There is hereby created the office of Village Attorney, who
shall be appointed by the Village President with the advice and consent
of the Village Board, and who shall post with the Village a surety
bond conditioned upon the faithful and lawful performance of the duties
of the office of Village Attorney in such amount as may be required
by the Village President.
In addition to such other duties as may otherwise be required
by applicable law, the Village Attorney shall have the following duties,
powers and responsibilities:
A. Suits and proceedings. The Village Attorney shall appear to prosecute,
defend or otherwise represent the interests of the Village of Homer
Glen in any suit, action or proceeding of any nature or kind in which
the Village is a party or is otherwise interested and, without limiting
the foregoing, shall specifically be required to maintain such actions
as may be necessary to enforce the ordinances and regulations of the
Village, prosecute and defend appeals of suits or proceedings affecting
or involving the Village, or to enforce judgments obtained by the
Village.
B. Documents and instruments. The Village Attorney shall prepare, review,
and approve any and all documents, contracts, agreements, conveyances
or instruments of any nature or kind which affect or purport to affect
the interests of the Village, prior to execution or approval thereof
by the corporate authorities of the Village.
C. Advice and counsel. The Village Attorney shall provide such legal
advice, opinions and counsel to the Village, the Village President,
Village Board of Trustees, its officers, officials and employees,
as may be necessary from time to time in connection with their responsibilities
and duties to the Village, or the business and affairs of the Village.
D. Ordinances and resolutions. The Village Attorney shall draft and
prepare all ordinances and resolutions as may be requested from him
or her by the Village President or the Village Board of Trustees.
E. Meetings. The Village Attorney shall attend all meetings and proceedings
of the corporate authorities of the Village, and shall stand ready
upon request to report on the status of legal matters affecting or
involving the Village, and to provide advice to the Village President
or Village Board of Trustees with respect to such legal issues as
they may confront during the conduct of their meetings and proceedings.
