flushometer valve must be connected to each
bowl in use on any premises connected to the public sewer of sufficient
size and capacity to carry off all matter deposited in such bowl and
all joints must be tightly and securely cemented so as to empty all
filth, excrement and offal and all foul and decaying matter into the
main of the public sewer to which the same is connected.

Whoever shall, in the City, construct, maintain or use or cause
or permit to be constructed or used by any person in his/her employ
or under his/her control any gutter, drainpipe, sewer or other pipe
from which there shall at any time escape or be discharged any filth,
slop, wastewater, refuse matter or excrement of any kind from any
shop, house, kitchen, bathroom, cellar, water closet, privy vault,
outhouse, stable, stock or hog pen or any filth from any source whatsoever
into or upon his/her own or any other property or into or upon any
street, gutter, alley or highway, branch, surface, water pipe or watercourse
or shall so construct or use or permit to be used any such pipes to
convey the wastewater from any building or premises onto any sidewalks
to the injury, annoyance or discomfort of the citizens of the City
shall be deemed guilty of a misdemeanor.

Before the City shall install or construct sewers within any
sewer district of the City, there shall first be a vote taken of the
residents of such district and installation or construction shall
not be undertaken unless a majority of the residents of such district
shall vote in favor thereof.

A. The
Mayor is authorized to accept, on behalf of the City, all money offered
by the Federal Government to enable the City to carry out any program,
act or activity necessary to the proper improvement of its sewage
works.
B. The
Mayor is hereby authorized to execute such agreements or documents
and to agree to such reasonable terms and conditions as may be required
by the Federal Government for the grant of such money.

No unauthorized person shall maliciously, willfully or negligently
break, damage, destroy, uncover, deface or tamper with any structure,
appurtenance or equipment which is part of the sewage works. Any person
violating this provision shall be subject to immediate arrest under
charge of disorderly conduct.

A. Superintendent To Supervise Sewer Connections, Sewage Treatment Plant,
Etc. The Superintendent of Water and Sewers shall superintend
and oversee all work attendant upon the making of all connections
with the public sewers whenever the proper permit shall have been
issued and no other person shall have authority to remove or break
the seals from any "Y" or "riser" or other pipe entering directly
into the public sewers. The Superintendent of Water and Sewers shall
also care for and oversee the sewage treatment plant and sewer lines
and perform any other duties pertaining to the sewer system when called
upon by the City Manager.
B. Observation Of Safety Rules — Liability Of City For Damages,
Etc. While performing the necessary work on private properties referred to in Subsection
(B) of this Section, the Superintendent or duly authorized employees of the City shall observe all safety rules applicable to the premises established by the company and the company shall be held harmless for injury or death to the City employees. The City shall indemnify the company against loss or damage to its property by City employees and against liability claims and demands for personal injury or property damage asserted against the company and growing out of the gauging and sampling operation, except as such may be caused by negligence or failure of the company to maintain safe conditions as required in Section
710.340.
C. Right Of Entry On Private Properties In Emergency Situations. The Superintendent, the Chief of Police and other duly authorized
officers and employees of the City bearing proper credentials and
identification shall have the immediate and absolute right to enter
upon all private properties and buildings of any type within the City
in emergency situations where public safety is involved including,
but not limited to, earthquakes, floods, tornadoes, hazardous substances,
hazardous wastes, fire, explosions, broken or ruptured gas pipes or
lines and like or similar occurrences or disasters to protect life
and/or property from and against death, injury and damage.

Violation of any Section of this Article shall constitute a misdemeanor and shall be punished in accordance with Section
100.090 of this Code.
