There is hereby created within the Borough of Buena the position
of Certified Animal Control Officer and the position of Municipal
Humane Law Enforcement Officer, which positions may be concurrent.
The Mayor of the Borough shall appoint a Certified Animal Control
Officer and a Municipal Humane Law Enforcement Officer, each for a
term of one year with the advice and consent of Council, or the Council
may award a contract for the services. The person or agency appointed
as the Certified Animal Control Officer is hereby authorized to license
dogs and other animals and the Municipal Law Enforcement Officer is
hereby authorized to investigate and sign complaints alleging violations
of animal cruelty law and arrest violators, and otherwise act as an
officer, with respect to people who violate state laws and municipal
ordinances regarding animal cruelty.
As used in this chapter, the following terms shall have the
meanings indicated:
CAT
Any member of the domestic feline species, male, female or
altered.
CERTIFIED ANIMAL CONTROL OFFICER
Any person or agency certified by the State of New Jersey
as defined pursuant to N.J.S.A. 4:19-15.16, as amended.

DOG
Any dog, bitch or spayed bitch.
DOG OF LICENSING AGE
Any dog which has attained the age of seven months or which
possesses a set of permanent teeth.
DOMESTIC ANIMALS
Any of various animals (including livestock) domesticated
by man so as to live and breed in a tame condition.
KENNEL
Any establishment wherein or whereon the business of boarding
or selling dogs or breeding dogs for sale is carried on, except a
pet shop.

NEUTERED
Rendered permanently incapable of reproduction as certified
by a licensed veterinarian.
OWNER
When applied to the proprietorship of any dog, cat or other
animal, includes every person having a right (or custody) in such
an animal and every person who has such an animal in his or her keeping
or who harbors or maintains an animal or knowingly permits such an
animal to remain on or about any premises occupied by that person
or who feeds such an animal on a regular basis.
PERSON
Any individual, corporation, partnership, organization or
institution commonly recognized by law as a unit.
PET SHOP
Any place of business which is not part of a kennel, wherein
animals, including, but not limited to, dogs, cats, birds, fish, reptiles,
rabbits, hamsters or gerbils, are kept or displayed chiefly for the
purpose of sale to individuals for personal appreciation and companionship
rather than for business or research purposes.

POUND
Any establishment for the confinement of dogs or other animals
seized either under the provisions of this chapter or otherwise.

SHELTER
An establishment where dogs are received, housed and distributed.
