Borough Council may from time to time amend the provisions of
this chapter or the locations and boundaries of the zoning districts
shown on the Zoning Map. Before Council takes official action on a
proposed amendment:
A. Council shall hold a public hearing on the proposed amendment.
B. In order to provide the Mifflin County Planning Commission with an
opportunity to make and submit recommendations with respect to the
proposed amendment, Council or the Borough Planning Commission (whichever
has prepared the proposed amendment) shall submit the proposed amendment
to the Mifflin County Planning Commission not less than 30 days prior
to the date on which Council plans to hold the public hearing on the
proposed amendment and not less than 45 days prior to the date on
which Council plans to take official action on the proposed amendment.
C. In the case that the proposed amendment was not one prepared by the
Borough Planning Commission, then in order to provide the Borough
Planning Commission with an opportunity to make and submit recommendations
with respect to the proposed amendment, Council shall submit the proposed
amendment to the Borough Planning Commission not less than 30 days
prior to the date on which Council plans to hold the public hearing
on the proposed amendment. The recommendations, if any, made by the
Borough Planning Commission shall be submitted in writing to Council
by not later than the time fixed for the public hearing.
[Amended 3-24-1986 by Ord. No. 86-2]
Notice of the time and place of the public hearing on the proposed
amendment (containing either the full text of the proposed amendment
or a summary setting forth in reasonable detail the principal provisions
of the proposed amendment and a reference to the place within the
Borough where copies of the proposed amendment may be examined) shall
be published in a daily newspaper of general circulation within the
Borough once each week for two consecutive weeks with intervals of
at least five calendar days between each publication. The first publication
shall appear not more than 30 days and not less than 14 days before
the date of the public hearing.
[Amended 11-15-1983 by Ord. No. 83-5]
If after a public hearing on the proposed amendment the proposed amendment is revised to include land previously not affected by it (or if proposed amendment is otherwise substantially revised), Council shall hold another public hearing on the proposed amendment as so revised before taking official action. Notice of that public hearing shall be published as and shall contain the information prescribed by §
240-68.
