As used in this chapter, the following terms shall have the meanings indicated:
MOTOR VEHICLE SERVICE DEVICE
Any tank, pump or other device or fixture for dispensing gasoline, oil or other motor fuel, or water or air, for use by motor vehicles.
PERSON
Any individual, partnership, firm, association, organization, corporation, government agency, or other entity.
From and after September 22, 1972, it shall be unlawful for any person to construct, erect or locate any motor vehicle service device upon any sidewalk or curb in the Borough of Lewistown or upon any other location from which vehicles might be served while standing or parked upon any street or alley in the Borough, provided that any such device lawfully located prior to September 22, 1972, may continue to be used and maintained, but every such device shall be removed whenever its use shall be discontinued. If and when it shall be necessary to replace such device, the device taking the place thereof shall not be placed or located in any location where a new device would be prohibited under this § 152-2.

Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not more than $300 and/or to imprisonment for a term not to exceed 90 days. Every day that a violation of this chapter continues shall constitute a separate offense.
