No person shall trespass on the property of the City, located
in Sections 17, 18, 19 and 20 of Township forty-eight (48), Range
twenty-four (24), in Lafayette County, Missouri, used by said City
as a reservoir for drinking water and other purposes and the surrounding
area and commonly referred to as the Edwin A. Pape Lake, hereinafter
referred to as lake; except as hereinafter provided.

A. No
livestock shall graze or be permitted upon said property without the
written consent of the Board of Aldermen of the City of Concordia.
B. No
dogs shall be permitted to run at large upon said property or enter
the lake waters, except dogs used for retrieval of waterfowl during
the waterfowl season as defined herein. The owners shall be held responsible
for his/her dogs.
C. It
shall be unlawful for any person to bathe, swim or wade in the lake
waters; provided, that wading may be permitted when waterproof material
is used so that the body does not come into contact with the water.
D. It
shall be unlawful for any person to dump or throw trash or rubbish
on the lake property or any substance in the lake waters.
E. All
persons hereinafter permitted to enter upon the lake property shall
conduct themselves in an orderly and prudent manner, and shall comply
with all of the regulations herein contained, all orders of the Police
Department, special Police or caretaker, and shall comply with all
the rules and regulations under which said person is permitted by
user permit to enter upon said premises or waters.
F. Intoxication
and use of profane language are prohibited, and persons committing
acts of vandalism, excessive noise, loud music, destruction of property,
and indecent behavior shall be subject to fine as hereinafter provided
and may be ejected from the premises, temporarily or permanently.
G. It
shall be unlawful to carry or use a gun on the ground or lake; except
shotguns as provided for in waterfowl hunting regulations hereof.
Possession of a firearm in a vehicle on the premises of the City lake
shall not be a violation so long as the firearm is not removed from
the vehicle or brandished while the vehicle is on the premises, as
stated in Section 210.280.
H. It
shall be unlawful to fish in the lake except from the times set forth
each year by the Board of Aldermen.

User permits may be issued, and all permits so issued shall
be issued on the condition that applicants will abide by all rules
and regulations then or thereafter put into effect and subject to
the right of the City to temporarily or permanently close all or part
of the grounds or lakes to fishing, boating and hunting, or any of
them at any time, and for any reason whatsoever; provided further,
that the City may suspend any other provision of this Chapter and
may grant at any time special permission contrary thereto to any person
or group of persons.

Any misstatement or error in the application made to obtain
any permit for the use of the lake waters or the surrounding area
or any misstatement, error or erasure on a permit for the use of said
area shall render the permit void without recourse and shall be deemed
a misdemeanor. The truthfulness and correctness of any information
contained in the application for a permit or the permit itself shall
be the sole and absolute responsibility of the person making said
application or holding said permit.

A. The
method of fishing allowed shall be limited to three (3) hand poles
(including rod and reel) and all other methods are prohibited.
B. The
use of carp, buffalo and gold fish minnows are prohibited.
C. Frog
hunting shall only be lawful during the season provided by State laws,
and the method of frogging and limit shall be the same as the State
laws, except that no gun shall be used. A user permit is required
for frog hunting.
D. The
Mayor and Board of Aldermen shall set by resolution the user fee for
fishing and hunting. Creel and bag limits and length of season shall
correspond to the laws and recommendations set forth by the Missouri
Department of Conservation.
E. No
boat shall be allowed on the waters of the lake without a user permit.
The minimum length of boats shall be ten (10) feet or, if less than
ten (10) feet, it must be a Coast Guard approved boat. No rubber boats
or personal watercraft shall be allowed on the lake waters.
F. Motorboats
will have unlimited horsepower but must operate only at a no-wake
speed and shall have a suitable life preserver for each passenger.
No motorboats shall be operated near enough to interfere with the
operation of the intake and pumping station and facilities and other
such restricted area as may be determined and established by the Board
of Aldermen of the City of Concordia.
G. All
persons operating boats upon the lake shall do so in a safe and prudent
manner as to ensure the safety of persons within such boats and the
safety of persons in other boats or other persons on said lake or
surrounding area. No person shall permit the overloading of any boat
and shall not operate motor-driven boats at such speeds as to create
waves that may endanger the lives of other boaters or unduly interfere
with fishing along the shoreline. No person shall operate any boat
at an excessive rate of speed or race with any other boat in any manner
whatsoever except by special permission of the City to hold public
exhibitions on said lake. The City shall not be responsible to a permit
holder or any other person for injury or damage to property due to
an accident or other incidents occurring on the lake or surrounding
premises.
H. Defective
or unsafe boats shall not be permitted on the lake waters. If any
defective or unsafe boats are found on the lake waters, they shall
be ordered out of the water and the user permit shall automatically
be revoked or suspended without refund of permit fee until such time
as such boat is repaired and approved by the person designated by
the Board of Aldermen.
I. No
dock, post or other erection of any kind shall be constructed, erected
or placed in or upon the lake waters or surrounding lands of the lake
without special permission of the City. Any person receiving such
special permission shall not construct, place or erect any post or
other erection except as is provided in such special permission.
J. Rental
of boats for hire is not permitted without written authority from
the City.

A. It
shall be unlawful to operate or make use of any motorized vehicle
in any area of the Edwin A. Pape Lake except the paved and graveled
roads and parking lots at the lake, other than specifically allowed
in this Section.
B. Parking
is allowed for scheduled events on the grounds in the area immediately
adjacent to the two (2) shelter houses and the horse riding arena
without special permission of City administration. Users are responsible
for good conduct in the use of City property.
C. Parking
is permitted on the grounds for the annual fourth (4th) of July fireworks
display without prior permission as long as it continues to be a civic
event sponsored by the Concordia Civic Club.
D. The
City administration may allow parking on the City lake grounds at
other times for special events as it may specifically authorize from
time to time.
E. Any
person who violates this Section shall be guilty of an infraction
and may be fined up to five hundred dollars ($500.00).

A. A waterfowl blind permit may be obtained by at least two (2) but not more than six (6) persons joining together and making application therefore. An amount as set out in Chapter
150, Table A of Title I of this Code shall be deposited with the City Clerk for the upcoming waterfowl season to reserve a location for a blind. The waterfowl blind permit shall authorize the persons to whom issued to erect one (1) waterfowl blind for the upcoming waterfowl season at the location designated by the Board of Aldermen or such other persons as the Board of Aldermen may designate.
B. In
addition to the maximum number of six (6) people assigned to a blind,
up to four (4) additional "occasional" waterfowl hunters may be designated
for each blind, making ten (10) the maximum number of hunters permitted
to shoot waterfowl from any given blind. It is permissible for minor
age children to accompany their parents or other adults in the blinds.
Waterfowl blinds are not to be occupied by anyone other than license-holding
hunters and their guests while actively engaging in the sport of hunting.
C. Each person hunting waterfowl upon City lake property, including those persons who have placed a refundable blind deposit as set out in Chapter
150, Table A of Title I of this Code and minor age children, shall obtain a waterfowl hunting permit by making application therefor with the City Clerk along with a fee as set out in Chapter
150, Table A of Title I of this Code. Each waterfowl permit issued shall be valid for one (1) waterfowl season and shall expire annually at the end of waterfowl hunting season but no later than March first (1st).
D. Waterfowl
hunting applications will be restricted to citizens of the City of
Concordia, Missouri until the day of the blind drawing. After the
day of the blind drawing, applications can be made by any person living
outside the City limits of Concordia. Applications are to be made
to the person designated by the Board of Aldermen to issue said permits.
E. The
amount deposited for the waterfowl blind permit shall be refunded
to a member of the group if the blind is removed from the lake property
without causing damage to City property by March fifteenth (15th).
Any blind left on City lake property after March fifteenth (15th)
will become City property and will be removed or disposed of properly
and no deposit will be refunded. Each member of the blind not removed
by March fifteenth (15th) shall not be allowed hunting privileges
for the next hunting season.
F. During
the waterfowl hunting season, all hunting-related accessories such
as decoys, are the sole responsibility of the waterfowl hunter. All
decoys shall be removed from City lake by the last day of the waterfowl
season. As the lake will become a shared lake between hunters and
fishermen immediately following the conclusion of the waterfowl season,
even if the Missouri Department of Conservation implements a late
winter or early spring waterfowl season, any decoys remaining on City
lake waters will become City property and will be removed or disposed
of properly and no deposit will be refunded.

A. No
fishing will be allowed on the City Lake during the waterfowl seasons.
The waterfowl season shall be defined as that time from the opening
day of the waterfowl youth hunt concluding the last day of duck season,
as determined by the Missouri Department of Conservation.
B. The
entire City lake shall be open for fishing the day after the final
day of duck season. If the Missouri Department of Conservation offers
an extended waterfowl season, the lake shall be shared by waterfowl
hunters and fishermen for the duration of the extended season. No
hunting will be allowed on City lake properties following the close
of the extended season, unless authorized by the Board of Aldermen.

All permits issued hereunder for boating, fishing and hunting
shall be subject to all laws of the State of Missouri regulating such
activity or activities in addition to the regulations herein set out
and the laws of the State of Missouri regulating such activities.

A. The
Board of Aldermen hereby establish a user's permit effective May 1,
1988, for use of the City lake property in the City of Concordia subject
to the rules and regulations contained in this Section as follows:

3. For the purpose of this Chapter, "sixteen (16) years of age" shall be defined as those individuals having celebrated his/her
sixteenth (16th) birthday.
4. Persons under sixteen (16) years of age are prohibited from fishing unless accompanied by a permit holder as defined in this Section or a senior citizen who is not required to apply or possess a user's permit as outlined in Section
235.110.
5. The City Clerk may authorize agents for sales of said permits and
shall issue a maximum of two (2) books, consisting of twenty-five
(25) permits each. An agent fee of five percent (5%) being a part
of the sum set for the particular user permits shall be returned to
such agent upon sale of such permits. When the vendor has sold a book
of permits, he/she will return the book and the sum of monies collected
for permits to the City Clerk. The City Clerk shall calculate the
respective agent fees and shall issue payment to said vendor for those
monies. Any unused book shall be returned to City Hall on or before
December first (1st) annually. New books shall be made available on
December first (1st) of each year. No person with outstanding books
shall be issued new books.

The City shall have the power to enforce the provisions of this
Chapter under the City Police powers and may prosecute violations
of this Chapter in the Municipal Court for the City of Concordia,
Missouri. All permits related to the use of the City lake property
shall be revoked upon a conviction of the holder thereof in violation
of any of the provisions of this Chapter.

A user's permit shall be issued by the City Clerk and such other persons as the Board of Aldermen may designate, and the City Clerk and all other persons so authorized by the Board of Aldermen shall issue the permits and charge a fee as outlined in Section
235.090 of this Chapter. Provided however, that senior citizens sixty-five (65) years of age or over shall not be required to apply or possess a user's permit.

No person shall trespass upon the City lake without a valid
user's permit. Fishing on the lake properties shall be twenty-four
(24) hours per day, or such hours as may be designated by the Board
of Aldermen, and then only by permit holders. There shall be no trespassing
upon the premises between the hours of 10:00 P.M. and 4:00 A.M. for
non-anglers except with prior permission from the City of Concordia.

The City reserves the right to temporarily or permanently close
all or any parts of the grounds or lake to fishing or boating or both
at any time.
