This article is adopted pursuant to § 61.34, Wis.
Stats., and other applicable Wisconsin Statutes.
As used in this article, the following terms shall have the
meanings indicated:
AGENT OF THE VILLAGE
Person(s) or agency, public or private, designated to act
on behalf of and with the authority of the Village of Sherwood.
FISHING
Any activity associated with the intent to catch fish by
any method.
FISHING SHELTER
A shelter used during the ice fishing season for protection
from weather elements.
MUNICIPALLY OWNED RECREATION TRAIL
Any recreation trail (path) owned by the Village of Sherwood
that is part of the Village trail system and used for the purpose
of general recreation by the public.
MUNICIPALLY OWNED STORMWATER FACILITY (POND)
Any stormwater facility owned by the Village of Sherwood
and used for the purpose of stormwater management to benefit the public.
The current listing of Village-owned ponds is: State Park Estate Ponds
(two); Mustang Pond; Miller Ponds (two); Meadowcliff Pond; and Nuthatch
Pond. (Note: The number of ponds may increase over time.)
SWIMMING and SWIMMING-RELATED ACTIVITIES
A person entering any Village-owned stormwater facility in
direct contact with pond water(s), without the aid of a watercraft,
for the purpose of water recreation.
TRAIL SYSTEM
An adopted Village of Sherwood map of owned, eased or dedicated
land(s) supported and maintained by the Village that constitutes a
cohesive recreation trail for usage by the general public.
VEHICLE
Any mode of transportation using any type of engine for propulsion.
This article shall apply to all users engaging in fishing on
a Village-owned stormwater facility (pond), users of the Village-owned
trail system, and persons contemplating using these facilities for
swimming purposes.
Swimming and swimming-related activities are not allowed in
the ponds.
The Village Administrator and any Village agent duly authorized
by the Village Board shall be empowered to act as enforcement agents,
including its choice of law enforcement agency (e.g., Calumet County
Sheriff's Department). It is recognized that State of Wisconsin Department
of Natural Resources personnel are the lawful enforcement agents regarding
fishing matters, not Village staff or local law enforcement.
A person(s) found violating this article shall be punishable as prescribed in Chapter
40, Fees and Penalties, of this Code.
A person cited for violation of this article may appeal to the
proper jurisdictional authority for redress of his grievance, e.g.,
local court or State of Wisconsin.
