Except for Aleppo Township employees acting within the scope
of that employment, no person or entity whatsoever shall work on or
temporarily or permanently damage or change any public road or street
or any other item of public property of Aleppo Township without first:
A. Describing in reasonable detail, in writing, the work to be done,
which shall, in addition, include returning any public property to
at least its immediately previous condition. This description shall
be filed in application form with the Township Secretary and approved
in writing by the Township Commissioners or their designee before
any work is done; and
B. Posting a completion/restoration bond or similar security in reasonable
form (including a deadline for restoration of the public property
damaged or changed) and in reasonable amount, satisfactory in all
respects to the Commissioners or their designee. The Commissioners
or their designee may, but need not, waive the completion/restoration
bond or similar security in the case of nonprofit, charitable and
similar groups.
The penalty for violation of this chapter shall be a fine of
$300 for each day the violation continues, plus costs of correction
of any damages or changes to public property, plus costs, including
attorneys' fees, incurred by the Township in enforcing this chapter.
In default of payment of such fine and costs, violators shall undergo
imprisonment in the county jail not exceeding 30 days.
