The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
FIRE PREVENTION CODE
The latest edition of the Virginia Statewide Fire Prevention Code, as amended.

A. 
Code enforcement. The fire prevention code shall be enforced by the Fire Code Official.
B. 
Appointment. The Fire Code Official shall be appointed by the Chief of the Fire Department with the approval of the City Manager.
C. 
Inspectors. The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary.
D. 
Powers and duties. The Fire Code Official and assistants shall have all the powers and duties as established in Chapter 3, Title 27, Code of Virginia (1950), as amended.
E. 
Annual report. A report of the bureau of fire prevention shall be made annually and transmitted to the City Manager. The report shall contain all proceedings under this article with such statistics as the Chief of the Fire Department may wish to include therein. The Chief of the Fire Department shall also recommend any amendments to this article which, in his judgment, shall be desirable.

A. 
The City shall enforce the Virginia Statewide Fire Prevention Code, published and adopted by the state department of housing and community development under authority of Code of Virginia, § 27-94 et seq., in its entirety, except such portions as are deleted, modified, or added herein. All persons engaged in activities within the City that are regulated by the Virginia Statewide Fire Prevention Code shall comply therewith.
B. 
For public inspection during working hours, three copies of the Virginia Statewide Fire Prevention Code with any subsequent modifications or amendments shall be kept at the office of the Chief of the Fire Department and one copy shall be kept in the Clerk's office of the General District Court of the City.
C. 
The responsibility to enforce the Virginia Statewide Fire Prevention Code is assigned to the Fire Department.

A. 
It shall be unlawful for any person to burn trash, refuse, grass, rubbish, or debris or authorize any such fire to be kindled or maintained on any private land, yard, alley, field, street, or other open place within the corporate limits of the City. Any person may burn over any field or lot within the corporate limits when such burning is done with permission of and under the supervision of the Chief of the Fire Department, or one of his assistants, and it shall be the duty of the Fire Chief to supervise every such burning or direct one of his assistants to do so.
B. 
Open burning for the instruction of public or industrial employees in firefighting or emergency services may be permitted by the Chief of the Fire Department and is excepted from the provisions of this section.

The City Building Official and the fire official shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes, or occupancies which shall require permits in addition to those required by this article. The fire official shall post a list of such materials, processes and occupancies in a conspicuous place in his office and distribute copies thereof to interested persons.

The Fire Prevention Appeals Board shall have the powers and duties set forth in Code of Virginia, § 27.98, and the Virginia Statewide Fire Prevention Code, and shall operate in accordance with the provisions of Chapter 10, Article II, Division 10.
