The International Fire Code/2012 published by the International Code Council, Inc., three (3) copies of which are on file in the office of the City Clerk, is hereby adopted and incorporated herein by reference as the Fire Code of the City of Eldon, with the additions, insertions, deletions and changes contained in Section
500.110.

The additions, insertions, deletions and changes in the International
Fire Code 2012 as adopted above shall be as set out below:
Delete Section 101.1 and insert in its place:
101.1: Title: These regulations shall be known
as the "Fire Code of the City of Eldon, Missouri,"
hereinafter referred to as "this code."
Add Section 101.6:
101.6: This Article or the code adopted herein
shall not be constructed to relieve the responsibility or liability
of any persons owning, operating, controlling any business or structure
or damage caused by defect therein, nor shall the City of Eldon or
any of its inspectors, agents or employees, including its Codes Enforcement
Officer, be held as assuming liability by reason of the inspection
authorized therein or certificate of approval issued as herein provided.
Add Section 103.5:
103.5: Qualifications of the Codes Enforcement Officer: The Codes Enforcement Officer shall be over twenty-one (21) years
of age, be of good moral character, and be physically able to carry
out the provisions of the Fire Code. The Codes Enforcement Officer
shall possess a working knowledge of building construction, fire suppression
systems and hazardous materials. The Codes Enforcement Officer shall
not be actively engaged in the construction business, nor associated
with the operation of any person, firm or corporation engaged in the
construction business.
Add Section 103.6:
103.6: Duties of the Codes Enforcement Officer: It shall be the duty of the Codes Enforcement Officer to enforce
the provisions of the Fire Code and to make all inspections required
thereunder, and to cause the issuance of all permits, collect all
fees and keep records required under this Article or the code adopted
herein. All fees are to be credited to the General Revenue. The Codes
Enforcement Officer shall also perform all tasks and services delegated
by other ordinances or supervisory personnel.
Delete Section 104.11:
104.11: Authority at Fire and Other Emergencies: The Fire Chief or Officer of the Fire Department in charge at the
scene of a fire or other emergency involving the protection of life
or property or any part thereof shall have the authority to direct
such operations as necessary to extinguish or control any fire, perform
any rescue operation, investigate the existence of suspected or reported
fires, gas leaks or other hazardous conditions or situations, or take
any other action necessary in the reasonable performance of duty.
The Fire Chief or Officer of the Fire Department in charge shall follow
the Incident Management System (IMS) as recognized by the National
Fire Protection Agency (NFPA). In the exercise of such power, the
Fire Chief is authorized to prohibit any person, vehicle, vessel or
thing from approaching the scene and is authorized to remove, or cause
to be removed or kept away from the scene, any vehicle, vessel or
thing which could impede or interfere with the operations of the Fire
Department and, in the judgment of the Fire Chief, any person not
actually and usefully employed in the extinguishing of such fire,
performance of a rescue operation, gas leak, hazardous condition,
or in the preservation of property in the vicinity thereof.
Delete Section 104.11.2 and insert in its place:
104.11.2: Obstructing Operations: No person shall obstruct the operations of the Fire Department in connection with extinguishment or control of any fire, or actions relative to other emergencies; see Section
205.090 of the City Code of City of Eldon. No person shall disobey any lawful command of the Fire Chief or officer of the Fire Department in charge of the emergency, or any part thereof, or any lawful order of a Police Officer assisting the Fire Department; see Section
310.020 of the City Code of City of Eldon. Any person who shall violate any provision of this Section shall be guilty of a misdemeanor, punishable by a fine of not more than five hundred dollars ($500.00); see Section
205.090 of the City Code of the City of Eldon.
Delete Section 111.4 and insert in its place:
111.4: Failure to Comply: Any person who shall
continue any work after having been served a stop-work order, except
such work as that person is directed to perform to remove a violation
or unsafe condition, shall liable to a fine of not less than fifty
dollars ($50.00) nor more than five hundred dollars ($500.00).
Delete Section 307.2 and insert in its place:
307.2: Permit Required: A permit shall be obtained
from the Fire Chief or his/her designated representative for the purpose
of bonfires or open burning. Only approved materials, such as leaves,
tree limbs, vegetation or tree trunks that originate on a residential
premises having not more than four (4) dwelling units will be permitted.
Permits shall only be issued for daylight hours and may be canceled
due to weather conditions and at the Fire Department's discretion.
Any person who violates a provision of this Section shall be guilty
of a misdemeanor, punishable by a fine of not less than fifty dollars
($50.00) and not more than five hundred dollars ($500.00).
Delete Section 307.4 and insert in its place:
307.4: Attendance: Open burning and bonfires
shall be constantly attended until the fire is extinguished. A garden
hose or water truck shall be available for immediate utilization.
Delete Section 503.2.3 and insert in its place:
503.2.3: Surface: Fire apparatus access roads
shall be designed and maintained to support the imposed loads of fire
apparatus and shall be surfaced so as to provide all-weather driving
capabilities. "All-weather" shall be defined as concrete or asphalt
designed for the imposed loads.
Appendix B shall be adopted in its entirety.
Appendix C shall be adopted in its entirety.
Appendix D shall be adopted in its entirety.
Appendix E shall adopted in its entirety.
Appendix F shall be adopted in its entirety.
Appendix G shall be adopted in its entirety.
Any person who shall violate a provision of this Article or
the code adopted herein or shall fail to comply with any requirements
thereof or who erects, constructs, alters, installs or repairs or
does any work on any building or structure in violation of the approved
construction documents or directive of the Codes Enforcement Officer,
or of a permit or certificate issued under the provisions of this
Article or the code adopted herein, shall be guilty of a misdemeanor,
punishable by a fine of not more than five hundred dollars ($500.00)
or by imprisonment for a period not exceeding ninety (90) days, or
by both fine and imprisonment. Each day that a violation continues
after due notice has been served shall be deemed a separate offense.
