It is the purpose and intent of this article to promote the health, safety and welfare of the inhabitants of the Town of Newfane by regulating the installation of culverts in roadside ditches for driveway and other purposes and by regulating the installation of drainage tile in lands serviced by drainage ditches maintained by the Town of Newfane to protect roadways, roadbeds and drainage ditches maintained by the Town of Newfane.
Any proposed installation of culverts in roadside ditches for driveway or any other purpose or the replacement of any existing such culverts in roadside ditches shall be in compliance with the specifications and requirements of the Town of Newfane Superintendent of Highways, and approval of plans and specifications shall be obtained from the Superintendent of Highways prior to the commencement of installation.
Any proposed installation of drainage tiles in lands serviced by drainage ditches maintained by the Town of Newfane or which will impact on drainage ditches maintained by the Town of Newfane or the replacement of any existing such drainage tile shall be in compliance with the specifications and requirements of the Town of Newfane Superintendent of Highways, and approval of plans and specifications shall be obtained from the Superintendent of Highways prior to the commencement of installation.
Any violation of this article shall be punishable by a fine not to exceed $250 per violation. Each week of a continued violation shall constitute a separate additional violation.
