For the purposes of this Article, the following terms shall be deemed to have the meaning indicated below:
BULKY RUBBISH
Non-putrescible solid wastes consisting of combustible and/or non-combustible waste materials from dwelling units, commercial, industrial, institutional or agricultural establishments which are either too large or too heavy to be safely and conveniently loaded in solid waste transportation vehicles by solid waste collectors with the equipment available therefor.
CITY
The City of St. Ann, Missouri.
DEMOLITION AND CONSTRUCTION WASTE
Waste materials from the construction and demolition of residential, industrial, or commercial structures, but shall not include materials defined as clean fill under Section 260.200, RSMo.
DIRECTOR
The Mayor of the City or his or her authorized representative who shall direct, supervise and control the City's solid waste management program as established by this Article.
DWELLING UNIT
Any room or group of rooms located within a structure and forming a single habitable unit with facilities which are used, are intended to be used, for living, sleeping, cooking and eating.
GARBAGE
Putrescible animal or vegetable wastes resulting from the handling, preparation, cooking, serving or consumption of food.
HAZARDOUS WASTES
Any waste or combination of wastes, as determined by the commission by rules and regulations, which, because of its quantity, concentration, or physical, chemical or infectious characteristics, may cause or significantly contribute to an increase in mortality or an increase in serious irreversible, or incapacitating reversible, illness, or pose a present or potential threat to the health of humans or the environment.
MULTIPLE HOUSING FACILITY
A housing facility containing more that two (2) dwelling units under one (1) roof.
OCCUPANT
Any person who, alone or jointly or severally with others, shall be in actual possession of any dwelling unit or of any other improved real property, either as owner or as a tenant.
OWNER
Any person who, alone or jointly or severally with others, shall own any dwelling unit or of any other improved real property.
PERSON
Any individual, partnership, co-partnership, firm, company, corporation, association, joint stock company, trust, estate, political subdivision or organization of any kind, or their legal representative agent or assigns.
PROCESSING
Incinerating, composting, baling, shredding, salvaging, compacting and other processes whereby solid waste characteristics are modified or solid waste quantity is reduced.
SOLID WASTE
Garbage, refuse and other discarded materials including, but not limited to, solid and semisolid waste materials resulting from industrial, commercial, agricultural, governmental and domestic activities, but does not include hazardous waste as defined in Sections 260.360 to 260.432, RSMo., recovered materials, post-use polymers, recovered feedstocks, overburden, rock, tailings, matte, slag or other waste material resulting from mining, milling or smelting.

COMMERCIAL SOLID WASTESolid waste resulting from the operation of any commercial, industrial, institutional or agricultural establishment and multiple housing facilities with more than two (2) dwelling units.
2. 
RESIDENTIAL SOLID WASTESolid waste resulting from the maintenance and operation of dwelling units, excluding multiple housing facilities with more than two (2) dwelling units.
SOLID WASTE CONTAINER
Receptacle used by any person to store solid waste during the interval between solid waste collections.
SOLID WASTE DISPOSAL
The process of discarding or getting rid of unwanted material. In particular the final disposition of solid waste by man.
SOLID WASTE MANAGEMENT
The entire solid waste system of storage, collection, transportation, processing and disposal.
STORAGE
Keeping, maintaining or sorting solid waste from the time of its production until the time of its collection.
TRANSPORTATION
The transporting of solid waste from the place of collection or processing to a solid waste processing facility or solid waste disposal area.

A. 
The Director shall be responsible for the collection, removal and final disposal of all solid waste generated within the City as provided herein.
B. 
The Director may make, amend, revoke and enforce reasonable and necessary rules and regulations consistent with this Article governing the collection, removal and final disposal of all solid waste, including, but not limited to, the following:
1. 
Specifications for solid waste containers, including the type, composition, equipment, size and shape thereof;
2. 
Identification of solid waste containers and of the covers thereof, and of equipment thereto appertaining, if any;
3. 
Weight limitations on the combined weight of solid waste container and the contents thereof, and weight and size limitations on bundles of solid waste too large for solid waste containers;
4. 
Storage of solid waste in solid waste containers;
5. 
Sanitation, maintenance and replacement of solid waste containers;
6. 
Billing and collection of solid waste collection fees;
7. 
Schedules of and routes for collection and transportation of solid waste;
8. 
Collection points of solid waste containers;
9. 
Collection, transportation, processing and disposal of solid waste;
10. 
Processing facilities and fees for the use thereof;
11. 
Disposal facilities and fees for the use thereof;
12. 
Record of quantity and type of wastes received at processing and/or disposal facilities;
13. 
Handling of special wastes such as toxic wastes, sludges, ashes, agriculture, construction, bulky items, tires, automobiles, oils, greases, etc.; and
14. 
Any other matter reasonable for and necessary to the implementation and enforcement of this Article.
C. 
When authorized by the Board of Aldermen, the Director may provide for the collection, removal and final disposal of solid waste by contract with an appropriate service provider, for the entire City or portions thereof, and any such contract may be exclusive to the selected service provider.
D. 
The owner and occupant of any property served or benefited by the City's solid waste collection shall be responsible for the orderly and sanitary accumulation and storage of solid waste pending its collection as provided herein, and said owner and occupant shall be further responsible for complying with the provisions of this Article and all regulations lawfully issued by the Director.
E. 
Any person violating any of the provisions of this Article, or any lawful regulations promulgated pursuant thereto, upon conviction, shall be punished as set forth in Section 100.220 of this Code.
F. 
The City and its representatives and contractors are hereby authorized to enter upon private property for the collection of solid waste as provided herein and for the enforcement of this Article.
G. 
The owner of any property located within the City, that is required to have solid waste collection services pursuant to any provision of the City's Code or regulation adopted by the City, shall be responsible for ensuring that such services are procured and that any fees charged for such services are paid. It shall be a violation of this Article for a property owner to fail to procure and pay the fees charged for such services when they are required.

A. 
The occupant or owner of every dwelling unit and of every institutional, commercial or business, industrial or agricultural establishment producing solid waste within the limits of the City shall provide sufficient and adequate containers for the storage of all solid waste, except bulky rubbish and demolition and construction waste, to serve each such dwelling unit or establishment and shall maintain such solid waste containers at all times in good repair.
B. 
The occupant or owner of every dwelling unit and of every institutional, commercial, industrial, agricultural or business establishment shall place all solid waste to be collected in proper solid waste containers, except as otherwise provided herein, and shall maintain such solid waste containers and the area surrounding them in a clean, neat and sanitary condition at all times.
C. 
The Director shall promulgate regulations governing solid waste containers and the storage of solid waste to ensure that its storage and collection is performed in an orderly, clean, sanitary and safe manner.
1. 
Residential solid waste containers shall be of a type originally manufactured for residential solid waste and constructed of galvanized metal, rubber, fiberglass, plastic or similar durable material. Containers shall be waterproof, leakproof and equipped with fly-tight lids and suitable handles. Containers shall be covered at all times except when depositing or removing waste.
2. 
Bags may be used for the storage of grass cuttings and leaves.
3. 
Collectable items of bulky rubbish and yard waste that are too large for storage in the standard containers may be stored as provided by the Director's regulation.
4. 
Industrial solid waste containers shall be rodent-resistant, shall be stored on a concrete base and enclosed on each side by a fence and gate with fifty percent (50%) air space, or by a masonry enclosure with a brick or brick veneer finish and gate, which effectively shields such container from view. Containers shall be waterproof, leakproof and covered at all times except when depositing or removing waste.
5. 
If the solid waste of a particular facility cannot be stored satisfactorily and efficiently in the prescribed containers, the owner or occupant shall furnish a tank-type container or containers of a size and number sufficient to contain refuse between collections, and each such container shall be maintained in a hygienic and satisfactory condition. Such special containers may be used only on a temporary basis and only with written approval of the City.
6. 
Large items of rubbish which qualify for pickup on a special pickup day may be stored on the outside of the premises concerned without placement into containers provided that the number of such items is reasonable, and provided further, that such storage shall not provide conditions which tend to create a sanitary problem or a hazard to the public health, welfare or safety.
D. 
Solid waste containers, bags, bundles or other collectable items shall be stored within a building or behind the building line except when being placed for collection. Solid waste containers, bags, bundles, or other collectable items shall not be placed for collection on any public right-of-way earlier than 5:00 P.M. the night before collection day and shall be removed from the public right-of-way no later than 8:00 P.M. the day of collection.

A. 
Schedules and regulations for the collection of solid waste, including garbage, yard waste and bulky rubbish, shall be established by the Director and may be amended from time to time; provided, however, that collections shall not occur before 6:00 A.M. or after 7:00 P.M. or on Sundays.
B. 
The City's solid waste collectors shall be responsible for the collection of solid waste from the point of collection to the transportation vehicle, provided the solid waste was stored in compliance with Section 225.030 hereof. Any spillage or blowing litter caused as a result of the duties of the solid waste collector shall be collected and placed in the transportation vehicle by the solid waste collector.
C. 
The Director shall ensure that all solid waste collectors shall be authorized by the City, licensed by the State of Missouri, insured, and in compliance with all regulations promulgated by the City and the State of Missouri applicable to solid waste management contractors.
D. 
All solid waste for which collection services are provided by the City shall be collected at the times and in the manner prescribed by the Director's regulations.

A. 
All transportation vehicles shall be maintained in a safe, clean and sanitary condition and shall be so constructed, maintained and operated as to prevent spillage of solid waste therefrom. All vehicles to be used for transportation of solid waste shall be constructed with watertight bodies and with covers which shall be an integral part of the vehicle or shall be a separate cover of suitable material with fasteners designed to secure all sides of the cover to the vehicle and shall be secured whenever the vehicle is transporting solid waste or, as an alternate, the entire bodies thereof shall be enclosed, with only loading hoppers exposed. No solid waste shall be transported in the loading hoppers.
B. 
Solid wastes shall be deposited at a processing facility or disposal area approved by the City and complying with all requirements of the Missouri Solid Waste Management Law, Sections 260.200 to 260.245, RSMo., and the rules and regulations adopted thereunder. The Director may designate the processing or disposal facility to be utilized.

A. 
It shall be unlawful for any owner, occupant or other person to:
1. 
Deposit or dispose of solid waste in any solid waste container other than his or her own container;
2. 
Fail to have solid waste collected as provided in this Article;
3. 
Fail to pay solid waste collection fees;
4. 
Allow the accumulation or storage of solid waste in the City's rights-of-way or on any place or in any manner not allowed by this Article or by Missouri law or regulation;
5. 
Transport solid waste either within or outside of the City (unless employed by the City or authorized by contract to do so);
6. 
Interfere in any manner with solid waste collection and transportation equipment or with the City's solid waste collectors or contractors in the lawful performance of their duties as such;
7. 
Burn solid waste or dispose of or discharge solid waste onto another's property, including the City, or into any lake, stream, or stormwater or sanitary sewer system;
8. 
Dispose of solid waste at any facility or location which is not approved by the City and Missouri Department of Natural Resources;
9. 
Engage in the business of collecting, transporting, processing or disposing of solid waste within the corporate limits of the City without the City's authorization or in violation of any provision of this Article or any State or local law or regulation;
10. 
Violate any of the provisions of this Article or any rule or regulation promulgated by the Director under the authority of Section 225.020(B).
