Section 100.215 Charge For Checks Returned For Insufficient Funds.

A. The penalty for checks returned for insufficient funds will be as set out in Chapter 150, Table A in Title I of this Code.

B. If the insufficient funds check was issued for payment of a water bill, payment of the water charges and insufficient check charge must be made to the City Treasurer before the shut-off deadline or service will be disconnected.

C. If the insufficient check charge and other costs are not paid, charges may be filed in accordance with applicable laws governing such violations.

Section 100.217 Scattering of Ashes and Burial of Remains on City Property.

A. In performance of their assignment as managers and caretakers of the properties of the City of Concordia, Missouri, the Board of Aldermen has determined that the City shall not grant permission for spreading of ashes or grant the privilege to bury any remains at or on any properties owned by the City of Concordia.

B. The City reserves the right to dispose of remains of animals at a designated location on City property so long as proper standards for burial are adhered to.

Section 100.218 Fingerprinting of Applicants or Licensees in Specific Occupations.

A. This Section is enacted pursuant to Chapter 43, Section 43.535, RSMo., to regulate the employment of full-time, part-time and volunteer employees working for the City of Concordia. This Section is also enacted to regulate the issuance of licenses for business, sales of alcoholic beverages, trades and solicitor, or for the regulation of individuals engaged in adult entertainment.

B. An applicant, employee or volunteer seeking employment or licensing, or engaged in adult entertainment shall submit, if requested, two (2) sets of his/her fingerprints taken by the Concordia Police Department to the Missouri State Highway Patrol, Criminal Justice Information Services (CJIS) Division, along with appropriate fees.

C. Upon receipt of the fingerprints and the appropriate fees, the City Clerk of the City of Concordia will transmit both sets of fingerprints and appropriate fees to the Missouri State Highway Patrol, CJIS Division. The Missouri State Highway Patrol, CJIS Division will compare the subject's fingerprints against its criminal file and, if necessary, submit the fingerprints to the Federal Bureau of Investigation for a comparison with nationwide records. The results of the Federal Bureau of Investigation check will be returned to the Missouri State Highway Patrol, CJIS Division, which will disseminate the State and national results to the City Clerk of the City of Concordia, Missouri.

D. The City Clerk shall disseminate the results of the criminal background check to the City Administration for a fitness determination.

E. In rendering a fitness determination, the Administration will decide whether the record subject has be convicted of, or is under pending indictment for a crime which bears upon his/her ability or fitness to serve in that capacity; any felony or a misdemeanor which involved force or threat of force, controlled substances or was a sex-related offense.

F. A record subject may request and receive a copy of his/her criminal history record information from the City Clerk of the City of Concordia. Should the subject seek to amend or correct his/her record, he/she must contact the Missouri State Highway Patrol, CJIS Division for a Missouri State record or the Federal Bureau of Investigation for records from other jurisdiction maintained on file.
