Any person, firm or corporation proposing to construct any street
improvement within the City of Weston shall apply to the Director
of Public Works for approval of the location, dimensions, design and
construction methods and materials of such street; said application
shall be in writing or plans submitted for approval and shall contain
such information including maps, plats, diagrams, detailed drawings
and specifications as the Director of Public Works may require. Plans
and specifications shall be prepared by a professional engineer licensed
to practice in the State of Missouri.

All streets constructed within the City of Weston shall be in
accordance with the following minimum design standards and specifications
for construction of streets.

Minimum requirements for the design and construction of local
residential streets shall be in accordance with the provisions herein
and with the Minimum Design Standards on file in the office of the
Director of Public Works.

Minimum requirements for other than local residential streets
shall be in accordance with the provisions herein and with requirements
for paving width, paving type, paving thickness, curb or curb and
gutter, and other details as may be approved by the Director of Public
Works.

A. All
work and materials shall conform to the specifications herein and
to portions of the following standard specifications as specifically
set forth herein, said portions being incorporated herein by reference:
1. Street Specifications and Standards, 1996, Kansas City Chapter
of the American Public Works Association. These specifications
and standards will be hereinafter referred to as APWA Street Spec.

A. Time Of Inspections. During the construction of all roads,
streets and alleys under the jurisdiction of the City, six (6) inspections
shall be made by the Director of Public Works:
1. One (1) inspection shall be made during the subgrading;
2. One (1) inspection shall be made prior to installation of curbs;
3. Curb inspection prior to placing of concrete in curbs;
4. One (1) inspection of the subgrade prior to placing base or concrete;
5. One (1) inspection shall be made upon final installation, manipulation
and compaction of the base.
6. Final inspection shall be made upon completion of the project, including
surfacing, backfilling and cleanup.
B. Approval. Other inspections may be made as deemed necessary
by the Director of Public Works.
1. Approval of the work by the Director of Public Works at either of
the first three (3) inspections shall give the contractor the right
to proceed with the next succeeding operation, but shall in no way
indicate complete approval of prior work if later inspection discloses
any deficiency in the first (1st) inspections.
2. These approvals will be secured by notifying the Director of Public
Works in ample time, but in no case less than forty-eight (48) hours,
to allow inspection of each phase. On the final acceptance inspection
of a completed street or sidewalk, Director of Public Works may require
a certificate of compliance as specified above.

A. The
contractor shall furnish a performance bond to the City of Weston
in the full amount of the contract, executed by a surety, guaranteeing
the work against faulty workmanship and faulty materials for a period
of two (2) years after the date of completion and acceptance.
B. Within
the two (2) year period, the contractor as ordered by the Director
of Public Works shall repair, replace or rebuild such portions of
the work which are found to be faulty because of materials or workmanship.
The contractor shall begin the remedial work not later than five (5)
days after the order from the Director of Public Works. In case the
contractor does not start the remedial work within the above time
limit or in case of an emergency condition caused by faulty work,
the City may take remedial action and charge the cost thereof against
the contractor and his/her surety.

If the Director of Public Works shall find that any such proposed
streets will conform to the accepted standards, he/she shall issue
his/her approval in writing or sign approval of submitted plans. Otherwise,
he/she shall disapprove such street construction in writing.
