A.
Purpose and intent. The Board of Trustees finds that the use of skateboards, in-line skates and roller skates in certain locations poses a significant threat to the health and safety of the community and especially to children, whose age and inexperience make them particularly vulnerable to the risks associated with these activities. It is, therefore, the intention of the Board of Trustees to exercise its authority pursuant to Article IX of the New York State Constitution and § 10 of the Municipal Home Rule Law to protect and safeguard the lives and well-being of the community, especially minors, by regulating the use of skateboards, in-line skates and roller skates in certain locations.

Definitions. The terms "in-line skates," "roller skates," and "skateboard" shall have those meanings set forth in § 388-9.

Unlawful activities.

Notwithstanding anything to the contrary herein, every person operating a skateboard, in-line skates or roller skates, where permitted, shall operate the same in strict observance of Article 34 of the New York State Vehicular and Traffic Law relating to the operation of bicycles and play vehicles, except as to those provisions which by their nature can have no application.

Penalties for offenses. Any person violating any provision of this section shall be guilty of a violation and upon conviction thereof shall be subject to a mandatory minimum fine of $100 for each offense.
