A Planning and Zoning Commission is hereby established.

A. The Planning and Zoning Commission shall consist of at least seven
(7) and no more than nine (9) members as provided herein.
B. The members shall include:
1.
The Mayor, if the Mayor chooses to be a member;
2.
A Council member selected by the Council, if the Council chooses
to have a member serve on the Commission; and
3.
At least five (5) but not more than seven (7) citizen members.
C. The Mayor and the Council shall determine their own membership on
the Commission, and the number of citizen members to be appointed
to the Council shall depend on the determinations of the Mayor and
Council as to their own membership. i.e., if both the Mayor and a
Council member serve on the Commission, five (5) citizens shall be
appointed. If only one (1) serves, six (6) citizens shall be appointed.
If neither serves, seven (7) citizens shall be appointed.
D. The citizen members of the Commission shall be appointed by the Mayor
with the approval of the City Council. Every appointee shall be a
registered voter and have been a resident of the City for not less
than one (1) year preceding the date of appointment.
E. All members of the Commission shall serve without compensation. The
term of each member shall be for four (4) years. Any vacancy in a
membership shall be filled for the unexpired term by appointment as
aforesaid. All members reappointed shall have their terms extended
by four (4) years.
F. Any member of the Commission may be removed by a majority of the
City Council at any time, for cause stated in writing and after a
public hearing held not less than seven (7) days from such notice
and a decision rendered within seven (7) days of the hearing.

A. The
Planning and Zoning Commission shall have the necessary power and
authority and is hereby authorized to:
1. Adopt and promulgate rules, regulations and procedures not inconsistent
with the law and ordinances of the City, for the operation of the
Commission and carrying out of the provisions of this Chapter.
2. Have general supervision of the enforcement of any zoning ordinances
enacted by the City Council.
3. Prepare a zoning plan for the City which shall conform to the provisions
of Sections 89.110 through 89.144, RSMo., and Sections 89.300 through
89.490, RSMo., as now amended, or shall hereafter be revised or amended,
and which shall include recommendations to the City Council relating
to, among other things:
a. The height, number of stories and size of the buildings and other
structures within the City.
b. The percentage of lots that may be occupied within the City.
c. The size of yards, courts and other open spaces within the City.
d. The density of population within the City.
e. The preservation of features of historical significance within the
City.
f. Location and use of buildings, structures and land for trade, industry,
residence or other purposes within the City.
g. The division of the City into districts and the regulation of erection,
construction, reconstruction, alterations of use of buildings, structures
or land therein.

A. The
duties of the Planning and Zoning Commission shall be as follows:
1. Make recommendations to the Mayor and the City Council related to:
a. The location, length, width, naming or arrangement of any street,
boulevard, highway, alley, waterway, bridge, viaduct, park, playground
or other place or improvement.
b. The platting of public property into lots, plots, streets, boulevards,
highways, waterways, alleys, transportation or other channels for
communication of any kind.
c. The design, location and grouping of public buildings.
d. The design and location of power and lighting plants.
e. The design and location of memorials and works of art.
f. The design and location of street lighting standards.
g. The location of communication and power pole lines, above or below
ground.
h. The design and location of billboards or projection signs.
i. Adoption and promulgation of rules, regulation, procedures and minimum
standards for the subdivision of land within the City.
2. Hear all applications and hold public hearings of special use permits,
planned commercial districts and any other change of zoning, and forward
such applications to the Mayor and the City Council with its recommendations.
The Commission shall, within forty-five (45) days from the date on
which such application is referred, render a full report to the Mayor
and the City Council regarding its findings and recommendations. A
majority of the City Council may extend the period of time in which
the report is to be submitted upon written request from the Chairman
of the Planning and Zoning Commission.
3. Make recommendations to the Mayor and the City Council on amendments,
modifications or revisions of the Zoning Code.
4. Perform such other duties as may be provided by law, ordinance or
resolution of the City Council.
B. The
recommendation of the Commission shall not be binding on the City
Council which may approve or disapprove the Commission's findings
and recommendations, except in case of an adverse report by the Commission,
such shall not become effective except by a favorable vote of three-fourths
(¾) of all of the members of the City Council; however no zoning
ordinance or any modifications, amendment or revision thereof shall
be considered by the City Council until and unless the same shall
have first submitted to the Commission for its examination and recommendation
thereof.
C. The
Commission shall hold scheduled meetings as deemed necessary by the
City staff and all such meetings shall be public meetings.

All plats of proposed subdivisions shall, before being approved
by the City Council, be submitted to the Planning and Zoning Commission
for consideration and recommendation thereon.
