This Part 2 shall be known and may be cited as "The Regulation of Drainage Pipes for Driveways Ordinance of Logan Township."

The following words and phrases when used in this Part 2 shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
PERSON
Any association, firm, partnership, corporation or any other entity, as well as, a natural person male or female. The singular shall include the plural.
TOWNSHIP COORDINATOR
The person authorized and empowered by the Logan Township Board of Supervisors to issue permits designating the type of pipe required and to oversee the enforcement of this Part 2.

It is hereby ordained that from and after the effective date of this Part 2 it shall be unlawful for any person to install, cause to be installed or permit the installation of driveways over Township culverts, ditches and drains without first securing a permit from the Township Coordinator; and it shall be unlawful for any person to install, cause to be installed or permit the installation of any driveway not in accordance with the specifications hereinafter set forth.

1. 
It shall be mandatory for anyone installing a driveway over a drain, culvert or ditch on a Logan Township right of way to use as a drain through said driveways, pipes constructed of one of the following materials:
A. 
Steel of such gauge or strength as to withstand the maximum weight of vehicles traveling said driveway; or
B. 
Concrete, of such gauge or strength as to withstand the maximum weight of vehicles traveling said driveway; or
C. 
Heavy Duty Corrugated Polyethylene Pipe, manufactured by Advanced Drainage Systems, (ADS) Inc.
Provided, that if ADS Heavy Duty Corrugated Polyethylene Pipe is used in a driveway over which vehicles will travel, then in such case the ADS Heavy Duty Corrugated Polyethylene Pipe must be covered with at least 12 inches of fill. Said fill may consist of crushed stone, gravel or compacted soil.
Provided further, that if ADS Heavy Duty Corrugated Polyethylene Pipe is used in a ditch, culvert or drain, over which no vehicles will be traveling, then no fill shall be required.
2. 
It is hereby directly prohibited for any person to use new or used water tanks with the ends cut out for the purpose as a drain through any driveway.

The Township Coordinator, upon application of any person desiring to install a drainage ditch, culvert or drain on a Logan Township right of way, shall issue a written permit designating the size and type of pipe to be used for said ditch so as to insure proper and actual flow of water in the said ditch, and to insure the pipe will withstand the weight of vehicles traveling over such drive.

1. 
Enforcement. Any police officer and/or other person authorized by the Board of Supervisors may enforce the provisions of this Part.
2. 
Penalty. Any person who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not less than $100 and not more than $1,000 plus the cost of prosecution, and/or be sentenced to imprisonment for a term not to exceed 90 days. Every day that a violation of this Part continues shall constitute a separate and distinct offense which shall be subject to the aforesaid penalties.
