This chapter shall be known as the "Administrative Code of the Township of Mine Hill."
The purpose of this chapter is to establish and organize the government of the Township of Mine Hill in accordance with the Mayor-Council Plan E form of government established pursuant to the Optional Municipal Charter Law (N.J.S.A. 40:69A-1 et seq.), approved by the voters of the Township of Mine Hill in November 1978; to define and separate the legislative powers of the Council and the executive and administrative powers of the Mayor; to establish and organize the various departments of government and to assign and allocate administrative functions, powers and duties to such departments.
All ordinances of the Township of Mine Hill heretofore adopted prior to January 1, 1980, except such ordinances or parts thereof as may be inconsistent with the provisions of the Optional Municipal Charter Law (Laws 1950, Chapter 210; N.J.S.A. 40:69A-1 et seq.) or the provisions of this chapter, are hereby continued as the local laws of the Township of Mine Hill.
For the purpose of this chapter, the words and terms set forth immediately below are defined as follows:
ADMINISTRATOR
The Business Administrator appointed pursuant to this chapter and the Charter.
CHARTER
The provisions of the Optional Municipal Charter Law (Laws 1950, Chapter 210, as amended) governing a Mayor-Council Plan E form of government.
CLERK or TOWNSHIP CLERK
The Municipal Clerk duly appointed by the Council pursuant to the Charter.
COUNCIL
The members of the Municipal Council of the Township of Mine Hill possessing all the legislative powers of the Township as set forth in the Charter.
DEPARTMENT
A unit of the municipal government established or designated by this chapter as a department.
DIRECTOR
The administrative head of a department established by this Code.
GOVERNING BODY
The Municipal Council of the Township of Mine Hill comprised of five Councilmen in accordance with provisions of the Optional Municipal Charter Law.
MAYOR
The individual serving as chief executive officer of the Township and possessing the executive powers of the Township as set forth in the Charter.
MONTH
A calendar month unless otherwise specifically provided.
ORDINANCE
Any ordinances of the Township of Mine Hill in force and effect on January 1, 1980, and thereafter, including this Code.
PERSON
Any individual, corporation, firm, partnership, association, organization or other entity.
TOWNSHIP
The Township of Mine Hill in the County of Morris, State of New Jersey, as governed and organized by the provisions of the Charter and this Administrative Code.
YEAR
A calendar year unless otherwise specifically provided.
For the purposes of the Administrative Code and any other ordinances heretofore or hereafter adopted, except as the context may otherwise require:
A. 
The present tense includes the past and future tenses and the future, the present.
B. 
The masculine gender includes the feminine and neuter.
C. 
The singular number includes the plural and the plural the singular.
D. 
The time within which an act is to be done shall be computed by excluding the first and including the last day, and if the last day be a Sunday or a legal holiday, that day shall be excluded.
E. 
The terms "writing" and "written" include printing, typewriting, stencil, duplicating and any other visual mode of reproducing words or figures on paper-like material which is in general use.
