A director may serve as a division head without additional compensation,
unless additional compensation is approved by the Council.
Department heads shall appoint subordinate officers and employees
within their respective departments, within the limits of available
appropriations, and except where authority to appoint is specifically
conferred upon the Mayor by the provisions of this Code. Department
heads may also suspend, discipline and remove such subordinate officers
and employees appointed by them, with the approval of the Mayor, subject
to such limitations as may be imposed by law. Each department head
shall annually in December furnish the Mayor and Business Administrator
with a list of all officers and employees within his (her) department,
setting forth the name, address and job title or job description and
the then-current annual salary of each such officer and employee.
In addition to the enumerated duties of all departments, divisions,
officers and employees as set forth in this Code, each such department,
division, officer and employee shall have those additional duties
as are directed by the Mayor, Council, or Business Administrator which
are generally consistent with their enumerated duties or which are
functions usually performed by such departments, divisions, officers
or employees.
Whenever a vacancy exists in the office of head of any division
by resignation, removal, disability or otherwise, the director of
the department may fill such vacancies temporarily by appointing an
acting head of such division, who shall have the powers and duties
and perform all the functions of such division head until the office
shall be filled permanently. Such appointment shall be for a maximum
period of 180 days, unless the Council by resolution shall extend
such period, and all such appointments shall be with the prior approval
of the Mayor.
The public, administrative and executive business offices of
the Township shall be open for the transaction of public business
daily except Saturdays and Sundays and legal holidays, between such
hours as the Mayor may prescribe with the approval of the Council,
except as otherwise provided by law. All departments in times of emergency
shall provide municipal services for 24 hours a day. The Mayor, Business
Administrator or a department head may require any officer or employee
to be in attendance for work on any day or days during such hours
as may be required whenever he determines that a public emergency
or the public interest so requires.
All officers and employees of the Township shall comply with
the following statutory requirements and prohibitions:
A. Political activity. No municipal officer or employee shall directly
or indirectly use or seek to use his authority or official influence
to control or modify the political action of another person; nor shall
any paid officer or employee, during the hours of duty, engage in
any political activity. Nothing in this section shall be construed
to prevent an elective officer from campaigning at any time.
B. Interest in contracts or jobs forbidden. No Township officer or employee
shall be interested directly or indirectly in any contract or job
for work or materials, or the profits thereof, to be furnished or
performed for this Township (N.J.S.A. 40:69A-163).
C. Acceptance of free services forbidden. No Township officer or employee
shall accept or receive, directly or indirectly, from any person operating
within the territorial limits of this Township, any business or service
upon terms more favorable than is granted to the public generally
(N.J.S.A. 40:69A-164).
D. Promise of office or employment forbidden. No candidate for office,
appointment or employment and no officer, appointee or employee in
the Township shall directly or indirectly give or promise any person
any office, position, employment, benefit or anything of value for
the purpose of influencing or obtaining the political support, aid
or vote of any person, under the penalty of being disqualified to
hold the office or employment to which he may be or may have been
elected or appointed (N.J.S.A. 40:69A-165).
