This article is adopted pursuant to the provisions of the Municipal Home Rule Law of the State of New York.
The Valley Central School District under the authority of § 1670 of the New York State Vehicle and Traffic Law has determined that parking of vehicles should be prevented from certain areas of the school district property and has indicated these areas to the public through the posting of signage and other pavement markings. Further the school district has informed the Town of Montgomery of a continuing problem with persons visiting and using the school district property ignoring the posted no parking areas.
The Town Board determines that the continuing practice of violations of the no parking restrictions as designated by the school district presents a threat to public health, welfare and safety wherein parking in such designated areas can hamper or prevent access by emergency service vehicles, delay response times for emergency services and potentially cause injury to emergency response personnel as well as employees, students and visitors to the school district properties.
In order to address the public safety concern identified above, the Town Board of the Town of Montgomery hereby authorizes the Town of Montgomery Police Department, as well as any other police agency empowered with the enforcement of the New York State Vehicle and Traffic Law, to enforce the parking restrictions on the property of the Valley Central School District.
