The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
OPERATOR and MANAGER
The individual responsible for operation and management of the swimming facility.
PPM
Parts per million.
SWIMMING FACILITY
Any swimming pool, wading pool, or spray pool entirely of artificial construction and for use by the general public or the occupants or members of any institution, school, association, or group.
SWIMMING POOL
An artificial permanent basin or tank, including all appurtenant equipment, structures and facilities, for the purpose of impounding water to a depth of more than three feet for the immersion or partial immersion therein of human beings.

A. 
This article, except as otherwise provided in this article, is adopted to provide regulations relating to the maintenance of sanitation and safety features applicable to the use and operation of all constructed swimming facilities, excepting those facilities set forth in this section; to provide for the requirement of permits and licenses for constructed bathing places; and to provide for the administration and enforcement thereof by the Health Officer.
B. 
There is expressly excluded from the operation of this article the following swimming facilities:
(1) 
Those exclusively owned by not more than one family and used exclusively by such family and their guests without compensation or charge of any kind payable by such guests.
(2) 
Single-occupant tanks or showers used exclusively for therapeutic purposes.

The primary purposes of this article in its application to swimming facilities are to:
A. 
Ensure that the water in such swimming facility is sufficiently clear, free from dirt or other foreign substances and properly treated by approved chemicals to make it free from undue hazard to the health of its patrons and the citizens of the City.
B. 
Ensure that the appurtenances of such swimming facility are so organized and operated that they promote and protect the safety of its patrons and of the citizens of the City.
C. 
Provide the Health Officer with a means of ensuring that these objectives are carried out and made effective both with respect to existing swimming facilities and for those which may be built in the future.

A violation of any provision of this article shall constitute a misdemeanor. Any person, upon conviction therefor, shall be fined not less than $10 and not more than $1,000. Each day that any person remains in violation of any provision of this article shall constitute a separate offense.

When the Health Officer finds that the provisions of this article are not met and that any condition exists that endangers the life, health, or safety of the users of any swimming facility, he may order the facility closed until the condition is corrected. Failure to comply with such order of the Health Officer shall be cause for cancellation of the license described in § 50-96.
[Code 1991, § 10-121]
No person shall operate a swimming facility unless an annual license has been secured from the Commissioner of the Revenue. This license shall be issued only after the approval of the Health Officer and payment of a fee of $25 to the City Treasurer. The license fee shall not be prorated. The operation and maintenance of any swimming facility in a manner not in accordance with the provisions of this article shall be justification for cancellation of this license. The license fee shall be nonrefundable, in whole or in part, for any cause whatsoever, including but not limited to cancellation of the license.

No person shall operate a swimming facility unless it is under the immediate control of an operator holding an operator's permit issued by the Health Officer. Operator's permits shall be issued only to individuals. An applicant for an operator's permit shall:
A. 
Have basic knowledge of the water treatment processes in swimming facilities.
B. 
Know proper technique for collection of water samples for bacteriological analysis.
C. 
Be capable of performing the chemical tests necessary to effect control of swimming facilities.
D. 
Have a certificate of successful completion from a recognized short course school for swimming pool operators and managers approved by the Health Officer.

A. 
Operating records.
(1) 
A daily record of the operation of the swimming pool shall be maintained by the operator. The record shall include:
(a) 
Date.
(b) 
pH and free available chlorine residual at least every three hours during pool operation.
(c) 
Weather conditions.
(d) 
Chemicals added and amounts.
(e) 
Filter pressures (inlet and outlet gauges).
(f) 
Filter rate of flow in gallons per minute.
(g) 
Details of all accidents.
(2) 
If requested to do so by the Health Officer, the operator shall submit weekly to the Health Officer a copy of the daily record on forms supplied by the Health Officer.
B. 
Disinfection.
(1) 
The chlorination equipment shall be operated so as to maintain a free available chlorine residual of not less than one ppm at all points throughout the swimming pool water when there are swimmers present. All free available chlorine residual determinations shall be made by using testing methods approved by the Health Officer.
(2) 
If the chlorine residual is stabilized by using cyanuric acid, the chlorination equipment shall be operated so as to maintain a free available chlorine residual of not less than 1.5 ppm at all points throughout the swimming pool water when there are swimmers present. The cyanuric acid content shall range from 61 ppm to 100 ppm, not exceeding 100 ppm.
C. 
pH. The pH of the water in the swimming pool shall be not less than pH 7.2 and not more than eight.
D. 
Filtration. The filters shall be operated 24 hours per day during the season of use of the swimming pool. At all times when the pool is opened for use, the water shall be sufficiently clear to permit a disc six inches in diameter, divided into alternate black and white quadrants, when placed on the bottom of the pool at the deepest point, to be clearly visible from the swimming pool deck at all distances up to 10 yards in a horizontal direction from projection of the disc on the swimming pool surface.
E. 
Chemicals. Chemicals other than chlorine, sodium or calcium hypochlorite, bromine, lime, soda ash, and aluminum sulfate, muriatic acid, and cyanuric acid shall not be used to treat swimming pool water without permission from the Health Officer.
F. 
Suction cleaner. The suction cleaner shall be used at such times as necessary to keep the flow of the swimming pool free from all visible sediment.
G. 
Supervision of operation. The operation of the swimming pool and all of its appurtenances shall be under the direct supervision of an individual having an operator's permit.
H. 
Filter room placard. A placard shall be prominently displayed in the filter room showing the following data: dimensions of the swimming pool in feet, volume of the swimming pool in gallons, area of the filters in square feet, filtering rate in gallons per minute, capacity of the pumps in gallons per minute at the appropriate head in feet, head loss at which the filters should be backwashed, and any other operating data the operator or Health Officer considers pertinent.
I. 
Food and drink area. Any person in the process of eating or drinking shall be confined to the area designated for preparation and serving of food and drink, and shall not be allowed on the deck or in the swimming pool.
J. 
Lifeguards.
(1) 
When a swimming pool is open, there shall be a sign clearly visible at the swimming pool stating when a lifeguard is not in attendance. Any individual on duty as lifeguard shall possess a valid lifeguard certificate issued by the American Red Cross.
(2) 
It shall be unlawful for pool owners or operators to allow minors to use a swimming pool at a time when there is no lifeguard on duty, unless they are accompanied by a parent, guardian, or other responsible adult.
K. 
Health Officer inspection. The Health Officer shall inspect the swimming facility as often as he deems necessary. If the Health Officer finds any condition at the swimming facility which in his judgment may in the future endanger the life, health, or safety of the users of the swimming facility, the Health Officer shall notify the operator in writing to correct such conditions within a reasonable time not exceeding 30 days from the date of such notice. If such condition is not corrected within the time prescribed, the Health Officer may order the facility closed until the condition is corrected.

A. 
Soap for use by the swimming facility users shall be provided at each shower and each lavatory.
B. 
Common use of brushes, combs, towels, and drinking cups is prohibited.
C. 
Suits and towels, when provided by the management of the swimming facility, shall be laundered after each use and handled in a healthful and safe manner.
D. 
The floors of dressing rooms shall be maintained in a clean and dry condition when the swimming facility is not in use to aid in the prevention or spread of athlete's foot disease.
E. 
All dressing room facilities shall be maintained in a healthful and safe manner. Toilet paper shall be provided at each water closet and female urinal.
