A. The Mayor
shall appoint a Municipal Solicitor, with the advice and consent of
the Borough Council, who shall be an attorney at law of the State
of New Jersey, in good standing, to hold office for a period of one
year or until a successor is named and appointed. The Solicitor shall
have actively practiced law in the State of New Jersey for a minimum
of 10 years with experience in representing government entities.
B. The Mayor
may appoint an Assistant Municipal Solicitor, with the advice and
consent of the Borough Council, who shall be an attorney at law of
the State of New Jersey, in good standing, to hold office for a period
of one year or until a successor is named and appointed. The Assistant
Solicitor shall have actively practiced law in the State of New Jersey
for a minimum of 10 years with experience in representing government
entities.

A. The Solicitor shall have the power and authority to assign and delegate
such legal matters to the Assistant Solicitor to assure the proper
representation of the Borough, Mayor and Council.
B. The Solicitor shall supervise all of the services provided by the
Assistant Solicitor, and the Assistant Solicitor shall provide the
Solicitor reports of their services on behalf of the Borough.
C. The Assistant Solicitor shall meet with Council and the Mayor and
attend all meetings of Council and all employees of the Borough upon
request.
D. The Solicitor shall furnish legal advice to the Mayor and Council
and all officers, departments, boards and commissions concerning any
matter arising out of the exercise of their official powers or performance
of their official duties.
E. The Solicitor shall prosecute and defend all legal matters or proceedings
in any court in which the Borough or any officer thereof is interested
as a party when so ordered by Council or the Mayor.
F. As directed
by the Mayor or Council, the Solicitor shall take such steps as may
be reasonably necessary to prosecute and enforce all Borough ordinances.
G. Upon request
of the Council, the Solicitor shall prepare or assist in preparing
any ordinance or resolution for introduction by Borough Council and,
when requested by Council, shall prepare and submit to Council for
its consideration any revision and codification of all general ordinances
of the Borough.

The Solicitor and Assistant Solicitor shall be paid for services
rendered at a reasonable hourly rate as set by Borough Council.
All original copies of papers, documents, memoranda, reports
and all other materials relating to the administration of the legal
duties of the Attorney shall be and remain the property of the Borough.
Upon the termination of his services with the Borough, the Attorney
shall forthwith surrender to any successor all such property at no
cost, together with a written consent to the substitution of any successor
in all legal actions and proceedings then pending to which the Borough
is a party.
