In the event of a violation of any of the provisions of this article
or of any of the provisions of the applicable state statute, the Certified
Animal Control Officer may cite the violator by issuing a summons
in lieu of complaint. Regardless of whether the violation is by summons
or by formal complaint, the Municipal Court of the Borough of Buena
shall, pursuant to the provisions of the statute, hear and decide
all such charges of violation in a summary manner. In the event that
the person so charged is found to be guilty of the violation, a civil
judgment shall be entered as provided by statute, and the amount of
said judgment shall be recovered in the name of the Borough of Buena.
In the event that a person convicted of a violation of any of the
provisions of this article or of the applicable state law refuses
or neglects to pay forthwith the judgment rendered against him and
the costs and charges incident thereto, such person shall be committed
to the county jail for a period not exceeding 10 days in the case
of a first conviction and, in the case of a conviction for a second,
subsequent or continuing violation, for a period not exceeding 30
days.
