The Mayor shall, with the approval of a majority of all members
of the Board of Aldermen, appoint a Park and Recreational Advisory
Board of not more than eleven (11) members.

One (1) member of the Park and Recreational Advisory Board may
be a member of the Board of Aldermen.

At the first (1st) regular meeting of the Board of Aldermen
following adoption of this Chapter, two (2) members of the Park and
Recreational Advisory Board shall be appointed for a term expiring
June 30, 2002, two (2) members shall be appointed for a term expiring
June 30, 2003, three (3) members shall be appointed for a term expiring
June 30, 2004. Thereafter, at the first (1st) meeting of the Board
of Aldermen in June of each year, members shall be appointed for terms
of three (3) years each, or until their successors are duly appointed
and qualified.

When a vacancy occurs on the Park and Recreational Advisory
Board by removal, resignation or otherwise of any member thereof,
said vacancy shall be reported to the Board of Aldermen and shall
be filled, in a like manner as original appointments, for the unexpired
term of said member.

No Park and Recreational Advisory Board member shall receive
any compensation as such.

The Park and Recreational Advisory Board members shall meet
at least quarterly on a set date and at a set time as determined by
the members. The members shall elect one (1) of its members as Chairman
and one (1) of its other members as Secretary.

A. The Park
and Recreational Advisory Board shall have the following duties and
responsibilities:
1. Identify
park and recreational attitudes of individuals and organizations in
the community.
2. Make
annual budget recommendations and identify long-range budget needs.
3. Encourage
resources to continue ongoing and future park and recreation programs.
4. Accept
and perform delegated responsibilities.
5. Advise
on basic policies that guide the department.
6. Maintain
a clear distinction between its own function and function of the Governing
Body and professional staff.
7. Submit
all recommendations or suggestions in writing to avoid misinterpretations.
8. Recognize
that its recommendations or suggestions will not always be followed.
9. Review
and advise on development plans.
10. Recommend
sites for park expansion.
11. Recommend
new programs for inclusion into department offerings.

The Mayor may, with the consent of a majority of all the members
of the Board of Aldermen, remove any Park and Recreational Advisory
Board member. Any member may also be removed by a two-thirds (2/3)
vote of all members of the Board of Aldermen, independently of the
Mayor's approval or recommendation.

The City or its appointee is hereby authorized to propound regulations
and rules governing the use, misuse and occupancy of the public parks
of the City of Ash Grove, including the regulation of hours that said
parks will be open to the public, the conditions and restrictions
of use of park equipment, the conditions, restrictions and hours of
use of the municipal swimming pool and provide for expulsion of and
limitation of use to the violators of the rules and regulations.

A. The City
or its appointee is hereby authorized to provide for, regulate and
police parking areas for motor vehicles using the municipal parks.
B. No person
shall drive a motor vehicle at a speed in excess of five (5) miles
per hour within any municipal park area.
C. The City
or its appointee is authorized to determine and designate intersections
where particular hazards exist and to determine whether vehicles shall
stop at one (1) or more entrances to any such intersection and shall
erect a stop sign or yield right-of way sign at every such place.
D. No person
shall drive a motor vehicle in the public parks except on streets,
roadways, driveways or parking areas that are designated for such
vehicular traffic.
E. No person
shall park a vehicle in any street, roadway, driveway or parking area
that is marked for parking in any public park at any time or in any
manner, except as designated by lines or markings upon the pavement
or ground.

The City employees so designated are hereby authorized to exclude
and prohibit the use of the public parks to any person in violation
of this Chapter or in violations of the rules and regulations of the
park.

Any person found and determined to be in violation of the provisions
of this Chapter or of the rules and regulations propounded by the
City or its appointee shall, upon conviction thereof, be punished
by a fine of not less than five dollars ($5.00) and not more than
five hundred dollars ($500.00).

It shall be unlawful for any person to conduct any musical festivals
or other presentations (revival meetings, craft shows, food sales,
athletic events, car shows, flea markets, antique shows, animal shows,
etc.) in any public park without first obtaining a permit therefor
from the City.
