GENERAL REFERENCES
Zoning — Ch. 220.
The purpose of this chapter is to establish procedures and requirements for conducting special events in the Village in order to properly provide for the public health, safety and welfare; and to provide penalties for violation of this chapter.
As used in this chapter, the following terms shall have the meanings indicated:
SPECIAL EVENT
Any temporary occurrence conducted or sponsored by a person, organization, entity, or association, involving a display, demonstration, performance, exhibition, or amusement which includes, but is not limited to, festivals, concerts, carnivals, arts and craft shows, fireworks displays, sporting events, parades, rallies, and the like, excluding regularly scheduled sporting events conducted on property where such events are normally held.
No special event shall be held within the Village unless a permit is first obtained for such event.
Application to conduct a special event shall be made to the Village, in writing, by the person or persons in charge or responsible therefor. All applications for special event permits shall be made at least 30 days prior to the date on which the special event is sought to be held, unless the Village Manager waives the time requirement for good cause shown.
A. 
The following requirement shall apply to special events in all zoning districts: All temporary uses, buildings and structures shall observe all yard setback requirements for the districts in which the special events are located.
B. 
The following requirements shall apply to special events in residential districts:
(1) 
All lots in a residential district with a nonresidential use (e.g., churches, schools, etc.) shall comply with the restrictions set forth for special events in nonresidential districts.
(2) 
Special events shall be limited to a duration of one day each, with no less than 120 days between special events. In cases where the desired duration of such special event is outside the limits as described herein, upon application, the Village President shall have the authority to vary the permitted duration to accommodate the activities of such event.
(3) 
No special events shall begin activities before 9:00 a.m. nor conduct activities after 10:00 p.m. In cases where the desired hours of such special event are outside the limits as described herein, upon application, the Village President shall have the authority to vary the permitted hours to accommodate the activities of such event.
C. 
The following requirements shall apply to special events in nonresidential districts:
(1) 
All special events shall provide on-site parking for attendee vehicles in accordance with the applicable off-street parking and loading requirements for the zoning district in which the special event is being held as set forth in Chapter 220, Zoning, of the Village Code.
(2) 
Special events shall be limited to a duration of 10 days each, with no less than 60 days between special events. In cases where the desired duration of such special event is outside the limits as described herein, upon application, the Village President shall have the authority to vary the permitted duration to accommodate the activities of such event.
(3) 
No special events shall begin activities earlier than 9:00 a.m. nor conduct activities after 10:00 p.m. In cases where the desired hours of such special event are outside the limits as described herein, upon application, the Village President shall have the authority to vary the conditions of this section to accommodate the activities of such event.

In determining whether to approve a special event permit, the Village Manager may consider any factors reasonably deemed relevant for the proposed event and necessary to secure the public welfare, including, but not limited to, the following:
A. 
Whether the special event appears to be held for any unlawful purpose;
B. 
Whether it appears the special event may be conducted in a manner so as to cause a breach of the peace;
C. 
Whether the special event will unnecessarily interfere with the public use of the streets, sidewalks, parks and/or other public areas;
D. 
Whether the special event appears to be primarily for commercial purposes with no general benefit to the Village or the public;
E. 
Whether the special event may have some special right or priority under the law; and
F. 
Whether the special event would, in any way, be detrimental to the public health, safety and welfare.
The permit evidencing approval under this chapter may include reasonable time, place and manner restrictions as a condition to granting any permit if such restrictions are reasonable and necessary for the protection of the public health, safety and welfare.
A. 
No person shall knowingly participate in a special event for which no permit has been obtained;
B. 
No person shall continue to organize, or participate in the further planning or organizing of, a special event that is conducted without a permit after a permit has been denied;
C. 
No person in a position of influence or control over a special event shall allow the conduct of a special event without a permit;
D. 
No person shall violate any condition of a special event permit; and
E. 
No person shall violate any ordinance, rule or regulation of the Village during the planning, operation, or conclusion of a special event.
A. 
In addition to any and all additional remedies available at law, any person violating any provision of this chapter may be directed to:
(1) 
Cease and desist such violation; and
(2) 
Upon a finding of a violation of this chapter, pay a civil penalty of not less than $100 nor more than $1,000 for each violation.
B. 
Every day a violation continues shall constitute a separate and distinct offense.
Proceedings to enforce violations of this chapter may be initiated and conducted in accordance with and pursuant to the administrative adjudication provisions of Chapter 1, Article III, Penalties and Enforcement, or by any other means provided by law for enforcement of code violations.
