There is hereby created the position of Chief Financial Officer
in the Borough of Buena. The person appointed to this position shall
receive a salary which is set by resolution and which amount may be
revised from time to time by ordinance.
The Mayor shall nominate and, with the advice and consent of
Council, appoint a person to fill the position of Chief Financial
Officer of the Borough of Buena, which person shall be designated
as the "Borough Chief Financial Officer." Neither the Mayor nor a
member of the governing body shall be eligible to serve as Chief Financial
Officer in the Borough of Buena.
The Chief Financial Officer may be a resident of the Borough
of Buena or a nonresident and, once appointed, shall serve at the
pleasure of the Council, provided that any person serving in such
position for a period of not less than five consecutive years shall
be granted tenure in office upon compliance with the provisions of
N.J.S.A. 40A:9-140.8, as amended, in which event such shall not be
removed except for just cause, and then only in a manner provided
by N.J.S.A. 40A:9-140.1 et seq., as amended.
Commencing January 1, 1991, no person shall be appointed or
reappointed as Chief Financial Officer in the Borough of Buena unless
such person holds a municipal finance officer certificate issued pursuant
to the provisions of N.J.S.A. 40A:9-140.1 et seq., as amended, unless
such individual has obtained a waiver from the Division of Local Government.
The Chief Financial Officer of the Borough of Buena shall perform
such duties as may be assigned by the Mayor and Council and shall
carry out the responsibilities set forth by N.J.S.A. 52:27BB-26 et
seq., N.J.S.A. 40A:9-140.1 et seq. and such additional duties as may
be prescribed by other statutes of the State of New Jersey or by subsequent
ordinances adopted by the Council of the Borough of Buena.
