A. 
The City is incorporated and classified as a Fourth Class City. In accordance with State law, the City has the Mayor, Board of Aldermen form of government. Appointments are made by the Mayor with the consent of the majority of the Board of Aldermen. This structure approximates the Federal Government in that it includes the concept of separation of powers (executive, legislative and judicial) and checks and balances. The Board of Aldermen is the basic governing unit because it levies taxes, appropriates monies and makes decisions on policy matters. The Board is the legislative body of the City. It adopts local resolutions and ordinances within the framework of latitude given it by State law. The laws of the City are the ordinances and these may be divided into three (3) categories:
1. 
Administrative. Dealing with the organization of government (i.e. the division of powers between administration departments, the salary scale of employees);
2. 
Contractual. The granting of franchises to private utility firms; and
3. 
Penal ordinances. Regulation of the conduct of persons and are based on the general policy powers of the municipality to protect the health, welfare and safety of the citizens of the City. Many ordinances cover fields where State laws already operate. State laws may also be adopted by reference and incorporated into local ordinances. The City shall have power to enact all ordinances not repugnant to the Constitution and laws of this State.
The inhabitants of the City of Fair Grove, as its limits now are or may hereafter be defined by law, shall be and continue a body corporate by the name of "The City of Fair Grove" and as such shall have perpetual succession, may sue and be sued, implead and be impleaded, defend and be defended in all courts of law and equity and in all actions whatever; may receive and hold property, both real and personal, within such City and may purchase, receive and hold real estate within or without such City for the burial of the dead; and may purchase, hold, lease, sell or otherwise dispose of any property, real or personal, it now owns or may hereafter acquire; may receive bequests, gifts and donations of all kinds of property; and may have and hold one (1) common Seal and may break, change or alter the same at pleasure; and may do any act, exercise any power and render any service which contributes to the general welfare and all courts of this State shall take judicial notice thereof.

A. 
The emblem in the form attached to and hereby made a part of this Code is approved and adopted by the Board of Aldermen as the official emblem of the City. It is to be used as needed for identification and promotion of functions and programs of the City.
B. 
Seal Described. The seal of the City shall, as heretofore, be a seal of Justice, inside of and surrounded by a scroll or circular impression having inscribed therein the words, "Seal of the City of Fair Grove, Missouri." The seal shall be circular and at least two (2) inches in diameter. The City Seal shall be safely kept in the office of the City Clerk.
