The following are hereby established as the parking lots operated by the Borough of Burgettstown:
A. 
Parking Lot No. 1 is the metered lot on the east side of Main Street across from Citizen's Bank.
B. 
Parking Lot No. 2 is the unmetered lot west of the Main Street Extension. The provisions of § 475-36 shall apply to this lot.

The time limits and charges for parking on Lot No. 1 shall be as set by resolution of the Borough Council, provided each parking meter in the said lot shall be in operation, and the provisions of this chapter regulating such operation and establishing parking time limits shall be in force from 8:00 a.m. to 6:00 p.m., Monday through Saturday, but not on Sundays and legal holidays.

A. 
Parking meters installed in the said lots shall be placed immediately adjacent to the individual parking spaces that shall be marked off in the said lots. Each parking meter shall be placed or set in such manner as to show the parking space adjacent to such meter is or is not legally occupied. Each parking meter installed shall indicate by a proper legend the legal time established by this article and, when occupied, shall indicate on and by its dial and pointer the duration of the period of legal parking and, on the expiration of such period, shall indicate illegal parking or overparking.
B. 
The Council may from time to time establish areas within any off-street parking area which shall be for the use of permit parking only. Persons having monthly parking permits shall use the designated areas within the off-street lots and shall not park at a meter. Persons who do not have a valid and current monthly permit shall not park in the permit only areas. Boundaries of each parking space in the permit only areas shall be marked in the same manner as for the metered spaces, and the remainder of the requirements herein shall continue to govern the manner of parking therein.
Lines and/or markings shall be painted or placed upon the various metered parking lots hereby established, adjacent to each parking meter, for the purpose of designating the parking space for which such meter shall be used. Each vehicle parked adjacent to any parking meter shall be parked within the lines or markings so placed and applicable to such meter. It shall be unlawful and a violation of this article for any person to park any vehicle across any such line or marking, or to park any vehicle in such a position that such vehicle shall not be within the area so designated by such lines or markings, or to park a vehicle elsewhere in any such lot than in an individual parking space adjacent to a parking meter.
It shall be unlawful to park any vehicle in Lot No. 1 otherwise than with the foremost part of the parked vehicle nearest to the parking meter applicable thereto.

Whenever a vehicle is to be parked in Lot No. 1, any time during which the parking meters therein shall be in operation, the operator of such vehicle shall, upon entering a parking space adjacent to a parking meter, immediately deposit, or cause to be deposited, in such parking meter, one or more coins of the United States as shall be specified in the legend upon such parking meter. Upon the deposit of such coin or coins, and placing the meter in operation, such parking space may be lawfully occupied by such vehicle for the length of time designated by § 475-34 of this article for parking in the said parking lot upon deposit of such coin or coins. If any vehicle shall remain in any such parking space for such length of time that the meter shall indicate by a proper signal that the lawful parking time shall have expired, such vehicle shall be considered as having been parked overtime, and the parking of a vehicle overtime shall be a violation of this article. Every hour that a vehicle shall remain parked at a meter showing a violation shall constitute a separate violation of this article.

A. 
It shall be unlawful, and a violation of this article, for any person to deface, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this article; provided, however, that nothing herein shall apply to the servicing or opening of parking meters by officers, employees and/or police officers of the Borough under the direction of the Borough Secretary-Treasurer and/or the Borough Council.
B. 
Any person who violates or permits a violation of this section shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the county correctional facility for a period not exceeding 30 days. Each day that such violation exists shall constitute a separate offense, and each provision of this section that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this subsection, the Borough may enforce this section in equity in the Court of Common Pleas of Washington County.

A. 
It shall be the duty of the police officers of the Borough, acting in accordance with instructions of the Chief of Police, to report:
(1) 
The name of the parking lot and the number of the parking meter therein that indicates that the vehicle occupying the parking space adjacent thereto is, or has been, parked in violation of any of the provisions of this article;
(2) 
The date and time of such violation;
(3) 
The state license number of such vehicle;
(4) 
Any other facts, the knowledge of which shall be necessary for a full understanding of the circumstances attending such violation;
(5) 
The exact location of the violation.
B. 
Every such police officer shall also place upon such vehicle a notice to the owner or operator thereof that such vehicle was parked in violation of the provisions of this article and instructing such owner or operator that if he shall report to the office of the Chief of Police and pay, for the use of the Borough, the fines set forth in this article, and that if such fine is voluntarily paid within 48 hours of the violation, a discount of 5% shall be deducted from the fine due.

Except as provided in § 475-39, Tampering with meters prohibited, violations of this article shall be punishable as provided in Article X, Violations and Penalties, of this chapter.
