As used in this article, the following terms shall have the
meanings indicated:
BOD (BIOCHEMICAL OXYGEN DEMAND)
The quantity of oxygen utilized in the biochemical oxidation
of organic matter under standard laboratory procedure in five days
at 20° C., expressed in parts per million by weight.
BUILDING CONNECTION
Any pipe with the applicable connections and fittings used
to convey sewage from a building to the sewer extension.
BUILDING PLUMBING SYSTEM
All the plumbing work within a building or structure and
extending to a point five feet outside of and beyond such building
or structure, conveying sewage from within the building to the building
connection outside of the building.
DOMESTIC SEWAGE
The wastewater from kitchens, bathrooms, lavatories, toilets
and residential laundries and containing, in addition to the mineral
and organic matter already in the water dispensed to the community,
an imposed burden of excrement, paper, soap, dirt, food wastes (garbage),
and/or other related domestic substances.
GARBAGE
Solid wastes from the preparation, cooking and dispensing
of food and from the handling, storage and sale of produce.
HOUSE CONNECTION
That part of the sewerage system which receives the sewage
from the house plumbing system and conveys it to the nearest end of
the sewer extension, unless a sewer extension is not available, whereby
the house connection shall be extended to the nearest available Y.
No house connection shall be made to a manhole of the public sewer
system without the express written consent and special permission
of the Public Works Manager of the governing body of the Township
of Mine Hill.
HOUSE PLUMBING SYSTEM
All the plumbing work within the building and to a point
five feet outside of the building, which plumbing work conveys sewage
from within the building to the house connection outside of the building.
INDUSTRIAL WASTES
The liquid wastes from industrial processes as distinct from
sanitary sewage.
INSPECTOR
The Plumbing Subcode Official of the Township of Mine Hill,
or his authorized deputy, agent or representative. The Plumbing Subcode
Official shall be responsible for house plumbing systems and house
connections.
MAIN SEWER
The sewers laid longitudinally along the center line or other
part of the streets, easements or other rights-of-way, and which sewer
is owned and controlled by the Township of Mine Hill.
NATURAL OUTLET
Any outlet into a watercourse, pond, ditch, lake or other
body of surface water or groundwater.
PERSON
Any individual, firm, company, association, society, corporation
or group.
pH
The logarithm of the reciprocal of the weight of hydrogen
ions in grams per liter of solution.
PLUMBING SUBCODE OFFICIAL
The person or persons who have been authorized by the Township
to make the inspections of the building connections and the connections
to the sewer extension and report to the Township.
PROPERLY SHREDDED GARBAGE
The wastes from the preparation, cooking and dispensing of
food that has been shredded to such degree that all particles will
be carried freely under the flow conditions normally prevailing to
public sewers, with no particle greater than 1/2 inch in any dimension.
PUBLIC SANITARY SEWER
A sewer which carries sewage and to which stormwater, surface
water and groundwater are not intentionally admitted. Such sewers
are not individual septic systems as regulated by N.J.A.C. 7:9A.
PUBLIC WORKS MANAGER
The Public Works Manager of the Township of Mine Hill, or
his authorized deputy, agent or representative. The Public Works Manager
shall be responsible for all parts of the sewerage system except house
plumbing systems and house connections.
SEWAGE
A combination of the water-carried wastes from residences,
business buildings, institutions and industrial establishments, together
with such groundwater, surface water and stormwater as may be present.
SEWER
A pipe for carrying sewage.
SEWERAGE WORKS
All facilities for collection, pumping and disposing of sewage.
SEWER EXTENSION
That part of a sewerage system intended to accept the building
connection and lying within the bounds of the street right-of-way
line or utility easement dedicated to the Township of Mine Hill.
SEWER SYSTEM
All trunks, subtrunks, branches and other sewer appurtenances,
either publicly or privately owned, except building connections, the
sewage from which is delivered to the sewage treatment plant.
STORM SEWER or STORM DRAIN
A sewer which carries stormwater and surface water and drainage
but excludes sewage and polluted wastes.
SUSPENDED SOLIDS
Solids that either float on the surface of or are in suspension
in water, sewage or other liquids and which are removed by laboratory
filtering.
TOWNSHIP
The Township of Mine Hill, New Jersey.
WATERCOURSE
A channel in which a flow of water occurs, either continuously
or intermittently.

A. General rule for all buildings with sanitary facilities. The owners
of every building which has available an accepted public sewer at
or within the property line shall connect, at the owners' expense,
all sanitary sewage facilities to the public sewer if the shortest
distance between the property line and the sewer is less than 500
feet. The existing septic system shall be abandoned in accordance
with N.J.A.C. 7:9A-12.8.
B. Notification that sewer system is available; time allowed for application
to connect. Notification shall be given by the Township to each affected
property owner when the sanitary sewer system is available to accept
the building connection. Application for a permit to construct such
building connection shall be made within 30 days following such notification,
and construction of the building connection shall be completed, inspected
and approved within 90 days following receipt of the permit.
C. Immediate connection of buildings required in certain cases. The
owners of every building which has available an accepted public sewer
at or within the property line shall connect, at the owners' expense,
all sanitary sewage facilities to the public sewer immediately upon
the order of the Township of Mine Hill if:
(1) There is a malfunction of the existing septic system; or
(2) There is a need, for any reason, to alter or enlarge the existing
septic system, whether or not such septic system is malfunctioning.
D. Temporary exemption for certain buildings with existing septic systems.
The owners of buildings currently served by an existing functioning
septic system installed less than five years before the acceptance
of the applicable public sewer by the Township may delay connection
to the public sanitary sewer until such time as the septic system
has been in use for five years provided:
(1) The permit is obtained and the connection fee is paid (or time payments
begun) within 30 days of notification; and
(2) The septic system meets all of the current standards for individual
sewage disposal systems.
E. Hardships. Where, by reason of excessive distance between a house, building or structure and the sanitary sewer, or by reason of differences in elevation between a house, building or structure and the sanitary sewer, strict adherence to the requirements of Subsection
A above would cause unusual hardship to the owner or owners of the property involved, the Township Administrator shall have the power to alter or waive the requirements of Subsection
A upon application of the property owner involved.
F. No unauthorized person shall uncover, make any connections with or opening into or use, alter or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the Public Works Manager and such other permit as may be required by the provisions of Chapter
476, Article
II, Excavations and Openings, of this Code or by other applicable ordinances.
G. There shall be two classes of public sanitary sewer connection permits:
for residential and commercial service and for service to establishments
producing industrial wastes. In either case, the owner or his agent
shall make application on a special form provided by the Township.
The permit application shall be supplemented by any plans, specifications
or other information considered pertinent in the judgment of the Public
Works Manager. A permit and inspection fee shall be paid to the Sewer
Collector at the time the application is filed, in accordance with
the fee schedule.
H. An applicant for a public sanitary sewer connection permit for service
to establishments producing industrial wastes shall also pay a fee,
which shall be as provided for in the Fee Schedule for review of plans,
specifications and testing.
I. Where the sanitary sewer, at the date of the application for permit
to connect, has no sewer extension for the property sought to be connected,
the connection to the sewer, including the making of the cut into
the main and the installation of the line from the main to the curb,
shall be made only by Township employees or other persons duly licensed
by the Township to do such work, and all such installations and connections
shall be approved by the Public Works Manager prior to use.
J. Separate and independent house connections required. A separate and
independent house connection shall be provided for each building and
for each dwelling unit.

Customers of the Mine Hill sewer system who are required to
pay the connection fee to the Township, shall pay the connection fee
as follows:
A. Owners of existing residential or nonresidential buildings served
by individual sewage disposal systems which are being connected to
the sewer system shall pay the full fee when the application to connect
to the sewer system is filed.
B. Owners of new residential or nonresidential buildings shall pay 50%
of the connection fee prior to the issuance of a building permit and
the remaining 50% before the issuance of a certificate of occupancy.
The connection of the house connection to the main sewer shall
be made at the sewer extension at the curbline, or, if no sewer extension
exists, connection shall be made at the nearest available Y connection
on the main sewer. The Public Works Manager, in accordance with Figure
12.5.0, Saddle Connection, and Figure 12.5.8.2, will designate the
position of the end of the sewer extension at the curbline or the
Y connection on the main sewer, whichever is appropriate. If it becomes
necessary to cut into the main sewer, since no other source of connection
is available, then such connection shall be made as directed by and
under the supervision of the Public Works Manager. The dead ends of
all pipes not immediately connected with the house plumbing system
must be securely closed by a watertight cover of imperishable material.
Prior to any connection to the sewer extension or to the main sewer,
the Public Works Manager must be given at least 48 hours' notice in
advance so that he may supervise such work. If the Public Works Manager
has not been given such notice, he may require the completed work
to be uncovered for examination at the owner's own expense.
Before any portion of the existing plumbing system outside of
the building is connected to the house connection, the owner shall
prove, to the satisfaction of the Plumbing Subcode Official, that
it is clean and conforms in every respect to these rules and regulations
and any amendments and supplements thereto.
All work on house connections shall be made by either the owner
of the premises personally doing the work or by a plumber licensed
by the Township of Mine Hill, and all of said work shall be approved
by the Plumbing Subcode Official of the Township; provided, however,
that any connections to or opening into a main sewer must be made
by a plumber licensed by the Department of Community Affairs, and
said work must be approved by the Plumbing Subcode Official of the
Township.
The Public Works Manager or Plumbing Subcode Official may apply
any appropriate test to the pipes, and the plumber and contractor,
at his own expense, shall furnish all necessary tools, labor, materials
and assistants for such tests and shall remove any defective materials
when so ordered by the Public Works Manager or Plumbing Subcode Official.
Each contractor or other person performing work on Township public property for the purpose of installing house connections shall post a bond, acceptable to the Township, in accordance with the provisions of Chapter
476, Article
II, Excavations and Openings, and any other applicable ordinance of the Township. All work shall be adequately guarded with barricades, lights and other measures for protection to the public from hazard. Streets, sidewalks, curbs and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the Township.
The owner of any property served by a building sewer carrying
industrial wastes shall install a suitable control manhole in the
building sewer to facilitate observation, sampling and measurement
of the wastes. Such manhole shall be accessibly and safely located
and shall be constructed in accordance with plans approved by the
Public Works Manager. The manhole shall be installed by the owner
at his expense and shall be maintained by him so as to be safe and
accessible at all times.
All measurements, tests and analyses of the characteristics of waters and wastes to which reference is made in §§
425-25B and
425-27A and
B shall be determined in accordance with Standard Methods for the Examination of Water and Wastewater, published by the American Public Health Association, 1960 Edition, and all subsequent revised editions and amendments and supplements thereto, and shall be determined at the control manhole provided for in §
425-28 above, or upon suitable samples taken at said control manhole. The cost and expense incident to the measurements, tests and analyses shall be borne by the owner.
No statements contained in this article shall be construed as
preventing any special agreement between the Township and any industrial
concern whereby an industrial waste of unusual strength or character
may be accepted by the Township for treatment, subject to payment
therefor by the industrial concern.
No person shall maliciously, willfully or negligently break,
damage, destroy, uncover, deface or tamper with any structure, appurtenance
or equipment which is part of the Township's sewerage works.
The Public Works Manager or Plumbing Subcode Official and other
duly authorized employees of the Township, bearing proper credentials
and identification, shall be permitted to enter upon all properties
for the purpose of inspections, observation, measurement, sampling
and testing in accordance with the provisions of this article.
Any person who shall violate any of the regulatory provisions of this article shall, upon conviction, be subject to the penalty in §
1-3, General penalty, of the Code of the Township of Mine Hill, and each violation of any of the provisions of this article and each day the same is violated may be deemed and taken to be a separate and distinct offense.
