It is the intent of the Board of Trustees in enacting this chapter
to provide for the orderly use, regulation and preservation of Village
parks. Such parks are deemed to be a valuable asset of the Village
and should be used for the mutual benefit and enjoyment of all in
such a manner so as not to constitute an annoyance or a nuisance for
residents of the area surrounding such parks. In furtherance of such
objectives, the Board of Trustees does hereby enact as follows.
Except as provided in §§
152-3 and
152-9, Village parks shall be closed to the public between the hours of 11:00 p.m. and 6:00 a.m. Any person found in such parks during the hours the park is closed will be subject to the penalty set forth in §
152-10 of this chapter.
Any individual or group wishing to remain in Village parks from
the hours of 11:00 p.m. to 6:00 a.m. may do so upon applying to the
Board of Trustees for permission. Applicant shall provide the name
of the person in charge and approximate number included in the group
using such park. If a park is to be used for all-night camping, the
Board of Trustees shall also be informed of such fact and the general
location in which the campers plan to camp.
After the hour of 11:00 p.m., no person shall operate any mechanical
device which will reproduce sound or music, such as a tape recorder,
radio, record player, television set or other device which reproduces
or emits mechanical sounds.
No person shall be permitted to operate upon any of the trails
or paths within Village parks any off-the-road vehicles, motor bikes,
snowmobiles or other similar vehicle. Only vehicles authorized for
operation upon the public highway shall be permitted to operate within
parks, and then only upon that portion of the park's land set
aside and used for a roadway.
Persons using Village parks will confine campfires to confined
or restricted areas or grills commonly used for cooking food. The
use of bonfires or other large fires for other than general heating
or cooking purposes is prohibited.
Notwithstanding any local law to the contrary, the moderate
use of alcoholic beverages in Village parks is permitted. However,
no person shall use alcoholic beverages in such a way as to constitute
a nuisance to other persons using a park or to persons living in the
area of the park. Any person who uses alcoholic beverages in such
a way as to constitute a nuisance may be asked to leave the park immediately.
Failure to do so shall constitute a violation of this chapter.
The following acts are prohibited in Village parks:
A. The hunting of any animal in the park by either firearm, bow, slingshot
or other device used to hunt animals.
B. The setting of traps or the trapping of any animal.
C. The discharge of any firearm for any purpose. For the purpose of
this chapter, a firearm shall include a rifle, shotgun, BB gun, pellet
gun or any other similar device or weapon.
D. No person shall deface, injure, displace, remove, fill in, raise,
destroy or tamper with any drive, path or walk; take up, remove or
carry away trees, shrubs, turf or any material or substance; remove
or destroy any structure, building or any appurtenance connected with
the park or any other property or equipment, real or personal, owned
by the Village of Castleton-on-Hudson or under the jurisdiction and
control of the Board of Trustees.
E. The dumping of any trash, garbage, scrap or other material constituting
litter, or in any other manner littering the park.
From time to time, the Board of Trustees may, by resolution,
adopt rules and regulations relating to the use of ice skating rinks
and setting reasonable hours of use thereof. Such resolution, when
adopted, shall be conspicuously posted in the Village Hall and in
a suitable place in the area of the ice skating rink.

Any person convicted of a violation of this chapter shall be
liable to a fine not to exceed $250, imprisonment for not more than
15 days, or both such fine and imprisonment. Each day's violation
shall be considered a separate and distinct violation.
