A. Open burning will be allowed in the City of Weston, Missouri, within
the following parameters:
1.
It shall be unlawful to burn or attempt to burn any item other
than leaves, small twigs, and small tree branches not to exceed four
(4) inches in diameter. No burning of building materials will be permitted.
Building materials shall include, but are not limited to, tires, rubber
products, asbestos-containing material, hazardous material, Styrofoam,
plastics, petroleum-based products, treated wood and other refuse.
2.
It shall be unlawful to conduct any burn on a day in which the
wind is blowing in excess of ten (10) miles per hour or on any day
in which the conditions are excessively dry.
3.
Burning shall be permitted only between the hours of 7:00 A.M.
and 7:00 P.M., and all burns shall be completely extinguished by 7:00
P.M.
4.
No burning of any kind shall be allowed in any public street.
5.
It shall be unlawful to burn yard waste if the waste is in excess
of two hundred (200) cubic feet (for example, ten (10) feet by ten
(10) feet by two (2) feet).
6.
An adult [over the age of eighteen (18)] must be present at
all times during any burn until such time as the entirety of the burn
is extinguished. The adult present at the burn shall be required to
have a rake and water hose on the site of the burn at all times.
7.
It shall be unlawful to burn underneath any electrical, telephone,
or cable television lines.
8.
It shall be unlawful to conduct any burn within fifty (50) feet
of any structure.
9.
If at any time a burn is causing heavy smoke or odor that is
harmful to the general public or is deemed to be dangerous by the
opinion of the West Platte Fire Protection District or by any officer
of the Weston Police Department, the burn may be required or caused
to be extinguished immediately.
10.
Any individual found to be in violation of this Section shall be subject to the general penalty provisions found in Section
100.220 of the Municipal Code of the City of Weston.
