[CC 1988 §32.010]
A "taxicab", under the terms of this Chapter,
is a motor vehicle of not more than seven (7) passenger capacity,
not including the driver, operated as a common carrier of persons
or property for hire within the City of Eldon, Missouri.

It shall be unlawful for any individual, firm or corporation
to operate a taxicab or taxicabs or to engage in the business of a
common carrier of persons or property for hire within the City of
Eldon, Missouri, without first having obtained a license from the
City Clerk of the City of Eldon, Missouri, for each and every motor
vehicle operated as a taxicab within the City.

Every individual, firm or corporation operating a taxicab or
taxicabs, as hereinbefore defined, within the City of Eldon, Missouri,
shall pay to the City Collector a fee of five dollars ($5.00) for
each taxicab for a period of twelve (12) months from the date of the
issuance of the license and no license shall be issued for a shorter
period than twelve (12) months and no refund shall be given on any
license issued; provided however, any taxicab now operating under
a license heretofore issued shall be authorized to continue to operate
for the period of its present license without the payment of additional
fee if the one so operating the taxicab complies with the provisions
as hereinafter set forth regarding liability insurance, subject to
being revoked by the Board of Aldermen as herein provided.

No license shall be granted for the operation of any taxicab,
as hereinbefore provided, until the applicant for the license shall
have filed with the City Clerk of the City of Eldon, Missouri, a liability
policy of insurance by some reliable insurance company or association
or other insurer authorized to transact business as such within the
State of Missouri conditioned to pay compensation for damages to any
property of any person or persons other than the property of the assured,
his/her agents or servants caused by the negligence of the assured
or his/her agents or servants in the operation of the taxicab, the
limit of such liability to be at least ten thousand dollars ($10,000.00)
and which said insurance shall bind the insurer to pay compensation
for bodily injuries, including death, to any person other than the
assured, his/her agents or servants, caused by the negligent operation
of the taxicab, the limit of such liability to be at least twenty-five
thousand dollars ($25,000.00) to any one (1) person and fifty thousand
dollars ($50,000.00) for any one (1) accident. The above provisions
shall apply to each taxicab so operated. Each policy of insurance
shall have the endorsement by the company on it to the effect that
the policy of insurance shall not be cancelled or shall not expire
until after ten (10) days' written notice to the City Clerk of the
City of Eldon, Missouri.

All taxicabs operated within the City of Eldon, Missouri, shall
be operated in a careful and prudent manner so as not to endanger
the life, limb or property of another and shall not violate any of
the provisions of ordinances of the City of Eldon, Missouri, and the
Board of Aldermen shall have the power to revoke any license for failure
of the operator of any taxicab to observe this provision after five
(5) days' written notice to the licensee and after hearing has been
accorded the said licensee before the said Board of Aldermen and,
provided further, that if the licensee shall allow the liability insurance
heretofore required to expire, upon the expiration of such insurance,
the license under which said taxicab is then operated shall be automatically
cancelled and annulled as of the date of the expiration of such insurance.

It shall be unlawful for any individual, firm or corporation
to operate a taxicab or taxicabs within the City of Eldon, Missouri,
without first complying with the provisions of this Chapter and it
shall be unlawful for any individual, firm or corporation to operate
a taxicab or taxicabs within the City of Eldon, Missouri, after any
license which had been granted and later annulled, cancelled or revoked.
Any individual, firm or corporation violating the terms of this Chapter
or any provision hereof shall be deemed guilty of a misdemeanor and
upon conviction shall be punished by a fine of not more than one hundred
dollars ($100.00) or by imprisonment for not more than ninety (90)
days or by both such fine and imprisonment for the violation of each
and every Section hereof.
